VACATEALLEY-CORNERSTONE
Proposed Action.
Staff recommends the following motion: Move to adopt Resolution 06-16, aooroving
Ordinance 06-961. aoproving the vacation of the allev in the Marketolace Lofts develooment
for first reading.
At the Zoning and Planning meeting, Ms. Hatcher moved and Mr. Aarness seconded a
motion to adopt Resolution RZ06-05, recommending approval of Ordinance 06-961,
approving the vacation of the alley in the Marketplace Lofts development. The motion was
approved unanimously.
Overview.
Hopkins Honda has moved to the former Knox site. This relocation will remove the entire
Honda line from downtown Hopkins. The site on Fifth and Mainstreet will become Hopkins
Dodge. The area occupied by Honda on Sixth and Seventh Avenues will be available for
redevelopment.
The applicant, The Cornerstone Group, is proposing to redevelop the Hopkins Honda area on
the north side of Mainstreet. The area is an odd shape that presents challenges in the
redevelopment of the sites. The triangular area on the north side of Mainstreet between Sixth
and Seventh Avenues would be a row of five townhomes. The area where the old Honda
showroom was located and the area to the north will be a retaillcondo building. The last area
used by Honda along Eighth Avenue would be another row of four townhomes.

Primarv Issues to Consider.
· What is the zoning of the property, and how has the Comprehensive Plan
designated the subject site?
The zoning of the property is B-3, General Business. In order for this development to occur
the property will have to be rezoned to POD; this would allow flexibility in the uses and site
development. The Comprehensive Plan has designated this site as Commercial. The base
zoning will remain.
. Is the alley needed for a public purpose?
The public works department reviewed the proposed vacation and determined that the alley
to be vacated is not needed for a public purpose.
· What is the staff recommendation for the vacation?
Staffis recommending approval ofthe vacation.
· What were the responses from the utility companies regarding the vacation?
Center Point, Energy, Excel, Qwest, and Time Warner Cable were notified of the vacation.
Time Warner, Center Point Energy, and Qwest responded to the proposed vacation. Qwest
will require an easement for the conduit system in the alley.
· What was the discussion at the Zoning and Planning meeting?
Ms. Anderson stated that the east-west alley needs to be vacated for the development to
proceed. No one appeared at the public hearing regarding this item.
Alternatives.
1. Approval the vacation of the alley. By approving the vacation, the applicant will be able
to construct the condos as proposed.
2. Deny the vacation of the alley. By denying the vacation, the applicant will not be able to
construct the condos as proposed. If the City Council considers this alternative, findings
will have to be identified that support this alternative.
3. Continue for further information. If the City Council indicates that further information is
needed, the item should be continued.

RESOLUTION MAKING FINDINGS OF FACT AND APPROVING
THE VACATION OF AN ALLEY
WHEREAS, an application for Vacation V AC06-1 has been made by The Cornerstone Group;
WHEREAS, the procedural history of the application is as follows:
1. That an application for a vacation of the alley was made by The Cornerstone Group on
January 27,2006;
2. That the Hopkins Zoning and Planning Commission, pursuant to mailed and published
notice, held a public hearing on the application and reviewed such application on February
28, 2006: all persons present were given an opportunity to be heard;
3. That the written comments and analysis of City staff were considered; and
4. A legal description of the alley to be vacated is as follows:
That part of the alley dedicated in Block 66, Minneapolis Second Division,
Hennepin County, Minnesota, accruing to Lots 6 through 9 inclusive, Block
66; except that portion of said alley vacated per Document No. 6818606,
Hennepin County Records.
NOW, THEREFORE, BE IT RESOLVED that the application for vacation VAC06-l is hereby
approved based on the following Findings of Fact:
1. That the above-described alley is not needed for a public purpose.
BE IT FURTHER RESOLVED that application for vacation V AC06-l is hereby approved based
on the following conditions:
1. That the site plan is approved.
2. That the preliminary/final plat is approved.
3. That Qwest have an easement for the existing conduit system.
4. That a utility easement is granted to Excel Energy.
