SALE OF PROPERTY - HARLEY HOPKINS

Staff recommends adoption of the following motion: Mpve to approve in

In October of last year the City negotiated for the purchase of
approximately 3.36 acres of th~ Harley Hopkins School property. The
City needed this prcpe~ty iu oLde~ to f~cilitate the construction of a
storm water ret;~tiou a~ea.

At the time this purchase was being negotiated, the School District
also stated they were interested in demolishing th:: ~~~,~t:i.n.q Harley
Hopkins School building and redeveloping the site~ The Cit~l stat'%' at
that time stated that they would cooperate with the School District in
facilitating this endeavor.
Subsequent to the execution of the purchaee agreement, th.e School
Distri~t requssted a revision because it was determined that
additional land would be required in ordar to meet zoning sotback
standards for their new structure on this site. It is now determined
that still more land will be needed in order to meet these setback
requirements.

Analvsis.
Based upon the proposal recommended, the City Council haa the
following issues to consider:
o Why does the School District require this additional property?
The Zoning Ordinance requires that school buildings constructed within
residential areas must meet a fifty foot setback requirement.
The architect for the School District has now completed the
preliminary design of the replacement building for the existing Harley
Hopkins School structure. The def" ign of this building does not
presently meet the setback requiI~ments, therefore one of the
following must be undertaken:
sale of additional property from the City
approval of a variance
It would be questionable as to whether a variance could be approved as
it would be difficult to prove hardship.
o What is the impact of this change?
1" 20 foot strip of property running approximately three-fourths the
length of the site is proposed to be sold to the School District. The
Sohool District would be required to provide an easement for the City
to utilize the property for public purposes including storm water
retention and recreational uses. Therefore, the City would not lose
any use ot the property even though it was no longer under Ci ty
ownership.

In order to complet.e a transfer of this property, the School District
would ruaed to receive approval of a request of a Waiver of the
Platting Requirements. Actual building construction will require
approval of a conditional use permit. At the present time it is
anticipated that the applicant will be appearing before the Zoning and
Planning comm1.ss.ion at their June meeting for consideration of these
iteJUs.

staft i~ recommending a sale price of $1.00. The fair market value is
not being requested by staff because the actual use of the Sit6 by the
City will not be diminished. rrh,is is a result of the easem~nt which
will be executed between both parties.

recording costs to facilitate the transfer of this property.

The City council has the following alternatives regarding this issue~
1. Approve the action as requested by staff. This will allow the
city staff to schedule the public hearing on the sale of the
subject property. They will also work with the School
District to undertake preparation of tha necessary paper work
to facilitate the sale.
2. Deny the request. Under this scenario the School District
will have two options:
~ a. request approval of a setback variance
b. redesign the proposed structure
3. continue for further information. The School District is very
anxious to begin construction of this new facility. Any
continuation will slow-down this process.
