This action could start the process of an overall street and storm
sewer project in Hobby Acres. The petition is for an Enqineerts
Report only.

A petition has been received from the Hobby Acres area for an
engineer's study conducted to identify advantages, disadvantages and
relative costs of two alternatives to improving the streets in Hobby
Acres.
A normal petition would be for an improvement. This petition is for
an engineerts study only. If a project is initiated as a result of
this study, tha Council could order the project constructed, after
'e. public hearinq, but it would take a 4/5 vote of the Council to order

The Hobby Acres homeowners have been concerned about the status of the
streets in their area. They have btaen discussing alternatives with
City staff for several months. After the City adopted the Roadway
Improvement Pol icy whereby the city shares 40' of the cost ot a
complete reconstruction, there has been more acceptance of a possible
project in their area.
The petition, as presented, asks to have an enqineerinq study
conducted to identify advantages and disadvantages and relative costa
of two alternatives to improving the streets in Hobby Acres. The two
alternatives requested are: 1. application of a two inch overlay on
existinq streets, and 2. comprehensive reconstruction of streets in
accordance with Hopkins Roadway Improvement Policy .7-D Section 3,
Roadwavs
The application of a two inch overlay on existing streets does not '.
address the two majo=::: problems on those streets, the lack of storm
drainage and the failure of the base. An overlay would serve as .
temporary measure but would not be a permanent solution. Under Policy
. .7-0 Section 3, Roadways, the total cost of the overlay would be an
assessable cost with ~o City participation.
Present policy is for the City to install storm sewers where needed
out of the Storm Sewer Fund. Any street restoration would be aseesscd
to the benefitted properties. Storm sewers are needed in the Hobby
Acres streets to control the drainage and to protect the street
surfaces and subgrade. Storm sewers would be installed based on ~~e
forthcoming storm Water Management Plan.
The street Reconstruction Policy calls for the property owners to pay
60% of the costs with the City paying 40%. This is for complete
restoration, which restoration will include the installation of
concrete curb and gu.tter.

In response to the petition, the Council has the following primary I
issues to consider:
- Should the petition for a study only be honored?
Minnesota statutes, Chapter 429, Local Improvements, Special
Assessments I sets the guidel ines and rules for special assessment
projects. All costs for an improvement, inClUding engineering costs
can be assessed. Nothing in the statutes addresses the cost of
preliminary engineering and plans if the project is not ordered
constructed. These costs may have to be borne by the City as it may
be difficult to prove benefit to properties for a study only.

The estimated cost for the study as petitioned is $5,000. If the
costs as developed for the study are close to those presented to the
!tobby Acres homeowners, we have been told that ths petitioning
homeowners would be in favor of constructing the project.
Projects that have been initiated by petition or by council have been
denied in the past by the Council but no costs for the studies for
those projects were assessed.
- How should the Council proceed if the petition is honored?
If the petition is honored, the Council, by resolution, should request
an Engineer's Report. This will set up the project for an assessable
project. As the pet! tion did not ask for the project but only the
report~ the Council could proceed under the provisions of the statute,
where, if there is less than 35% in frontage of the real property
abuttinq on the streets named in the petition as the location of the
improvements, the resolution adopting the project may be adopted only
by a vote of fou~-fifth~ of all members of the Council.
. - What are the current conditions of the roadway and storm drainaqe?
The streets in Hobby Acres were constructed about 35 years ago aftar
sewer and water was installed in the area. The city has no record of
the amount of base material or the type of asphalt surface
constructed. The streets were constructed without curbing. This type
of construction allows surface water to infiltrate into the base
material, weakening the base and causing failure of the aspbalt
surface. As a result, the asphalt surface of most of the streets are
in a very poor condition. Normal maintenance would not qive a
satisfactory result.
No storm sewers exist in the Hobby Acres streets. All surface water
drains on the road surface or leaves the road toward the edges,
eventually sOftening the base. No curbing exists on the streets which
would control the storm waters toward eventual disposition at Farmdale
Road and County Road #18.
- Should the Council consider the petition fer a study for a two inch
overlay.
The streets in Hobby Acres as mentioned above are in a very poor
condition. Normal maintenance would not give a satisfactory result.
The application of a two inch overlay would give a n9~ satisfactory
surface to the streets. This overlay would not address the underlying
problems of no storm sewer and a deteriorating base conditicn. The

overlay would be a temporary measure which would be fully assessed.
The estimated life of the overlay is about five years. This would not
be a good return on the costs of the pr~ject. staff recommends that
the overlay not be included in the study but a complete restoration
only be studied.
- Timetable tor improvements?
If the petition is honored and an engineer's study and feasibility
report is ordered, this report could be done by the first meetinq in
July. A hearing on the report to order the project constructed could
not be held before the first meeting in August. This would be too
late in 1988 to construct a project of this size. The homeowners in
Hobby Acres have been told that if a project is ordered in, that it
would not begin before early 1989 and would be completed and assessed
in 1989. They are agreeable to this timetable.

years. Thiel computed an approximate cost of the project 6S follows:

Repair cost as recommended = $50-$60 per foot
Project cost @I $55/foot = $350,000

The cost to repair the streets using an overlay only would total between
$140,000 and S 150,000 ($2250 - $2500 per lot) and waul d last about three
to fiye years. The city would probably not partiCipate 1n sharing any costs.

As a result of increas1ng concern over the deterioration of the streets in
Hobby Acres (see attached map) a number of actions have been taken by our
homeowners' assoc1ation during the past year. These actions included
form1ng a Street Improvement Committee, holdlng informational meetings
for our association members (with presentations by various members of
the City of Hopkins Public Works. Engineering and Street Department
staffs), and numerous fo1Jow~up discussions with these City staff il
members. The above actions have culminated in a petition to the City of
Hopkins to conduct an engineering study to ident try advantages,

disadvantages and relative costs of two alternatives to improving the
streets tn Hobby Acres as follows:
1. Application of a two inch overlay on existing streets.
2. Comprehensive reconstruction of streets in accordance with
Hopkins ROadway Improvement Policy #7-0 Section 3) Roadways.
. This petition was presented for signature to the attendees of a meet1r.g of
the Hobby Acres Homeowners' Assoclation held 00 21 Apron 1988 at the
Commlllity Room in the Hopkins City Hall (copy of minutes attached>' This
followed a presentaUon by John Thiel. Director of PubHc Works for the Clty
of Hopk tns on the new Iy adopted streeet policy and a report from Otr
association"s Street Improvement Committee. Subsequent to this meeting
an attempt was made to contact all homeowners who had not signed either
the petition for the study or another fann indicating that they chose not to
sign the petition and reasons for not doing so. The results from the
petitioning activity are as follows (petitions attached):
Total Hobby Acres Homeowners - 64
Homeowners in favor of the petition - 54
Homeowners not in favor of the petition - 8
Homeowners not contacted - 2
The reason that the pet1tlon includes the two inch overlay alternative to
the comprehensive reconstruction of the streets per the polley is because
our Street Improvement Committee lacked the engineering expertise to
effectively provide answers to those residents who beheve that this
approach would be adequate
We would like to take this opportunity to publicly acknowledge and thank

the City Council for the adoption of the Roadway Improvement PoHcy which
. we bel1eve to be important to the long term future of Hopkins.
We respectfully request that you accept our petition hereby submitted and
authorize V'I'e engineering stUdy to proceed as early as practicable. OUr
Street Irr~rovement Committee further recommends that the foHow1ng
guldel1nes be taken under advisement in conduct of the study as these are
of the utmost importance to the residents of Hobby Acres. These
recommendations were discussed at the 21 Aprl1 Assoc1aUon meeting
mentioned above and the expectation that they would be given serious
considerat1on by the City 1s largely responsible for the overwheJm1ngly
favorable response to the petition These gc1del1nes are as fcHows:
- No tree removal
- Replace streets at approximately the current width
- -ROlled- design for concrete gutters, If gutters are necessary
- 60/40 homeowner/city cost Share basis for street improvement
- Professtonal opinion on the effect that storm sewer installation
would have on the present sanltary sewer backup problems tn
some of the homes in the neighborhood

Assuming favorable action by the CIty Councl1 on our pet1Uon.. we request
U".at upon compleUon of the engIneering study our Street Improvement
CommIttee be brfefed on the results ~jor to the holding of a pubHc hearing.
This will give us a chance to brief our Assoclat1on members before the
hearing which could facflitate the hearing.
Members of our Street Jmprovement Committee plan to be at the CouncH
meeting on 17 May to answer any questions that Councll members may wish
to ask.

A RESOLUTION ORDERING PREPARATION OF
ENGINEER'S REPORT ON IMPROVEMENTS
WHEREAS it is ordered by the City Council that
consider.stion be given to the improvement of Hobby Acres by
street reconstruction thereon and the assessment of
benefiting property for all or a portion of the cost of the
improvement pursuant to M.S.A., Secs. 429.011 to 429.111, as
amended.
NOW, THEREFOP.E, BE IT RESOLVED BY THE CITY COUNCIL OF
i'. THE CITY OF HOPKINS, MINNESOTA, that the proposed

improvement be referred to Gordon Anderson, Director of
Enqineerinqi for study and he is instructed to report with
all convenient speed advising the Council in a preliminary
way as to whether the proposed improvements are feasible and
as to whether they should best be made as proposed or in
connection with some other improvement, and the estimated
cost of the improvements as recommended.
Adopted by the City Council of the City of Hopkins,
Minnesota this 7th day of June, 1988.
