Q.V~rv~ey .. On January. 9, 1990, the City council desi.gnated the subject site as surplus property. The City Council also directed staff to solicit proposals. Requests for Proposals were mailed to 5 developers~ TWo proposals were received by the city at the end of March. The proposal from. Marcus Corporation was selected. Qn February 27 I 1990 the rezoning of the site from R-4 residential to B-3 business became effective. The applicant, Marcus corporation, is in the process of purchasinq well site on Second street and Blake Road from the city. applicant, is proposing to construct a 6600 square foot buildinC] retail. statt is recommending approval because the applicant meets the ordinance requirements. Mark Senn appeared before the Commission~ The Commission had 1;,'~viewed the proposal at the previous meeting. Mr. Senn showed the Commission samples of the e}~terior material for the proposed structure. The Commission discussed the landscaping! fencing( heating and air conditioning units, and the access to the property. ' The Commission unanimously approved Resolution No.. Parking. The site plan shows 31 parking spaces. The site will require 30 spaces for retail. 7 spaces are designated as compact. The site is allowed to have 25% of the spaces as compact. Staff is recommending that the one parkir~g space near the entrance on Second street be eliminated. Access.. Access to the site is proposed from Blake Road and Second street. The access from Blake Road will have to be approved by Hennepin county. If access is not granted by the County on' Blake Road, the site will have only one access point which is accept~ble to staff. The access point from Second street is lined up with the access point to Fina~ staff has reviewed the access point on Second street with Mitch Wanson of Benshoof and Associates. The site plan shows 4 trees of the required size plus additional shrubs throuqhout the site. The applicant has stated that he will add additional trees on the site. However, the applicant will not be able to add 11 trees to the site. Probably only two or three additional trees will be added to the site. The Commission can grant a waiver where compliance restricts off-street parking. The site will drain to a catch basin on the sout.heast corner of the site. The applicant will have to receive permission from Hennepin County to connect to the existing catch basin. Fire Ma,~sh~l. The Fire Marshal has reviewed the plans and found them acceptable. If the access from Blake Road is not granted from the County the plan is still acceptable. The B-3 district is ill general business district which allows most retail uses. The ordinance requires the fence t,o be a type that captures vehis:le ligh€:s. The applicant is proposing a 6 foot chain link/vinyl slat fence on tha west and north sides of the' property. This type of fence is being proposed because the fence does not look as bulky" However, the applicant will erect a wood fence if the Commission indicates a wood fence is preferred. The stnff would recoJ1lll'tend a wood fence. The fence on the north side of the property will have to be e>l:tended which the applicant has indicated he will do.. Most of the activity on the site occurs away from the residential areas. The apartments to the west are buffered by the building and a fence. The nearest apart:ment building to the west is oriented to the north and south not in the direction of the site. . WHEREASl the procedural history of -the application is as follows: 1. That the application for CUP90-3 was filed with the City of Hopkins on June 1, 19009 2. That the Ropkins Planning commission reviewed such application on June 26, 1990. 3. That the Hopkins Planning commission, pursuant to published and mailed notices, held a public hearing on June 26,.1990 and continued on July 31, ~990; all persons present at the hearing were given an opportunity to be heard. 4.. That the written comments and analysis of t..>1e City Staff and the Planning Commission were considered. ZfOW THEREFORE BE IT RESOLVED, that application for CUP90-3 is hereby approved sUbject to ,the following Findings of Fact: 1~ That the proposed building meets the requirements for the B-3 district. 2. That retail uses atte allowed in the B-3 district. BE IT FURTHER RESOLVED, that application for CUP90-3 is hereby approved subject to the following Conditions: ~. That the fence on the north side of the building is extended with a heiqht of at least 3 1/2 feet in wood. 2. That the applicant. adds 2 or 3 trees to the site. 3. Receive the proper permits from Hennepin County for drainaqe.. 4.. Tbat the fence between the reside.ntial area and the site is a wood fencea 5.. That the area behind the building is designated 'One 'Way' . 6. That the existinq sldewalk is retained or replaced by the applicant. 7. That the trasn container is enclosed on four sides.
