Proposed Action.
Staff recommends approval of the following motion: Move that
Council adopt Resolution 91 -154, Resolution approving Petition
for Fire Protection System at Central Park Square Mali, 1426 -28
Mainstreet, Hopkins, Minnesota, and Ordering Improvements.
Adoption of this resolution will provide funding for a fire
protection sprinkler system for the Vent -a -Hood store at Central
Park Square Mall.
Overview.
The owners of Central Park Square Mall have presented a petition
for funding a fire protection system that will bring the building
into compliance with the City of Hopkins and State of Minnesota
fire codes as ordered. The Fire Marshall has reviewed and
approved the plans, specifications and cost estimates attached to
the petition.
The petitioner has received bids for a project that calls for
installation of an extension of an existing sprinkler system to
the basement at 1426 -28 Mainstreet. The bid totals $5,500 and is
presented to the Council for approval. The petitioner will be
installing the system and wishes to have the cost assessed after
completion and acceptance. Section 429 of the State Code allows
installation of devices and equipment related to fire safety to
be installed and assessed to the benefitted properties. The
amount to be assessed would be the total cost of the project plus
administrative costs of five percent of the project or $100,
whichever is greater. Present City policy is to charge eight
percent interest and spread the assessment over ten years.

The proposal meets all policy criteria and staff
recommends approval.
o Are adequate funds available?
To date this is the second 1991 project of such
nature off Mainstreet, and ample funds are
available.

and we do hereby further agree that the total cost thereof
shall be assessed against and become a lien upon the real

to 429 111.
Each of the undersigned for himself, his heirs and assigns
hereby waives any and all notices of public hearing which
may be required by law for the order and installation of
such improvement, agrees that such improvement is feasible,
necessary, and proper for the protection of the general
public health and welfare, and further hereby waives any and
all notices of hearing which may be required in the law
prior to and for the proper special assessment of the land
affected, improved and benefitted by such improvement.

RESOLUTION NO. 91 -154
RESOLUTION APPROVING PETITION FOR AND ORDERING IMPROVEMENTS
WHEREAS, the owners of Central Park Square Mall with leased
space located at 1426 -28 Mainstreet, Hopkins,
Minnesota, have petitioned for an improvement
consisting of the installation of a fire
protection system pursuant to Minnesota Statute
No. 429.031, Subd. 3; and
WHEREAS, the petition and accompanying documents thereto
complies with the requirements of the
aforementioned statute.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF HOPKINS:
1. Such improvement is hereby ordered as proposed and
requested in the petition.
2. That the Engineering Superintendent and Fire
Marshall be directed to review and approve the
plans and specifications accompanying the petition
for the construction and installation of the fire
protection system.
3. That said installation and construction be in
conformance with Minnesota Statute Chapter 429 and
all state and municipal codes, ordinances and
regulations pertaining thereof.
4. That periodic inspections be conducted by the City
of Hopkins to assure compliance with said codes
and requirements.
Adopted by the Council of the City of Hopkins this 17th day
of December, 1991.
