CR 96-07 Vacation Of Easement - 1106-1124 MainstreetJanuary 10, 1996 Council Report 96 -7 VACATION OF UTILITY EASEMENT-1106-1124 MAINSTREET Proposed Action. Staff recommends the following motion: Move to approve Resolution 96 -4. approving Ordinance 96 -778. vacating a utility easement at 1106 -1124 Mainstreet, for first reading, Overview. There currently is a 14 -foot wide utility easement on the site where the theater /restaurant is being constructed. The utility easement runs east -west, the entire site. The proposed theater and restaurant buildings will be located over the utility easement. The utility easement was for a storm sewer that is now not being used. The subject storm sewer was rerouted during the Mainstreet project with the anticipation of the site being redeveloped. NSP also has their power lines across the subject easement. (103)1 (104) 1(138) 1 06bc • WHEREAS, the City of Hopkins has approved the construction of a theater and restaurant at 1106 -1124 Mainstreet; WHEREAS, there is an abandoned storm sewer at 1106 -1124 Mainstreet; WHEREAS, there is an existing utility easement for the storm sewer at 1106 -1124 Mainstreet; WHEREAS, the subject storm sewer was rerouted during the Mainstreet project; and WHEREAS, the utility easement at 1106 -1124 Mainstreet is not needed by the City of Hopkins. NOW, THEREFORE, BE IT RESOLVED that the utility easement at 1106 -1124 Mainstreet is hereby vacated. Adopted this 16th day of January 1996. ATTEST: James A. It is the intent of this vacation to vacate the public utility easement retained by the City of Hopkins, Minnesota, in the Ordinance recorded as Hennepin County Recorder Document No. 721564.
