Knox Lumber was approved in June to construct a warehouse OD the property west ot :'~e present retail store. It was determined lat.r the site was unbulldable. In November Knox was approved to move the building to the site that the existing building is on. The rear yard setback tor an 1-2 district is 20 teet. The proposed warehouse will be setbaak 20 teet but thElre Is a 20 foot overhang whicb would go to the lot line. . Trurlan Howell, architect for lnox appeared before the Co.mission. The property owner of the site to the west, R. L. Johnson, has no objeotion to the applioant baving the overhang to the lot line. Since the applicant bas control ot both parcela it will appear as one big parcel. The poor 80i1 oonditions create. a hardship to the applicant because the R. La Johnson site is unbulldable. . The building itself will have a 20 foot setback. Cn1y the overhang vill be in the 20 foot setback area. It is possible that if Knox ever lost the l&aBe to the R. L. Johnson property the overhang could be reaoved to provide the 20 foot setback. Alternatives. 1- Appro ve the 20 foot rear yard setback variance. Tb18 will allow the applicant to construct the warehouse with the 20 foct overhang. 2 . Deny the variance. The applicant will still be able to build the warehouse but without t.he overhang. 3 . Continue for more information. If the Commission feels more information is needed, the item should be continued for a month. I . I . .. WHEREAS, an application for a Variance entitled . ' VN87-12 has been made by Knox Lumber Company, 250 5th i - Avenue South, to oonstruct a building with a 20 foot property line setback. WHEREAS, the procedural history of tbe application it. as follows: 1 . That an application for Variance VH87-12 was filed with the City of Hopkins on November 23, 1987 . 2. That the Hopkins Planning Commission reviewed such application on December 29, 1987. 3 . That the Hopkins Planning Commission, pursuant to mailed notices, held a pUblic hearing on December 29, 1987; all persons present at the hearing were given an opportunity to be heard. 4. That the written comments and analysis of the . City Staff and the Planning Commission were considered. NOW THEREFORE BE IT RESOLVED, that the Hopkins City Council makes the rollowing Finding5 of Fact in respect to VN87-12: 1 . Johnson the 20 foot overhang is to be removed or Knox obtain a 20 foot easement from R. L. Johnson stating no buildings ...ill be constructed in this area. 2.
