Proposed Action Staff recommends that the Council approve the following motion: Move approval of a transient merchants license for Eddie Bauer. Inc. Approval of this motion would allow Eddie Bauer, Inc. to conduct a sale in westside Park. Overview Eddie Bauer, Inc. is seeking a transient merchant license in order to conduct a sale from March 6 to March 24 in Westside Park. Eddie Bauer will be leasing space for this sale. The plan is for the sale to take . place at the following times: Monday - Friday: 10 am - 9 pm saturday: 10 am - 6 pm Sunday: 11 am - 5 pm Primary Issues to Consider 0 Does Eddie Bauer, Inc. meet the conditions for a transient merchant license? 0 Does this sale meet the zoning requirments? 0 Is there sufficient parking? 0 Is this a proper area for a retail sale? 0 What impact will this sale have on Hopkins? A transient merchant is defined as: "Transient merchant II means and includes persons...who engage in or transact any temporary or transient business in this state,...selling goods, wares and merchandise, and who for the purpose of carrying on such business, hire or lease.. .a building,...for the exhibition and sale of such goods, wares and merchandise. 0 Does this sale meet the zoning requirments? This area is zoned industrial. The zoning ordinance was amended in 1990 to allow retail sales in industrial areas as long as no more than 25% of the building is used for retail. Eddie Bauer has agreed . to this condition. The site plan shows almost half of the 114,000 s. f. being leased by Eddie Bauer. A large part of this area, however, will be used for storage. 0 Is there sufficient parking? There are more than 400 parking spaces available. This meets the zoning requirements for the approximately 30,000 s.f. of retail that is planned to be used. Whether this will be sufficient depends on how many people will attend the sale. 0 Is this a proper area for a retail sale? This area was not designed to be used for retail. While there is probably sufficient parking, there may be considerable traffic generated. The zoning ordinance, however, allows this use. The president of the Park Valley neighborhood association has been notified. . , . Council Report #91-46 Page Three 0 What impact will this sale have on Hopkins? This is a difficult question since it is not possible to know how many people will be attracted to this sale. There will be traffic congestion. There will probably an impact on the surrounding residential area. There will be additional demands on city services such as police. Eddie Bauer has agreed to pay for either Hopkins police officers or other security to provide for traffic control and security within the building. Alternatives 1) Approve the transient merchant license. This will allow Eddie Bauer, Inc. to conduct a sale in Wests ide Park from March 6 to March 24. . 2) Approve the license with conditions. CITY OF HOPKINS Hennepin County, Minnesota RESOLUTION NO. 91-25 A RESOLUTION APPROVING A REQUEST FOR SPECIAL LEGISLATION GMNG HOPKINS THE AUTHORIlY TO RAISE MONIES TO PAY FOR REMEDIAL ACTION AT THE HOPKINS LANDFILL WHEREAS, Hopkins has entered into a Closure Agreement with the Minnesota Pollution Control Agency which requires the City of Hopkins to study and remediate environmental concerns at the Hopkins landfill, and WHEREAS, Methane gas monitoring has indicated the need to perform remedial action at the landfill, and WHEREAS, the Council desires to perform a remedial action project at the Landfill, and WHEREAS, the City of Hopkins has limited abilities in which to raise funds in which to pay for remedial action, . NOW, THEREFORE BE IT RESOLVED by the City Council of Hopkins, Minnesota that the City Council approves and requests that the State of Minnesota grant Hopkins the authority to issue bonds to pay for the cost of clean-up at a landfill in the city and to impose garbage collectIOn surcharges, a landfill clean~up property assessment, and a service charge to be collected like a property tax to pay costs of clean-up or to payoff the bonds. The Council also requests an appropriation of money from the Metropolitan Contingency Action Trust Fund for a portion of the clean-up costs. Authorizes Hopkins to issue bonds in a maximum total amount of $5,000,000 for limited cleanup costs at a specific landfill and to borrow money in anticipation of the bonds. SEC. 3. Revenue Mechanisms. Authorizes Hopkins to raise revenue in three different ways to pay cleanup costs directly and to make payments on the bonds. SUBDMSION 1. Authority. Authorizes imposition of the various revenue mechanisms not to exceed $400,000 per year from a combination of all the mechanisms. SUBD. 2. Solid Waste Collection Surcharge. Authorizes the city to impose a solid waste collection service surcharge. SURD. 3. Landfill Cleanup Assessment. Authorizes the city to impose a special assessment on property in the city, based on classifications of property related to solid waste generation. SUBD. 4. Sen'ice Charge. Authorizes the city to impose a service charge upon the net tax capacity of the property in the city, to be collected like a property tax. . SEC. 4. Does Not Affect Liability. Requires the city to seek reimbursement of the cleanup costs and to apply amounts recovered first to the administrative and legal costs incurred under this act, then to repay the appropriation from the Metro Landfill Contingency Action Trust Fund, then to repay principal and interest on the bonds, and fmally to provide property tax relief. SEe. 6. Appropriation. Appropriates a blank amount to the city from the Metro Landfill Contingency Action Trust Fund.
