Resolution Orderinq storm Sewer and Parking Lot Improvements - Bursch Redevelopment site. This action will begin the process of reconstructing and installing storm sewer north and south of the presently vacant Bursch Restaurant and improving the adjoining parking lot. Overview. Recent Council action set in motion redevelopment of the Bursch Restaurant ,site with the construction of a movie theater. site plans for the new theater call for the location of the building that puts it in conflict with an existing city storm sewer system. Location of the proposed theater building is therefore the driving force behind '.". reconstruction of existing storm sewer as well, as , installation of a new system at the south end of the site and in the parking lot. Primary Issues to Consider. o What'are the proposed storm sewer and parking lot improvements? o What are the sources of funding? o What agreements with the developer are necessary? o What is the timetable for design, bidding and construction? o What is the staff's recommendation for the choice of engineering services? Analvsis. o What are the proposed storm sewer improvements? An attached site map illustrates the needed improvements. Proposed is the installation of new sewer in the alley north of the present building, abandonment of an existing 36" sewer immediately north and in the alley east of the present building, installation of new storm sewer in the parking lot, and installation of new sewer from the existing structure at the Hopkins Plaza Apartments to 8th Avenue South. Estimated costs total $60,000. Parking lot improvements are summarized as follows: Lighting - poles, fixtures, underground electrical installation Bituminous reconstruction - 2" overlay Curbs - in parking lot and on 7th Avenue Sidewalk - replacement where necessary . Striping Signage The estimated cost~ for parking lot improvements also totals $60,000. ' o What are the sources of funding? It is proposed that the developer assume liability of 100% of the engineering costs until the construction phase ($6340 estimated). After that point the developer would assume 40% of the storm sewer engineering and construction costs. Remaining costs would be borne by the City with TIF funds. o What agreements with the developer are necessary? Staff recommends at minimum that prior to plan and specification preparation that the developer be required to provide a letter of credit or some other security for 100% of the cost of the plan phase for the total project. In addition, staff recommends that the developer provide a letter of credit by May 1, 1991, for the construction phase of the storm sewer project based on the following: ~ A. If the developer has completed all required conditions in sections 2.2 and 2.3 of the forthcoming development agreement with the City, . he shall provide a letter of credit for 150% of his 40% share of the storm sewer construction (not to exceed $30,400). Sections 2.2 and 2.3 require secured financing, building permits, securing the subject property from HRA, and being in a position to proceed with the project immediately. B. If the developer is not in a position to proceed by May 2 he shall be required to provide a letter of credit in the amount of 150% of the total cost of storm sewer construction. C. At such time the letter of credit for the construction phase is provided, the letter of credit for the design phase shall be refunded to the developer. 0 What is the timetable for design, bidding and construction? The following is a proposed project schedule: March 5 Council authorizes project e March 5-April 1 Plans and specs developed April 2 Council approves plans and authorizes bidding April 10 & 17 Advertise in Sailor April 12 & 19 Advertise in Construction Bulletin May 1 Bid Opening May 7 Award of bid May 13 Begin construction Attached is an activity schedule that illustrates the potential conflict this project could have with the Alley Underground Utilitiep Project and the Mainstreet Project. It is of utmost importance for new storm sewer to be placed in the alley between 7th and 8th Avenues before electrical underground utilities are installed in that same alley. The storm sewer must be installed by June 1 in order to allow ample time for the alley underground project to be completed. e e 0 What is the staff's recommendation for the choice of engineering services? staff received scope of services proposals from RCM, TKDA and Westwood. The engineering services proposed appear to be similar. Differences in engineering fees are listed below: TKDA 14% of estimated construction cost RCM 5.3% of estimated construction cost Westwood 5.0% of estimated construction cost Based on RCM Associate's extensive knowledge of the City's storm sewer system and its past performance with storm sewer projects, staff recommends that RCM Associates be designated project engineer for this improvement. . . CITY OF HOPKINS Hennepin County, Minnesota RESOLUTION NO: 91-28 RESOLUTION ORDERING IMPROVEMENT AND AUTHORIZING PROFESSIONAL SERVICES WHEREAS, a project has been proposed to the Council that encompases reconstruction of existing storm sewer, installation of new storm sewer pipes, and reconstruction of a parking lot at the vacant Bursch Restaurant Site with an estimated cost of $120,000, NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF HOPKINS, MINNESOTA: 1. Such improvement is hereby ordered as proposed and that RCM Associates, Inc. is hereby designated as the engineer for this improvement and shall prepare plans and specifications for the making of such improvement. . 2. Authorization to proceed with this project shall be contingent upon the developer providing security for 100% of the design and plan phase costs for the storm sewer and parking lot improvements by March 8, 1991.
