Overview A petition has been received from the resident at 1711 1st Street North for a sewer and water main improvement project at her residence. An engineer's study needs to be conducted to show the feasibility of such an improvement along with estimated costs of the project. Primary Issues to Consider. o Should the petition be accepted? o What are the current utility conditions at the residence? o Timetable for improvements? Pursuant to Minnesota Statutes, Chapter 429, not less than 35 percent of owners in frontage of the real property abutting on the streets named in the petition need to provide their signatures. This petition does not meet that requirement. Nevertheless, staff recommends its acceptance in light of the circumstances surrounding the present utility conditions at the petitioning property. In all other aspects the roster has been found to be in proper form. o What are the current conditions at the residence? Currently the residence at 1711 1st Street North is not served by City sanitary sewer or water. A septic system, originally installed to serve the above address and the home located at 101 18th Avenue North, now provides sanitary service to the petitioner. It appears this septic system is at minimum partially located on the property at 101 18th Avenue North and because this neighboring property is being sold, an easement for the septic system needs to be granted. A problem arises in that the buyer of the property addressed off 18th Avenue has plans to construct a new driveway and garage and needs to situate the facilities over parts of the septic system. Under these circumstances the new owner will at best grant an easement that sunsets in the near future. The petitioner seeks a sewer hookup to the main in 18th Avenue as a solution. A private well provides water service to the residence. Staff recommends an in -house study to determine the most feasible means of providing City utility services to the petitioner and to provide cost estimates. Staff has already learned in a very preliminary way that construction, costs could total almost $10,000. Construction and - engineering costs are recommended to be assessed solely against the petitioning property since other abutting property does not derive benefit. The petitioner has indicated she may I wish to apply for deferral of assessments. o Timetable for improvements? Staff is prepared to complete a feasibility study in preparation for public hearing this fall. Plans and specifications could easily be prepared for a spring construction project. CITY OF HOPKINS PETITION FOR LOCAL IMPROVEMENTS To the Council of the City of Hopkins: We, the undersigned, being the owners of real property abutting on the improvement hereby and hereinafter petitioned for, do hereby petition that you install, improve, extend and construct sanitary sewer main and water main along the following street, avenue, alley or thoroughfare in the following location in the City of Hopkins 1st Street North between 17th and 18th Av enues North and we do hereby further agree that the total cost thereof shall be assessed against and become a lien upon the real`property benefitted by said improvement, and that said improvement be installed pursuant to M.S.A. Section 429.011 to 429.111. CITY OF HOPKINS Hennepin County, Minnesota RESOLUTION NO: 91 -129 RESOLUTION ORDERING PREPARATION OF FEASIBILITY REPORT WHEREAS, a certain petition requesting sanitary sewer and water main improvements at 1711 1st Street North and filed with the Council on October 15, 1991, is hereby accepted. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF HOPKINS, MINNESOTA: The proposed improvement shall be referred to the engineering superintendent for study and that he is instructed to report to the Council with all convenient speed advising the Council in a preliminary way as to whether the proposed improvement is feasible and as to whether it should best be made as proposed or in connection with some other improvement, and the estimated cost of the improvement as recommended.
