PUBLIC HEARING - SPECIAL ASSESSMENTS
Staff recommends the fallowing motion: Move that
Resolutions 90-98 90 -99 , 90 -100 and 90 -101 Resolutions
for Adoption of the Assessrn nt Roll. be adopted.
This action would cause the assessments in Exhibits A -D to
be levied against the properties involved.
Overview.
The proposed special assessments as described in Exhibits A,
B, C, and D are assessments for those projects completed to
date and their costs. Other assessments include unpaid
utility bilis or other charges that can become a lien on the
properties involved.
Notices of this public hearing and statements of assessment
have been mailed to all affected property owners.
All hearings must be completed, resolutions adopting
assessments passed, and the assessment rolle certified to
Hennepin County by October 10, 1990.

o Do residents have right to appeal?
Residents are given the opportunity to approach
the Council with their appeals during the public
hearing. Standard appeal forms were available at
City Hall and need to be submitted ne later than
tonight. Staff would like to examine these
appeals before making recommendations. Staff
recommends that the hearing be continued until
September 18 in order to examine any appeals.
If owners have not received satisfaction in this
manner they may still appeal an assessment to
district court pursuant to NSA Section 429.081
within 30 days after adoption of the assessment.

ADOPTION OF THE ASSESSMENT ROLL
PROJECT 8a-o7
HOBBY ACRES
WHEREAS, pursuant to proper notice duly given as
required by law, the City Council has met and heard and
passed upon all objections to the proposed assessment for
the construction of street, curb and gutter, and storm
sewer, Hobby Acres, as described in the files of the City
Clerk as Project 88 -07, and has amended such proposed
assessment as it deems just,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
HOPKINS, MINNESOTA:
1. Such proposed assessment, as a mended, a copy of
which is attached hereto and made a part hereof, is hereby
accepted and shall constitute the special assessment against
the lands named therein, and each tract of land therein
included is hereby found to be benefited by the proposed
improvement in the amount of the assessment levied against
it.
2. Such assessment shall be payable in equal anrnuai
installments extending over a period of 15 years, the first
of the installments to be payable on or after the first
Monday in January, 1991, and shall bear interest at the rate
of 8 percent per annum from the date of the adoption of this
assessment resolution. To the first installment shall be
added interest on the entire assessment from October 1, 1990
until December 31, 1991. To each subsequent installment
when due shall be added interest for one year on all unpaid
installments
.
3. It is hereby declared to be the intention of the
Council to reimburse itself in the future for the portion of
the cost of this improvement paid for from municipal funds
by levying additional assessments, on notice and hearing as
provided for the assessments herein made, upon any
properties abutting on the improvement but not made, upon
any properties abutting on the improvement but not herein
assessed for the improvement, when changed conditions
relating to such properties make such assessment feasible
4. To the extent that this improvement benefits
nonabutting properties which may be served by the
improvement when one or more later extensions or

improvements are made, but which are not herein T ssessed,
therefore, it is hereby declared to be the intention of the
Council, as authorized by Minnesota Statutes; Section
420, 051, to reimburse the City by adding any portion of the
cost so paid to the assessments levied for any of such later
extension or improvements.
5. The clerk shall forthwith transmit a certified
duplicate of this assessment to the County Auditor to be
extended on the property tax lists of the County, and such
assessments shall be collected and paid over in the same
manner as other municipal taxes.

the construction of concrete alley in Block 82, West
Minneapolis Second Division, as described in the files of
the City Clerk as Project. 89-05, and has amended such
proposed assessment as it deems just,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
HOPKINS, MINNESOTA:
1. Such proposed assessment, as amended, a copy of
which is attached hereto and wade a part hereof, is hereby
accepted and shall constitute the special assessment against

improvement in the amount of the assessment levied against
it.
2. Such assessment shall be payable in equal annual

RESOLUTION ADOPTING ASSESSMENTS
MISCELLANEOUS PROJECTS; DELINQUENT UTILITY BILLS AND INVOICES
WHEREAS, pursuant to proper notice published and given as
required by law, the City Council of the City of
Hopkins has met and heard on Tuesday, September 18
1990, and passed upon all objections to the proposed
assessments for miscellaneous projects, delinquent
utility bills and delinquent invoices, all as more
fully set forth and described in Exhibit D. attached to
Resolution No. 90-87 adopted the 7th day of August,
1990, and
WHEREAS, each of said improvements as set forth in Exhibit D
hereto attached, were presented and considered by said
Council separately at said meeting and each separately
accepted and adopted by unanimous vote of said Council,
NOW THEREFORE BE IT RESOLVED by the City Council of the City
of Hopkins as follows:
1,. Such proposed assessments, as amended, a copy of
which is attached hereto and made a part hereof and
hereby accepted and shall constitute the special
assessments against the lands therein named and each
tract of land therein included is hereby found to be
benefitted by the proposed improvement in the amount
of the assessment levied against it.
2. Such assessments shall be payable in equal, annual
installments extending over the periods of years set
forth in Exhibit D, the first of the installments to
be paid with the real estate taxes due and payable
in 1991 Any deferred installments shall bear
interest at the rate as set forth in said Exhibit D
from October 1, 1990. To the first installments
shall be added interest on the entire respective
assessment from October 1, 1990 until December 31,
1991. To each subsequent installments, when due
shall be added interest for one year on all unpaid
i nstallments.

3. The owner of any property so assessed may at anytime
after the adoption of the assessments and before
November 15, pay the whole of the assessments
against any parcel to the City Manager, and no
interest shall be charged if the entire assessment
is paid before November 15. Also the owner of the
property may at anytime thereafter, except between
November 15 and December 31 of each year, pay to the
City Manager the entire amount of the assessment
remaining unpaid.
ATTEST:
The Clerk shall forthwith transmit a certified
duplicate or duplicates of these assessments to the
Hennepin County Auditor to be extended on the proper
tax lists of the County, and such assessments shall
be collected and paid over the same manner as other
municipal taxes.
