CR 91-207 Fees For Minutes\ S Y O G 'r 1 September 11, 1991 P K% Council Rpt 91 -207 FEES FOR MINUTES, AGENDAS, TIF AND REVENUE BONDS Proposed Action Staff recommends that the Council approve the following motion: Move that the Hopkins City Council approve Ordinance #91 -695 for first reading. This action will amend Chapter Ten of - .the Hopkins City Code to authorize the charging of fees for copies of documents, TIF applications, and revenue bond applications. overview As part of the ongoing effort to have fees and charges reflect actual costs, staff is recommending that the City Council authorize charging for copies of documents as well as TIF and revenue bond applications and administration. These are separate. issues that are being brought forward in a single ordinance for administrative convenience. The attached documentation provides the background and rationale for these fees. Setting the fees will be done by separate. resolutions when Ordinance #91 -695 is approved for second reading. The Council at this time is only being asked to begin the process authorizing the charging of fees. Primary Issues to Consider o Should these actions be done in separate ordinances? Staff expects to be bringing before the Council a number of new fees and charges in the next few months. Each ordinance involves publication costs and separate reports. If the Council feels that fees should not be charged for certain items mentioned in Ordinance #91 -695,. it can be amended prior to second reading. Proposed Fees At the present time, the City does not charge.any fees as relates to the processing and sale of taxable /tax exempt bond issues. The practice has been to charge for actual administrative and legal expenses. Rather than continuing with the above approach, I am now recommending that an application process be established along with a set fee. The fee is proposed to be as follows: o A nonrefundable application fee of $5,000. o An administrative fee of 1/4 of 1 of the total bond issue with a maximum of $10,000. This payment would be required at the time of bond closing. The above -fee amounts would be used to reimburse the City for the following expenses as relates to a specific bond issue: o Staff review and processing of application. o City attorney review of bond documents. o Other required legal counsel. o Required reporting and administration by City Finance Department. Besides the above fee, it is my understanding that an ordinance needs to be adopted which identifies fees for the following: o Tax increment application. o Economic development fund application. The application fees for these are as follows: o Preliminary application, 0. o Final application, $1000 (refundable upon execution of a redevelopment contract). o $1000 processing fee subsequent to final application approval. Mielke, City Manager Subject: Proposed Fees - Minutes and Agendas The City has historically provided mailed copies of minutes and agendas to interested individuals for both Planning Commission and the City Council. At the present time, there is no written policy to guide staff in the distribution of these items. I am recommending that the City Council adopt a policy regarding the distribution of agendas and minutes. This policy, if adopted would allow for the continued distribution of minutes and agendas to designated sources while allowing others who wish to receive mailed copies to continue doing so, but at a specified charge. Attached you will. f ind Policy # 3 -F. This proposed policy discusses who would receive free mailed copies of Council agendas and minutes as well as policies regarding the agendas and minutes of other Boards and Commissions. Also attached are proposed fees to compliment Policy # 3 -F. The fees, as I understand it, can only be imposed if the Council adopts an ordinance allowing the fees to be charged. I would suggest that the City Council review Policy 0 3 -F as well as the current distribution lists from the Zoning & Planning Commission and City Council. The Council may wish to add or reduce the number of names listed on Policy # 3-F. POLICY # 3 - f DISTRIBUTION OF AGENDAS AND MINUTES 1.0 PURPOSE: The purpose of this policy is to provide guidance on the reproduction and distribution of agendas and minutes of the City Council and its official boards, committees and commissions. 2.0 GENERAL Agendas and minutes of the City Council and its .official boards, committees and Commissions are public documents. Agendas and minutes are available to the public for inspection and review by anyone wishing access to them during normal business hours. 3.0 COPIES OF AGENDAS AND /OR MINUTES 3.01 Upon request, agendas and /or minutes will be copied and provided to anyone wishing to have copies. 3.02 Anyone requesting copies of agendas and /or minutes will be required to pay the normal cost of copies as the City charges for copies. 4.0 MAILED DISTRIBUTION OF MINUTES AND AGENDAS 4.01 Copies. of City Council agendas and minutes will be mailed free of charge to the following: o City Council members o Planning Commission members o Presidents of Neighborhood Associations o Chairpersons of other Hopkins Boards and Commissions. o Chairperson - Hopkins Community Promotions o Chairperson - Hopkins Business Council o Manager - City of Edina o Manager - City of St. Louis Park o Manager - City of Minnetonka o Local Media o Superintendent - School District 270 4.02 Others requesting to receive mailed copies of agendas and /or minutes will be required to pay a fee to cover the cost of distribution and copying. The fee will be set by resolution of the City Council. 4.03 Copies of Planning Commission and minutes will be mailed free of charge to : o City Council members o Planning Commission members o Neighborhood Presidents o Chair - HCP o Chair - HBC 4.04 Others wishing to recieve mailed copies of agendas and /or minutes of the planning commission shall.be required to pay a fee to cover the cost of distribution and copying. The fee will be established by resolution of the City Council. 4.05 'Copies of agendas and /or minutes for all other Hopkins boards, commissions and committees will be mailed free of charge to members of the City Council, and the individual members of the respective boards, commissions, and committees. 4.06 All others requesting to receive mailed copies of the agendas and /or minutes shall be required to pay a fee to cover the cost of distribution and copying. The fee shall be established by resolution of the Council. 5.0 CERTIFIED COPIES OF MINUTES 5.01 Certified copies of agendas and /or minutes shall require an additional fee.
