CR 91-87 Comprehensive Plan Change - TownhomesIII ' March 28, 1991 Proposed Action. Staff recommends approval of the following motion:. Move to approve Resolution No: 91 -9 approving a change in the comprehensive plan from high density multiple family to medium density multiple family. Approval of this motion will recommend approval of a change in the comprehensive plan from high density multiple family to medium density multiple family. These property is located east of Ramsgate, on Hiawatha. There was little discussion on the item at the Zoning and Planning meeting. Overview. The applicant, Mark Z. Jones, is proposing to construct 13 townhomes on a site just east of Ramsgate. This site is currently zoned R -2, low density multiple family. Mr. Jones proposed project is allowed in an R -2 zone. However, the comprehensive plan has designated this site as high density multiple family. A high density zoning would allow a 3 story apartment building on this site. As a general rule, the Zoning Ordinance and Comprehensive Plan should be consistent with one another. Mr. Jones has applied for approval of a conditional use permit for the construction of the townhomes and a preliminary plat. Any approval will be contingent on the Metropolitan Council approving this change. Primary Issues to Consider. o If the zoning were changed to be consist with the comprehensive plan, what could be constructed on the site? o What is the result if the comprehensive plan is not changed? CR: 91 -87 Page 2 o If the zoning were changed to be consistent with the comprehensive plan, what could be constructed on the site? A higher density zoning would result in the possibility of a 3 story multiple dwelling being constructed. Approximately 31 to 50 units could be constructed on just the site that the townhomes will be built on. o What is the result if the comprehensive plan is not changed? The courts have ruled that if the comprehensive plan and the zoning are not consistent, the existing zoning is what the owner has the right to develop under. However, if Mr. Jones requested a rezoning of the subject property to a higher density, the comprehensive plan in its current state would support the rezoning request. Alternatives. 1. Approve the change in the comprehensive plan from high density multiple family to medium density multiple family. This change will make the zoning ordinance and comprehensive plan consistent with each other. 2. Deny the change in the comprehensive plan from high density multiple family to medium density multiple family. By denying the change the applicant will still be able to construct the proposed development because the zoning is consistent with the proposal. However, by denying the change the applicant could request a zoning change and construct a higher density development than proposed 3. Continue for further information. If the Commission indicates that further information is needed, the item should be continued. Jones for a Change in the Comprehensive Plan is hereby approved. WHEREAS, the procedural history of the amendment is as follows: 1. That the application for a Change in the Comprehensive Plan was filed with the City of Hopkins on December 31, 1990. 2. That the Hopkins Planning Commission reviewed such application on January 29, 1991. 3. That the Hopkins Planning Commission, pursuant to published and mailed notices, held a public hearing on January 29, 1991; all persons present at the hearing were given an opportunity to be heard. 4. That the written comments and analysis of the City Staff and the Planning Commission were considered. NOW THEREFORE BE IT RESOLVED, that application for a Change in the Comprehensive Plan ZCP: 91 -1 is hereby approved subject to the following Findings of Fact: ATTEST: 1. That a medium density designation will provide for a buffer between the high density and single family homes. BE IT FURTHER RESOLVED, that application for ZCP:91 -1 is hereby approved subject to the following Conditions: 1. That the Metropolitan Council approves the change. Adopted this 2 day of April, 1991.
