Staff recommends adoption of the following motion: Move that Council authorize Change Order No. 8 as it concerns the 7th Street S. Landfill Gas Remediation, Project 90 -18. overview. After the landfill remediation project got underway, the MPCA requested a change in compaction requirements for the 24 inches of topsoil cover in the landfill area itself. A work change directive was issued to Ames Construction by RCM to execute this request. The contractor was requested to submit an itemized proposal for additional compensation because of the additional finish grading stage added to the scope of the project. Primary Issues to Consider. o What are the costs? Change Order No. 8 will cost an additional $18,200. o What are the specifics of this change order? See the attached supplement from RCM . and Associates for description of change and justification. Attached is a copy of the cost estimate prepared by the Engineer for this change. Attached is a copy of Serial Letter No. 23 from the Engineer requesting additional cost information. Attached is a copy of Serial Letter No. 33 from the Contractor stating their position on this change. Attached is ' a copy of Serial Letter No. 37 from the Contractor stating the Contractor agreed with the cost for this additional work as estimated by the Engineer. Gentlemen: We have reviewed the referenced document as it affects our scope of work on the referenced project. This document would add a compaction requirement to the topsoil. The revised requirement calls for 95% Standard Proctor Density in the lower 18 inches and the top 6 inches is to be loose. We resist this change in that it seems counterproductive. Should the change be required; however, there would be additional costs associated. This revised specification is not easily achieved. We would have to add an additional finish grading stage to the entire black dirt area in order to meet the requirement. The additional cost would be $25,667.00. Our position has not changed since our serial letter no. 7. We have tried to discourage the upgrading of the compaction specification for the topsoil to 95% standard proctor density. This modification does not make sense. We are discussing the compaction of two feet of topsoil which overlie landfill debris. We have been told that the change is required due to the. risk of settlement causing poor surface drainage. Realistically, the settlement possible in the two feet of topsoil is insignificant compared to the settlement from the landfill below. If you insist on the change, the cost is the price we indicated previously, $25,667.00. We realize that hourly costs do not fully account for the extra cost. The full amount is justified; however, due to other concerns. We have a very real concern that the increased compaction may not be physically possible. We have been able to achieve the increased compaction so far; however, this is definitely a difficult process tryingto compact the topsoil over the landfill which is extremely soft. The other concern is the additional time this compaction is taking. There is the possibility that this additional compaction could take so much time that we would not have the project completed by the deadline. We could then be assessed .liquidated damages.
