SUBJECT: Secdnd reading vacating utility easements
Attached are Ordinances 91 -696 and 91 -697 which will vacate
the utility easements at 1120 2nd Street South. These
utility easements are being vacated to facilitate
construction of a new Holiday gas station.
Holiday is required to provide a new easement for an
existing storm sewer on the site. As of the date of this
memo Holiday has not provided a satisfactory legal
description of the easement. If a satisfactory legal is not
obtained by the Council meeting staff is recommending to
continue the second reading until a satisfactory legal is
obtained. Staff will provide an update on the new easement
at the meeting.
Staff is recommending the following motion: Move to approve
for second reading Ordinance 91 -696 and Ordinance 91 -967
vacating utility easements at 1120 2nd Street South and to
order the ordinances published.

ORDINANCE VACATING A UTILITY EASEMENT IN TRACTS A, B; AND C,
REGISTERED LAND SURVEY NO. 1316, FILES OF THE REGISTRAR OF
TITLES, HENNEPIN COUNTY, MINNESOTA
That the following described utility easement in
the following designated area of the City of Hopkins:
An easement for the installation, maintenance and
repair of a public sanitary sewer under, across and
upon that part of Tract A, Registered Land Survey No.
1316, lying Easterly of a line commencing at a point
distant 45 feet West of the Northeast corner of said
Tract A and proceeding thence Southeasterly to a point
which is distant 110 feet South of the North line and
15 feet West of the East line of said Tract A, and
under, across and upon the East 15 feet of that part of
said Tract A lying South of the North 110 feet thereof;
and the East 15 feet of Tract B, said Registered Land
Survey; and the most Easterly 15 feet of Tract E, said
Registered Land Survey
be and the same is hereby vacated as a public utility
easement.
