ACCELN . Council at its August 7, 1990, meeting adopted a resolution concerning detachment of portions of a certain parcel of land in Hopkins and to be annexed by Minnetonka. The alternative chosen by Minnetonka provides for an Opportunity Court extension and an access to the east for the Westbrooke area as well as the vacant Steiner property. Cost and impact on a wetland are limitations, however these factors have diminished in light of Minnetonka's willingness to assume the entire cost through MSA and the fact that the Nine Mile Creek Watershed District prepared to grant a permit. Significant benefits are realized by a direct two -way collector between Smetana Drive and Bren Road in that traffic noise around the Opus Condominiums is reduced and needed access for the Steiner property is provided. This roadway makes improvements on traffic flow patterns and reduces traffic on sensitive roadway segments. Construction of the roadway affords an opportunity for the City of Minnetonka to provide water main and sanitary sewer utilities to the now undeveloped Steiner property. The alternative roadway chosen by Minnetonka and making annexation necessary is basically foundd on economics. If the roadway were to be centered on the existing common boundary, land acquisition costs would be $5460,000. By following the annexation route, land acquisition costs total $133,000. The roadway alignment along the enter line of the existing boundary would have adverse impact on Drag Specialties. A parking lot would be lost and the building would be in non - conformance as far as set -back regulations are concerned. o What are particulars in the cooperative agreement? Minnetonka will undertake the construction of Opportunity Court extension along Smetana Road and that the c.:,:dst.s shall be paid by Minnetonka. The contract will be let by Minnetonka and all engineering and supervision will be performed by Minnetonka.. All plans and proposals shall' be subject to- review and approval by Hopkins. Construction shall be in accordance with MSA standards. Minnetonka shall, provide sanitary sewer and water service to the Steiner property in Hopkins 1 RESOLUTION APPROVING PLANS AUTHORIZING BIDS, AND APPROVING COOPERATIVE AGREEMENT WITH THE CITY OF MINNETONKA CONCERNING CONSTRUCTION OF OPPORTUNITY COURT EXTENSION WHEREAS, the Council deems it appropriate and expedient to construct and reconstruct portions of Smetana Road as part of an Opportunity Court Extension Project, and WHEREAS, plans and specifications for such a project, as prepared by Rieke Carroll Muller Associates, Inc., have been presented for approval, NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF HOPKINS, MINNESOTA: Adopted this 4th day of September, 1990. Berg, Mayor • of AGREEMENT BETWEEN THE CITY OF MINNETONKA AND THE CITY OF HOPKINS RELATING TO THE CONSTRUCTION OF OPPORTUNITY COURT EXTENSION THIS AGREEMENT, made and entered into this CITY OF MINNETONKA, party of the first part, hereinafter sometimes referred to as "MINNETONKA ", and the CITY OF HOPKINS, party of the second part, hereinafter sometimes referred to as "HOPKINSft, both being municipal corporations organized and existing under and by virtue of the laws of the State of Minnesota. This Agreement is made pursuant to the authority granted in Minn. Statute 471.59. day 19 , by and between the WITNESSETH THAT: 1. Tian CITY OF MINNETONKA is interested in the construction of Opportunity Court Extension along the common boundary lines between the two cities as it is proposed to be constructed from Smetana Court to llth Avenue, a distance of approximately 0.7 miles, and in accordance with that certain Feasibility Study made by Rieke Carroll Muller Associates, Inc., and accepted by the Minnetonka City Council on June 18, 1990. • T 2. It is estimated that the total construction and engineering costs of said project will be in the amount of $945,288.04 and it is proposed that the CITY OF MINNETONKA fund the entire project. 3. It is agreed by and between the parties that MINNETONKA shall undertake the construction of Opportunity Court Extension along the common boundary line between the parties and extending from Smetana. Road to llth Avenue, a distance of approximately 0.7 miles, and that the costs of such project, based on actual construction and engineering costs, shall be paid by MINNETONKA. 4. The contract for such construction shall be let by the CITY OF MINNETOVKA in accordance with all applicable laws in respect to the letting of public improvement contracts and that all engineering and supervision shall_ be performed by the CITY OF MINNETONKA and that all the plans, proposals, drawing and proceedings shall be subject to review and approval by the CITY OF HOPI NS and its agents. 5. The construction of such street shall be in- accordance with the standards required for Municipal State Aid streets. 6. The CITY OF MINI ETONKA shall provide sanitary sewer and water service to service P.I.D. No. 25- 117 -22 -44 -0002 within the CITY OF HOPKINS. The service will be provided in accordance with the existing Joint Use Utility Agreement between both parties dated August 17, 1971. 7. The parties hereto have caused this agreement to be executed and sealed by their respective officers and by proper authorization of their respective municipal councils.
