CR 91-270 Final Plat - RamsgateDecember 10, 1991 O P K FINAL PLAT - RAMSGATE TOWNHOMES Council Report CR 91 -270 Proposed Action. Staff recommends the following motion: Move to approve Resolution 91 -152 approving the final plat for the Ramsgate 2nd Addition. The Zoning and Planning Commission unanimously approved Resolution RZ91 -24 recommending approval of the final plat for Ramsgate 2nd Addition. Overview. The preliminary plat for the Ramsgate Townhomes was approved on August 20, 1991. The Ordinance requires that within six months of approval of the preliminary plat the applicant shall submit the final plat for approval. The applicant has submitted the final plat for approval. The plat indicates that the south part of the site will be an outlot. This outlot will have a parking area and will be unbuildable as long as it is an outlot. The plat shows that 17 feet of right -of -way will be dedicated for right -of -way for Hiawatha Avenue. There currently is only 7 feet of right -of -way on the west side of the road, this additional 10 feet of right -of -way will expand the overall right -of -way of Hiawatha from 40 feet to 50 feet. If Hiawatha is expanded in the future, the additional right -of -way will allow for a wider road. The right -of -way for Cambridge will remain unchanged. The staff reviewed the applicant's request with the Commission. Chris Hayhoe, representing the applicant appeared before the Commission to answer any questions regarding the final plat. Mr. Pavelka stated that this was not a public hearing, but he would allow the audience to speak regarding the final plat. There was very little discussion on this matter. CR91 -270 Page 2 o What are the specifics of the plat? The plat indicates that 17 feet of land will be dedicated for right -of -way purposes for Hiawatha Avenue which is 10 feet more than presently exists. The right -of -way for increased Avenue will be ncreased overall from 40 to 50 feet. The right -of -way for Cambridge Street is 60.80 feet, which is the current right -of -way. The south side of the lot will be an outlot used for overflow parking for the proposed townhomes and the adjacent apartments. The proposed townhomes will be constructed on Block 1. o Has the final plat changes from the preliminary plat? The final plat has changed slightly from the preliminary plat when the number of townhomes was reduced from 13 to 12. A townhome was eliminated in order to make the holding pond larger which reduced the size of the outlot. The site plan was changed at this time but not the preliminary plat. The final plat reflects the smaller outlot, which was the size of the outlot approved by the City Council on the final site plan. Specifically the outlot's north lot line was moved 28 feet to the south to accommodate the larger holding pond. o What were the City Engineer's comments? The City Engineer reviewed the plat and noted that the holding pond should be recorded on the plat as an easement and also a 10 foot drainage and utility easement parallel to Hiawatha. The applicant has been notified of the additional easements. The 10 foot drainage /utility easement and the holding pond easement have been added. Alternatives. 1. Recommend approval of the final plat. By approving the final plat, the applicant will be able to file the plat with Hennepin County. 2. Recommend denial of the final plat. If the City Council denies the final plat, the City Council will have to state findings of fact that support the denial. 3. Continue for further information. That an application for a final plat SUBD 91 -3 was filed with the City of Hopkins on November 4, 1991. 2. That the Hopkins Planning Commission reviewed such application on November 26, 1991. 3. That the Hopkins Planning Commission, mailed notices, held a hearing on November 26, 1991. 4. That the written comments and analysis of the City Staff and the Planning Commission were considered. NOW THEREFORE BE IT RESOLVED, that application for SUBD 91 -3 is hereby approved subject to the following Findings of Fact: 1. That the platted lot meets the minimum requirements of the zoning ordinance. 2. That the proposed subdivision meets the requirements of the subdivision ordinance. BE IT FURTHER RESOLVED, that application for SUBD 91 -3 is hereby approved subject to the following Conditions: 1.
