LICENSE ~D PERMIT FEE ANALYSIS
proposed Aotion.
Staff recommends adoption of the following motion: MoVe to adopt for
the first readinq ordinance No.91-680. "Allowinq adoption of chapter
10 fees throuah a resolution."
The implicati6ns of amending chapter 10 in the city code are; 1.
license and permit fees updated by resolution, 2. simplification of,
license and permit terminology, 3. Up dated license and permit fees.
overview.
Chapter 10 of the city code currently requires that license and permit
fees be established by ordinance. Ordinance No. 91";'1580 would allow
fees to be changed by resolution, instead of an ordinance. If
Ordinance No. 91--680 is approved, ?l forth coming resolution will
combine all fees charged by the city into one chapter of ,the city
code.
License and permit fees are intended to reimburse the' city for
expenses incurred by the city to regulate activities'or provide
services. City staff conducted a survey of license and p~rmit fees in
surrounding cities. survey data revealed that Hopkins' fees are below
average when compared to surrounding cities. The proposed resolution
increases various f_ees based on findings from the survey. Staff is
recommending that the Council adopt the proposed ordinance since it
will simplifY, and lower the cost of revising fees.
NOTE:: :public WorkS is currently revising their fee schedule, and it
will be included in chapter 10 .at a later date.

Detailed Baokground.
Licenses and permits are intended to regulate variQusactivities. When
a license or permit is required by a city it has the legal authority
to impose a fee if it so chooses. The city can reimburse itself by
charging a fee based on the costs of regulating the li.censedactivity.
Fees should only reimburse costs of regulation, and can not generate
revenue for the sake of generating revenue. Also, a city can not
recoyer expenses it acquires merely because a business or organization
exists.
The number of licenses and permits a city issues depends, on what the
license or permit is. A majority of licenses issued, every year are
renewals, and to the same organizations and individuals. There is
little connection between what license or permit ,fee is, and how many
licenses and permits actually applied for.
Even though cities have a wide range of discretion on setting fee
rates; fees can not be a disguised as a tax, or generate excessive
revenue beyond the cost of regulation. Current state law does not
define whata. disguised tax is, Or what excessively high revenue
means. However, if a fee unfairly restricts businesses that are not
public nuisances the fee could be yiewed as excessive, and considered
unfair in court. (even though most contested cas,es involving ,license
and permit fees are decided in favor of municipalities).
Most cities list license and permit fees, and. relative definitions, in
city code books. state law requires that cities establish licenses and
permi ts in an ordinance, however, fee, rates can be establ ished in
either an ordinance, or resolution. Currently, IIopkins requires an
'ordinance to amend the license and permit fee schedule.
Fee SettinaFormat.
The current .format of chapter 10 (license and permits) requires the
fee schedule to be amended by ordinance. The actual authority to grant
the l.icenses and permits must always be in an ordinance format. Fee
charges .can beset in an ordinance, or resolution.
The advantages of using a resolution format to set fees is the
relative ease for amending the schedule. An ordinance format is a more
complicated, and time consuming administrative procedure. The
disadvantage to using a resolution format is the ability to amend the
fee schedule so easily . without a more time consuming administrative
process there is potential for arbitrary and capricious fee changes.

Lioenseand permit Fee Survey.
city staff conducted a survey to determine how license and permit fees
in other cities compared with Hopkins. The survey was designed tO,find
information on what fees other cities were charging, and what items
other cities were licensing.
'The survey did not gather information on all license and permit items,
only information on the most common items was gathered. Based on
limited time, the survey did not collect information on how many
licenses were issued, numbers issued by type, collected revenue, or
the fee,. amending format.
o Survey selection.
A total of 32 cities, out of 37 requests, responded to the license and
permit survey. cities surveyea were selected at random, but restricted
to the Twin cities Western suburbs. Some cities were selected because
of their comparaple population and size to Hopkins.
o Limitations of the survey.
Most cities in the twin cities metropolitan area have larger, or
smaller populations compared to Hopkin~. That is why the s~mple pool
of cities chosen for the survey does not compare specifically to
Hopkins. However, when the collected data was analyzed there appeared
to be no correlation, statistically or otherwise, indicating that
license fees vary based on the population size of a city.
Also, it appears that the reasons ,to license an activity, or grant a
type of permit, is unique to each city. Fee rates depend on what the
policy goals of each city are, and fee rates for similar items can
vary considerably. Some cities use licenses and permits to restrict
certain activities (ie. intoxicating liquor stores), while another
city may b~ ambivalent toward the' same issue.
License fees are inherent policy decisions, and the reason one city
establishes a fee at one rate vs. another rate is dependant on a
variety of factors. There is considerable variation between cities on
fee amounts, and the statistical deviation in the survey data
substantiates that fact.
o Survey conclusions.
The survey data did not indicate a common trend in license fee rates.
Several items had wide standard deviation spans ,a.nd a wide range
between the maxi-mum and minimum values., The variety of items that
cities licensed varied significantly. For example; almost all cities
have licenses 'for intoxicating alcohol, but some cities require
licenses for activities unique to their own city (ie. laundries, pet
shops, auto repair shops, etc.), and several items were ,licensed in
only one or two cities.

Analysis of Issues.
o What is the effect ofa license and permit fee?
Most fees are regressive in nature, and do not consider the
individual's . ability to pay.. Low income residents and small
businesses might pay a disproportionate . burden when compared with
their ability to pay~ Fees discriminate against individuals on fixed
incomes, ie. elderly residents. Fees are exclusionary; those who can
,not pay, or who refuse to pay are excluded from consuming, or
conducting those services. Low income residents and small businesses
who can not afford various applicable ;license .and permits will be
excluded. Small businesses might consider fees as an additional cost,
and a .hindrance to commerce.
However, there is no direct evidence. that license fees unfairly
restrict most activities. Businesses which must pay the fee u.sually do
so, and usually it isa minor expense. Fees are traditionallya,part
Of acquiring the license or permit. Licensing is intended to regulate
and restrict activities, and it is not always equitable; sometimes
licensing is intended to be inequitable.
a How does the Hopkins fee schedule compare to other cities?
Hopkins' license ;:lnd permit fee schedule is below average (overall) in
comparison to survey averages. Several items are significantly below
the survey ave~age (contractors, skating rinks, restaurant fire
inspection, etc.), while only a few: are above the survEfY average (ie.
3.2 on sale, care sales, street' vendor, etc. ). Overall, Hopkins'
license ;:lnd permit fees are below survey averages. For additional
comparison information refer to survey data summaries.
.0 Should Hopkins increase license and permit fees?
Based on the survey data Hopkins does not haVe an up-to-date fee
schedule. A license or permit requires staff time for administrative,
and regulatory tasks, and the fee rate should reflect an ability of
the license, or permit to reimburse the city for these expenses. Based
on a correlation between current fees and survey averages, most
license and permit fee increases would .not be excessive relative to
the ability to pay.
The city of Hopkins will have to compensate for a reduction in local
government aid from the state. License and permi t fees exist to
reimburse the city of expenses encumbered by issuing licenses and
permits. It is possible that other forms of revenue have subsidized
low fee rates in the past, and by increasing fee rates the city would
correct the imbalance.

Amend chapter 10 allowing fee adoption through resolution.
The city should consider the advantages of amending chapter 10
allowing fee changes through resolution. Eyen though the potential of
arbitrary and capricious fee increases is possible, administrative
simplicity would allow for a fee schedule that coUld better reflect
t~ecosts of regulating the fee item.
o Additional fee items.
A list of additional regulatory items is being prepared, and it will
be made available to the council at a later date.
Alternatives.
1. Amend chapter 10 by approving ordinance 91-680, . allowing fees to
be established through resolution; and review the proposed fee
schedule resolution for adoption after approving ordinance 91-
680.

Direct staff to investigate, and analyze additional options.

Recommendations.
staff recommends that the council approve al te1:"hati ve number 1. The
resolution format will give the city flexibility when amending license
and permit .fees. In addition,. staff recommends the council to review
the proposed resolution which w'ould increase li.cense and permit fees,
and adopt the proposed fee increases. The fee increases are based on
survey averages, and/or individual department recommendations. Fee
increases are not based on capricious or arbitrary parameters.
Survey Data summary Notes.
* various investigatory fees under ~Business/Regulatory , and
Intoxicating Liquor, had different fee rates for in state business
establishments, and out state business establishments . In the survey
data base only in state fee charges are listed. Investigatory fee
rates for out state business were often twice, or three times the in
state fee rate.
* If the fee rates distinguished different rates between initial
issuances and renewals; only the renewal rate was used in the data
base.
* Not all cities had consistent fee rate schedules, some fees (ie.
animal impOund) had a wide range with several different rates,. In
order to have a base for determining a standard statistical analysis
only the most common rate was used.

CHAPTER X
LICENSES AND PERMITS; PROCEDURES AND FEES
Section 1000 - General provisions
1000.01. Policy: purpose. By the enactment of this chapter, the city council
intends to establish to the maximum degree' possible a' uniform system for the
issuance, revocation, suspension and renewal of licenses and permits for all
activities for which licenses and permits are required by this. code. The
council also intends that fees for licenses and permits required by this code
shall be those set by this chapter.
1000.03. Application of chapter. Subdivision 1. General. Where a provision
of this code requiring a license or a permit contains no procedure for issuance,
revocation, suspension, renewal or fee, the provisions of this chapter apply.
Subd. 2. Other provisions. Where a provision of this code requiring a
license or a permit contains procedures for its issuance, revocation,
suspension, renewal or the procedure for a pro rata payment of a fee t those
provisions prevail over this chapter.

Subd. 3. Conflicts. Where a direct conflict exists between the amount of
a license or permit fee set by any provisions of this code and,a fee set by this
'. chapter, the fee set by this chapte~ ~pplies.

1005.01
Section 1005 - Licensing procedures
1005.01. Licenses required. It is unlawful for any person to engage in any
trade, profession, business or privilege in the city for which a license is
required by any' provision of this code without first obtaining a license from
the city in the manner provided in this section.
1005.03. Application. Application for a license is made to the clerk upon
foms provided by the city. The applicant shall state the location of the
proposed activity and such other facts as are required for by the code or
applicable to the granting of the licen~e.
1005.05. Payment of fee. The fees required fbr a license shall be paid at the
office of the clerk before the granting of the license. Except as otherwise
provided in this code, no license fee shall be prorated for a portion of a, year,
and no license fee paid shall be refunded.
1005.07. Bond and insurance. Required bonds shall be in form satisfactory to,
the city attorney, shall be executed by two sureties, or a surety company, and
be subject to the approval of the manager and the council. Where policies of
insurance are required, the policies shall be approved as to substance and form
by the city attorney. Satisfactory evidence of coverage by bond or insurance
shall be filed with the clerk before the license is issued.
1005.09. Approval or denial of 'licenses. Where the approval of any city or
state officer or the council is required prior to the issuance of a license, the
approval must be presented to the clerk before the license' is issued. No
license may be approved by any city officer or issued by the clerk if it appears
that the conduct of the activity for whicq a license is sought will be contrary
to the health, safety or welfare of the public or any regulation, law or ordi-
nance applicable to such activity. '

issue, the activity licensed and the term of the license. Licenses shall be
signed by the manager and clerk, and be impressed with the city seal.
1005.15. Exhibition of license certificate. A licensee shall carry his license
certificate upon the licensee's person at all times when engaged in the activity
for which the license was granted. Where the licensed activity is', conducted at
a fixed place of business or establishment, t' he certificate shall be, exhibited
in s'ome conspicuous place on the premises. The licensee shall present the
license ce~tificate when applying for a renewal and upon demand of any police
officer or'authorized representative of the city.
1005.17. ,Transfer of license. Unless otherwise provided in this code, no
license shall be transferable without the authorization of the council.

\ 1005.19. Renewal of license. License renewals are issued in the same manner
and subject to the same conditions as original licenses.
1005.21. Revocation; denial; suspension. A license issued or to be issued by
the city may be denied" suspended or revoked by the council for any of the
following reasons:

a) Fraud, misrepresentation, or incorrect statement contained in the
application for license, or made in carrying on the licensed activity;
b) conviction of any crime, or misdemeanor, pertaining to license held or
applied for, subject to the provisions of Minnesota Statutes, chapter 364;
I c) conducting this licensed activity in such manner as to constitute a
breach of the peace, or a menace to the health, safety and welfare of 'the
public, or a disturbance of the peace or comfort of the residents 0 the city,
upon recommendation of the city health authorities or other appropriate city
official;
d) expiration or cancellation of any required bond or insurance, or
failure to notify the city within a reasonable time of changes in the terms of
the insurance or the carriers;
e)

actions unauthorized or beyond the scope of the license granted;
f) violation of any regulation or provision of this code applicable to
the activity for which the license has been granted, or any regulation or law of
the state so applicable;
g) failure to continuously comply with all conditions required as prece-
dent to the approval of the license.
1005.23. Hearing. A license may not be suspended or revoked until after a
hearing is granted to the licensee. The hearing ~s held before the city council
upon due notice to the licensee stating the time and place of such hearing,
together with a statement of the violation alleged to be the cause for the
revocation or suspension of the license.
1005.25. Temporary suspensions. The council may temporarily suspend a license
pending a hearing on revocation or suspension when in ~ts judgment the public
health, safety and welfare is endangered by the continuance of the licensed
activity.
1005.27. Inspections. The city health authority and other appropriate city
offic:;!.als may enter upon the premises where any licensed activity is being
conducted for the purpose of inspection at any reasonable hour.

1005.29. Transfer of licenses. Any license duly issued upon which a license
fee of $10.00 or more has been paid may be transferred or assign'ed, should the
licensee desire to change his place of business to a new location. The city
manager may at his direction and under such regulations as he may prescribe and
on surrender of( the original license accompanied, by a transfer fee. established
from time to time by resolution of the city council, issue a new license for the
new location provided that the provisions of this code and other applicable
ordinances of the city authorizing the granting of such license are complied
with, including separate investigation fees and expenses whenever required.
1005.31. Proration of license fees. Whenever the annual city operating license
fee is $300.00 or more and any such licensed business is either connnenced or is
transferred during the calendar year, the license may be granted or transferred
and the fee therefor may be calculated or prorated for the remaining unexpired
period of such year and such license transferred or reissued to the new owner or
other applicant subject to the payment of any and all investigation costs and
transfer fees. All such prorations shall be ca~culated upon a calendar monthly
basis. The fee for any license atnOunting to less than $300.00 per year shall be
the full amount pro\Tidedby ordinance and no reduction in the amount of such .fee
shall be made because part of the licensa year has elapsed prior to the date
such license is issued.
1005.33. License report to the council, revocation. At the first regular
tneeting of the council in each month, the city manager shall 'report to the
council all license or transfers issued or applications for licenses or trans-
fers of licenses denied by him during the preceding 30 days, or since making his
last report. The council may at any time, either with or without a notice to
the licensee, .revoke .any transfer of a license issued by the city tnanager ,or
grant any' application for a license or for a transfer of a liCense which the
city manager has denied; and may revoke any license after giving the licensee at
least seven days notice by registered mai,l at the licensee's address shown on
the license application, or, if none is shown, at the ;licensee's last known
address, of the intention of the council to revoke such license and giving the
licensee an opportunity to appear before the council and be heard with reference
thereto.

1015.01
Section 1015 - Permit procedures and fees
1015.01. Permits required. It is unlawful to conduct any activity in the city
for which a permit is required by any provision of this code without first
obtaining the permit from the city in the ma~ner provided in this section.
1015.03. Application for permit. Application for a permit is made to the clerk
on forms furnished by the city. The application shall tontain information as to
location, nature, extent and costs of the proposed structure, work, installa-
tion, activity, or other purpose, and other information which the building
official or other duly authorized persons may required under this code. The
application shall contain a declaration th?t the facts and representations
therein made are trueand,correct, which statement shall be subscribed to by the
person or persons, or officers or agents of a corporation, applying for the
permit.
1015.05. Granting of permits. Upon payment to the city by the applicant of the
required fee for any permit, and upon approval of the appropriate official, the
permit shall be issued, except where council approval is required, in which case
the appropriate officer may issue the permit only after approval. is granted by
the council.
1015.07. Payment of fees. Subdivision 1. Payment. The permit fee and other
fees and charges set forth in tpis code shall be collected by the city before
the issuance of any permit, and the clerk, building official, or other persons
authorized to issue a permit for which the payment of a fee is required under
the provisions of this code may not issue a permit until the' fee has been paid.
Subd. 2. Double fees. If a person begins' work of any kind or which a
permit from the city is required without having secured the necessary permit
therefor, either previous to or on the date of commencement of such work or on
the next succeeding day when work is commenced on a Saturday afternoon, Sunday
or legal holiday of the city, the person shall, when subsequently securing such
permit, pay double the fee provided for the permit, and is subject to the
penalty provisions of this code.
