PRELIMINARY/FINAL PLAT - -THE OAKS OF MAINSTREET
Proposed Action.
Staff recommends the following motion: Move to approve Resolution 96 -98. approving a
preliminary /final plat for The Oaks of Mainstreet.
At the Zoning and Planning meeting, Mr. Blair moved and Mr. Gross seconded a motion to
approve Resolution RZ96 -19, recommending approval of a preliminary /final plat for the Oaks
of Mainstreet The motion carried unanimously.
Overview.
The applicant has been approved and is in the process of constructing 66 townhomes on what
was the Pines Mobile Home Park, located on the southeast corner of Mainstreet and Shady
Oak Road. The applicant is proposing ten, six-unit buildings. The buildings will be a variety
of one and two -story units The last City approval that is needed is plat approval.
The plat will divide the site into six blocks with each unit townhouse footprint plus additional
land for decks, steps, etc. The common area will also be a lot.

o Does the proposed plat meet the zoning requirements?
The townhomes will be platted as townhomes. By platting the townhomes as townhomes, the
only area that a homeowner will own is the building footprint plus additional land for the
deck, steps, etc. All other areas on the site will be owned by the association. The setback
areas are from the site as a whole. The plat shows the setbacks for the R -2 zoning. The
proposed plat meets the zoning requirements.
o Does the proposed plat meet the subdivision requirements?
The plat as proposed meets the subdivision requirements. The plat will dedicate right -of -way
for what is currently used for Mainstreet and 19th Avenue. The roadway system throughout
the site is considered an alley. The alley meets the minimum width requirements of 20 feet.
The site plan reflects the proposed realigning and upgrading of Shady Oak Road. The
applicant aligned the site with the plans of Shady Oak Road that were provided to the City
from the County. The County is required to review all proposed plats that abut a county road.
As of the date of this report, no comments have been received from the County.
The Building Inspection and Engineering departments have reviewed the plat and found it
• acceptable.
o Is a park dedication fee required?
A park dedication fee is required. Each unit will be required to pay $200.00.
o What was the discussion at the Zoning and Planning meeting?
Staff noted that this was the last City approval needed to proceed for the redevelopment of
the Pines Mobile Home Park. Keith Jans, representing Real Estate Equities, appeared before
the Commission. The Commission asked Mr. Jans when the Commission would be reviewing
the fence and signs. Mr. Jans stated that they probably will present the fence and signs to the
Commission in January. No one in the audience spoke at the public hearing.
Alternatives.
1. Approve the preliminary/final plat for the Oaks of Mainstreet. By approving of the
preliminary/final plat, the subject property will be platted.
2. Deny the preliminary /final plat for the Oaks of Mainstreet. By denying the
preliminary/final plat, the subject property will not be platted and the development will not
proceed. If the City Council considers this alternative, findings will have to be identified
that support this alternative.

3. Continue for further information. If the City Council indicates that further information is
needed, the item should be continued.
