This action will amend Section 315 of the city Code authorizing the
city Manager to establish a Personnel pOlicy.

The City's current personnel rules and regulations are ccntained in
section 315 of the Hopkins City Code i union contracts, and var ious
administrative melllos. These regulations need to be Drought into a
sing-Ie document. The proposed Personnel Policy will accomplish this.
. staff is proposing that the Personnel Regulations be removed from the
city Code. The new Personnel Policy would be an Administrative Policy
approved by the City Manager.

How was the proposed policy created? !
The proposed policy consists primarily of pol icies currentll' i.n I
forcet POlicies contained in the current personnel ordinance, I
w:':lich are not outdated, have been included in the new policy. i
Existing administrative policies1 dealing with such subjec'ts as :
health insurance for retirees, were also included in the policy. 1

New policies dealing with sexual harassment and AIDS have been II'
developed using examples from other cities.

What is the effect of removing the Personnel regulations from the i
City code? !
The personnel policy will remai.n the basis for personnel
management. It.s authority is not diminished by being a policy
rather tha~ an ordinance. The policy will be much easier to keep
. up to date. RevIsions will be brought before the Council for
approval.
The City Charter gives the City Manager control over p~rsonnel
!tl-lttters.
Chapter 6, Subdivision 3.. Except as in this Charter
otherwise provided, he shall appoint and may remove the
City Clerk, the City Assessor and all other City
officers and employees, all appointments to be upon
merit and fitness alone.
Chapter 6 i Subdivision 5. HG shall axerci~e control
ever all departments and divisions of the City
administration created by this Charter or which may be
hereafter created by the Council.
The current personnel ordinance has been in effect for many
ysars. It has not been revised for at least 7 years. It is a
cumbersome process to amend the ordinance for ~very .small chanq8 ..,
in p~r$onnel policy. The policy therefore has not been amended.
There have been instead a number of administrative memos issued.
This has lad to some confusion about what policies are currently
in force.

Has the proposed policy been reviewed by the city Attorney?
The policy has been reviewed by the city Attorney. He found no
problems with the proposed policy.
Have the employees been made aware of the proposed policy?
Drafts of the policy were originally given to supervisors for
review. After changes were made copies were again given to
supervisors and also to union representatives.

ORDINANCE: NO. 90-68S
AN ORDINANCB RELATING TO PERSONNEL REGULATIONS
AMENDING SECTION 315 OF THE
HOPKINS CITY CODE
BE IT ORDAINED by the Council of the City of Hopkins as follows:
SECTION 1. That Hopkins City Code is amended by deleting Section
315 in its entirety and addinq a new section 315 to read as
follows:

position of City employment, except when State law, City Charter, or Qrdina.nce

qualifications fo~ the position as determined by the City Manager.
315.02 D.ill.:t-illM . Except. as otherwise provided by Sta.te law, City
. Cha1.'ter. or ordinance. the City Manager or designe~ shall make all cktebicIls
regarding discipline of City employees, including s~sp&nsion and terminaticn.

employuent practices of the City. All City emplcye~s shall comply with ~l~se

be distributed to the City Council before adoption.
