CR 91-163 Petition Feasibility Study - Knollwood Sty 5 July 31, 1991 ° P K�� Council Report: 91 -163 Accept Petition and Order Feasibility Study Knollwood Street Reconstruction Proposed Action Staff recommends the following motion: Move that Council adopt Resol ution 91-97, Resolution Acceptina Petition and Ordering Preparatio of Feasibility Report- Knollwood Street Reconstruction This action is a repeat first step in the process of providing overall street and storm sewer reconstruction and utility upgrading in the Knollwood neighborhood. Overview At its February 6,'1990, meeting Council passed a resolution ordering a street improvement in Knollwood. The Council ordered a project with a roadway width of twenty feet without curb and gutter and with parking restrictions. The consultant engineer worked closely with the neighborhood association in developing preliminary plans. By April Council was considering changes in the City's Roadway Improvements Policy #7D, and since this clouded discussions of a street project in Knollwood, staff and the neighborhood petitioned Council to table any further plan development. In August 1990 Council formally adopted a revised roadway policy and the association has since that time discussed a renewed effort.. The result is a new petition. Pursuant to Minnesota Statutes, Chapter 429, the requisite number of owners of not less than 35 percent in frontage of the real property abutting on the streets named in the petition have provided their signatures. Pursuant to the City Roadway Policy #7D, the requisite fifty -five percent of owners have petitioned for a street without concrete curb and gutter. The roster has been examined, checked, and found to be in proper form. The petition requests construction methods and features that are contrary to Roadway Policy #7D or standard engineering design, to wit: flat laying catch basins and bituminous alleys. Staff feels these are issues better discussed at a public hearing once a feasibility study has been prepared that itself will examine these methods and features. Council should be aware that it may at a future time see fit to reject some of the specific requests in the petition and will then need a 4/5 vote to order a project. At this time staff recommends acceptance of the petition. o Why order another feasibility report? The petition suggests various options in street design and width. A new report needs to examine options not previously discussed. In addition, a 1991 report will provide more current cost estimates for the various alternatives. Staff anticipates such a report ready for Council presentation by September 17. A public hearing could then be held on October 15. Staff recommendation is to order another feasibility study that discusses various street widths and their cost with and without concrete curb and gutter (the latter option entailing a raised bituminous road edge). is 0 CITY OF HOPKINS PETITION FOR LOCAL IMPROVEMENTS To the Council of the City of Hopkins: We, the undersigned, being the owners of real property abutting on the improvement hereby and hereinafter petitioned for, do hereby petition that you install, improve, extend and construct and reconstruct streets, storm sewer, water main and sanitary sewer. Construction Methods Desired: Continuous asphalt raised edge curb and gutter in lieu of concrete curb and gutter: Requires 55% of all property owners' signatures (26 total signatures). May require design modifications to address actual drainage and maintenance concerns. Requires inobtrusive and flat - laying gutters (non - raised) to collect storm water for drainage into the underground storm sewer system. Asphalt paving (center draining) at alleys. Street Width - 20 feet overall (back to back of raised edze) Streets currently 20 feet or greater in width shall be reconstructed to those same respective widths. Streets currently less than 20 feet in width shall be reconstructed to 20 feet in width unless existing and/or adverse conditions are present and the City Council approves a width narrower than 20 feet. Streets less than 26 feet in width may be subject to parking restrictions on "as needed" basis at time of construction or in future if needed. City staff will review streets for emergency vehicle needs and will report to City Council with recommendations. City staff will work with neighborhood to identify areas and appropriate justifications where street width may be increased to provide unrestricted parking (26 feet maximum width). along the following streets, avenues, alleys or thoroughfares in the following locations in the City of Hopkins: Bridle Lane Cottage Downs Edgemoor Drive Park Terrace Valley Way. Wilshire Walk and Alleyway of Cottage Downs ...and we request that each benefitted property be assessed only for the applicable cost of improvements petitioned for and installed in accordance with Minnesota Statutes 429.011 to 429.111. The assessment and construction to be in accordance with Hopkins Legislative Policy #7 -D, Roadway Improvements. This declaration is made in conformity to Minnesota Statutes, Section 429.035. NOW THEREFORE, be it resolved by the City Council of Hopkins, Minnesota, that the proposed improvement be referred to the engineering superintendent for study and that he is instructed to report to the Council with all convenient speed advising the Council in a preliminary way as to whether the proposed improvement is feasible and as to whether it should best be made as proposed or in connection with some other improvement, and the estimated cost of the improvement as recommended. FURTHERMORE, funds in the amount of $4,000 are appropriated to prepare this feasibility report. Adopted by the City Council of the City of Hopkins, Minnesota, this 6th day of August, 1991.
