CR 91-181 Comprehensive Plan Change - Townhomes\ -T Y O G Ao August 14, 1991. y o p K 10, CD Council Report: 91 -181 COMPREHENSIVE PLAN CHANGE - TOWNHOMES Proposed Action. Staff recommends approval of the following motion: Move to approve Resolution No: 91 -9 approving a change in the comprehensive plan from high density multiple family to medium density multiple family. Approval of this motion will provide for a change in the comprehensive plan from high density multiple family to medium density multiple family. The property is located east of Ramsgate, on Hiawatha. The Commission on 4 -0 vote approved Resolution RZ91 -3 recommending approval of a change in the Comprehensive Plan from high density multiple family to medium density multiple family. ov rview. The applicant, Mark Z. Jones, is proposing to construct 12 townhomes on a site just east of Ramsgate. This site is'currently zoned R -2, low density multiple family. Mr. Jones proposed project is allowed in an R -2 zone. However, the comprehensive plan has designated this site as high density multiple family. A high density zoning would allow a 3 story apartment building on this site. As a general rule, the Zoning Ordinance and Comprehensive Plan should be consistent with one another. Mr. Jones has applied for approval of a conditional use permit for the construction of the townhomes and a preliminary plat. Any approval will be contingent on the Metropolitan Council approving this change. There was little discussion on the item at the February 26, 1991 Zoning and Planning meeting. Primary Issues to Consider. o If the zoning were changed to be consistent with the comprehensive plan, what could be constructed on the. site? o What is the result if the comprehensive plan is not changed? A higher density zoning would result in the possibility of a 3 story multiple dwelling being constructed. Approximately 31 to 50 units could be constructed on just the site that the townhomes will be built on. o What is the result if the comprehensive plan is not changed? The courts have ruled that if the comprehensive plan and the zoning are not consistent, the existing zoning is what the owner has the right to develop under. However, if Mr. Jones requested a rezoning of the subject property to a higher density, the comprehensive plan in its current state would support the rezoning request. Alt rnatives. 1. Approve the change in the comprehensive plan from high density multiple family to medium density multiple family. This change will make the zoning ordinance and comprehensive plan consistent with each other. 2. Deny the change in the comprehensive plan from high density multiple family to medium density multiple family. By denying the change the applicant will still be able to construct the proposed development because the zoning is consistent with the proposal. However, by denying the change the applicant could request a zoning change and construct a higher density development than proposed 34 Continue for further information.
