'.'.'..',;...':, , -~~ :.- ":, l....~ JIlIIlIoIEl___ _..IIliR _ CI'l'Y OF HOPKINS Hennepin County~ Minnesota ORDINANCE NO: 90-633 ORDINANCE ESTABLISHING PROCEDURES FOR THE COLLECTION AND DEFEffi1ENT OF SPECIAL ASSESSMENTS Be it ordained by the City Council of the City of Hopkins as follows: That Section 703 pertaining to collection and deferment of special assessments is hereby added to the Hopkins City Code. 7003.01 Inasmuch as the city feels it necessar.y and proper to provide for prepayment of special assessments in whole or in part and to implement a procedure to allow deferment of special assessments in appropriate instances all as made and provided for in M.S. Section <129.061 and M. s. Secti.on 435.193 through 435.195, the following provisions are hereby authorized. 703.03 ;Frepav:ment. In addition to the prepayment of the whole of the assessment and intereB't on propert~t as provided by said statute, the oT",mer so assessed for local improvements may prepay not less than twentY--f i ve percen.t (25%) of the assessments withi.n 30 days fallowing adopti.on of the assessment roll. The balance remaining \V'ill he paid in accordance with the schedule adoptf,,"ld by the City Council. 703.05. Qefer~pt of Pavment~. The City Council may in its discretion defer payment of special assessments for a period of not more than 10 years for any homestead property ow:ned ,by a person 65 years of age or cIder or retired by virtue of a perm.anent and tot,al disability in either instance of which the city Council determines it would be a hardship for said owners to make the pa)nrrents. Such deferment shall be based on the following standards; 1. The annual income of owners requesting a deferment is found not to exceed the sum of $21/000.00 as of January 1, 1990. This amount shall subsequently be adjusted annually by the Consumer Price Index for the Twin city area; 2. Property owners retired as a ~e0ult of a permanent and total disability established by evidence satisfactory to City Council who have not attained age 65; _"l ... .. ~~- 1ri~ -- 7......,--...._ Deferred assessments shall accrue simple interest during the deferment period at the rate established for paYl:\ent of assessments at the time the assessment roll was adopted. The certification of deferment shall be renewed annually by the owner during the term of the deferment but net later than September 30 of each year. Upon failure to renew the deferment certification or upon expiration of the 10 year deferment period, the City Clerk shall prompt.ly certify to the county Au.ditor the amount of the deferred assessment. including interest to be inserte.d on the tax rolls and collected in the period of time remaining in the original assessment. .
