Public Hearing To Correct Omissions
Mainstreet Reconstruction
Proposed Action.
Staff recommends the following motion: Move that Council
adopt Resolution 91-03, Resolution Orderina Mainstreet
Reconstruction Improvement To Include Previously Omitted
Parcels.
Overview.
On September 18, 1990, Council conducted a public hearing
concerning reconstruction of Mainstreet. Procedures for
hearing publication in the official newspaper were followed
and hearing notices were mailed to owners of affected
parcels. Unfortunately four parcels were overlooked in the
mail notices, and a public hearing was called to address
this oversight.

0 What are the four omitted parcels?
The four omitted parcels are to be found on the
attached location maps and are legally described as
follows:
1. Lot 16, Block 15, West Minneapolis Third Division.
2. Lots 1 to 10 incl. and Lots 40, 41, 42 incl. adj.
1/2 of vacated alley, and ex. alley, Block 2, West
Minneapolis~
3. That part of a 60 ft. wide RR R/W across the NW
1/4 of the SE 1/4 lying East of the easterly R/W
of 7th Avenue and lying North of the centerline of
Excelsior Avenue and lying southwesterly of a line
drawn parallel and 15 ft. southwesterly from the
centerline of the main track of the Chicago and
Northwestern Trans. Co. as the track is located,
exoept road, Sec. 24, T. 117, R. 22.
4. Lot A, West Minneapolis and that part of 100 ft.
RR R/W lying northeasterly of a line parallel with
and 22.58 ft. northeasterly from centerline of.
. said R/W and lying southeasterly of Excelsior
Avenue and westerly of 5th Avenue, also that part
of the SW 1/4 of the SE 1/4 lying northeasterly of
said RR R/W, except road, Sec. 24, T. 117, R. 22.
0 Why is a hearing necessary?
Because the four parcels in question did not receive
mailed notices of the original hearing on September 18,
1990, the assessment procedures for them would be
flawed. Holding a public hearing for them removes the
jeopardy of losing potential assessments.

RESOLUTION NO: 91-03
RESOLUTION ORDERING MAIN STREET RECONSTRUCTION IMPROVEMENT TO
INCLUDE PREVIOUSLY OMITTED PARCELS
WHEREAS, a resolution of the city Council adopted the 21st
day of August, 1990, fixed a date for a Council hearing
on the proposed improvement of Mainstreet from
Washington Avenue to Shady Oak Road by way of street
and utility reconstruction, and installation of
lighting and landscape amenities and
WHEREAS, ten days' mailed notice and two weeks' published
notice of the hearing was given, and the hearing was
held thereon on the 18th day of September, 1990, at
which all persons desiring to be heard were given an
opportunity to be heard thereon and
. WHEREAS, certain parcels in the assessment area were not
given mailed notice and a public hearing was held on
the 8th day of January, 1991, at which all persons
desiring to be heard, and 'more specifically the owners
of those parcels who had not received mailed notice,
were given an opportunity to be heard thereon,
NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
HOPKINS, MINNESOTA:
Such improvement as ordered in Resolution No. 90-112 on
November 6, 1990, is hereby ordered to include and to affect
more specifically the following legally described parcels:
1. Lot 16, Block 15, West Minneapolis Third Division.
2. Lots 1 to 10 incl. and Lots 40, 41, 42 incl. adj
1/2 of vacated alley, and ex. alley, Block 2, West
Minneapolis.
