CONDITIONAL USE PERMIT AUTO STORAGE LOT
Proposed Action.
Staff recommends the following motion: Move to approve
Resolution 91 -133 approving an auto storage area at 802 St.
Louis Street.
The Planning Commission unanimously approved Resolution
RZ91 -20 recommending approval of a storage lot at 802 St.
Louis Street.
Overview.
The applicant, Auto Repossessers, has located a storage area
south of the Edco Building on 2nd Street N.E. The Zoning
Ordinance requires that any storage use not enclosed within
a building shall require a conditional use .permit. The
applicant was unaware at the time he located his operation
on the subject site that a CUP was required.
Staff reviewed the request with the Commission. The
applicant appeared before the Commission and stated that he
repossesses cars and occasionally boats, motorcycles and
snowmobiles and that it was only used for storage. The
Commission decided that they wanted to review the status of
the lot in three years to determine if additional upgrading
would be necessary.

Primary Issues to Consider.
o What improvements are staff recommending for the site?
The site is surrounded by a building to the north, Dick's
Towing operation to the east, railroad tracks to the south
and a parking area to the west. The only visible part of
the site is the west side. The site is currently fenced
with chain link on the west and south, and a wood fence on
the north.
Staff is recommending that the site be fenced on the west
side with a fence similar to the fence around Dick's Towing.
This fence would be on the west side of the property. Staff
also recommends that the applicant cleanup the area on the
west side.
o Are there other conditions staff is recommending for
the site?
Staff is recommending the following conditions: 1) That the
site be used for the storage of cars only. 2) That the lot
is not expanded in the future without approval from the
City. 3) That the use remains as an auto storage lot for a
period of three years from the date of the CUP and that the
site be hard- surfaced in accordance with a plan acceptable
to the City staff. 4) That the applicant secures sufficient
access to the subject site from Edco.
o How does this use differ from Dick's Towing Operation?
The applicant's operation is used for storage of cars only.
The applicant repossesses cars and needs a place to store
them. Dick's Towing operates a business from his lot.

1. Approve the conditional use permit to store cars. By
approving the conditional use permit, the applicant
will continue to operate an auto storage area.
2. Deny the conditional use permit to store cars. By
denying the conditional use permit, the applicant will
not be able to store cars on the subject property.
3. Continue for further information. If the Council
indicates that further information is needed, the item
should be continued.

RESOLUTION NO: 91 -133
RESOLUTION MAKING FINDINGS OF FACT AND APPROVING APPLICATION
FOR CONDITIONAL USE PERMIT CUP:91 -6
WHEREAS, an application by Minnesota Repossessers for a
conditional use permit to allow use of a storage lot is
hereby approved.
WHEREAS, the procedural history of the amendment is as follows:
1. That the application for Conditional Use Permit
CUP: 91 -6 was filed with the City of Hopkins on
October 9, 1991.
2. That the Hopkins Planning Commission reviewed such
application on October 29, 1991.
3. That the Hopkins Planning Commission, pursuant to
published and mailed notices, held a public
hearing on October 29, 1991; all persons present
at the hearing were given an opportunity to be
heard.
4. That the written comments and analysis of the City
Staff and the Planning Commission were considered.
NOW THEREFORE BE IT RESOLVED, that application for CUP:91 -6 is
hereby approved subject to the following Findings of
Fact:
1. That an outside storage area is allowed in the I -2
zoning district.
BE IT FURTHER RESOLVED, that application for CUP:91 -6 is hereby
approved subject to the following Conditions:
1. That an eight- foot -high wooden fence be constructed on
the west side of the site.
2. That the site be used only for motor vehicle, boat,
motorcycle and snowmobile storage.
3. That the site is not expanded without City approval.
4. That the owner of the property provide access to the
site.
5. That the Planning Commission will review the
conditional use permit in three years to consider
possible upgrading of the site with landscaping and
paving.
