Approval of this motion would allow Monk Enterprises, Inc. to conduct a sale in 810 First Street s. Overview Monk Enterprises, Inc. is seeking a transient merchant license ln order to conduct a sale from April 1 to May 1 in the building located at 810 First st. s. . Council Report #91-46 Page Two Primary Issues to consider 0 Does Monk Enterprises, Inc. meet the conditions for a transient merchant license? Yes. A transient merchant is defined as: "Transient merchantll means and includes persons...who engage in or transact any temporary or transient business in this state,...selling goods, wares and merchandise, and who for the purpose of carrying on such business, hire or lease...a building,...for the exhibition and sale of such goods, wares and merchandise. 0 Does this sale meet the zoning requirments? This area is zoned industrial. The zoning ordinance was amended ln 1990 to allow retail sales ln industrial areas as long as no more than 25% of the building is used for retail. Eddie Bauer has agreed to this condition. The lease indicates that 5,513 . s. f. or 8.1% of the building is being used for this sale. 0 Is there sufficient parking? A retail operation of this size is only required to have approximately 25 parking spaces available. Alternatives 1) Approve the transient merchant license. This will allow Monk Enterprises, Inc. to conduct a sale. 2 ) Approve the license with conditions. Conditions could include hours of operations, security, etc. 3) Do not approve the transient merchant license. .
