The original petitions were for an Engineers Report. This aotion will
aocept the Engineer's Report and will continue an assessable projeot
by calling for a Public Hearing on November 15, 1988.
Overview.
A petition has been received from the Hobby Aores area tor an
engine~r's study conducted to identify advantages, disadvantages and
relative costs of two alternatives to improving the streets in Bobby
Aores.
A normal petition would be for an improvement. This petition i~ tor
an engineer1s study only. If a project is initiated as a result ot
this study and hearing, the Council could order tbe proje~t
construoted, after public hearing, but it would take a 4/5 vote or~b.
Counoil to order the project oonstruoted.

Baokground.
The Hobby Acres homeowners have been concerned about the st8tus of the
streets in their area. They have been disoussing alt~rnat1ves with
City staff tor several months. After the City adopted tbe Roadway
Improvement Policy whereby the City shares 40$ of the coat of a
oomplete reconstruction, there has been more acceptanc9 of a possible
project in their area.
The petition. as presented, asks to have an engineering study
oonducted to identify advantages and disadvantages and relative costa
of two alternatives to improving the streets in Hobby Acreso The two
alternatives requested are: 1. application of a two inch overlay on
exis t1ng streets. and 2. oomprehensi ve reconstruction of streets in
accordance with Hopkins Roadway Improvement Poli~y #7-D Section 3.
Road ways
The application of a two inch overlay on existing streets does not
address the two major problems on those streets, the lack of storll
drainage and the fai lure of the base. An overlay would serve as a
temporary measure but would not oe a permanent solution. Under Policy
#7-D Se~t1on 3, Roadways, the total cost of the overlay would be ae
assessable cost with no City participation.
Present polioy is for the Ci ty to install starID sewers where needed
out of the Storm Sewer Fund. Any street restoration would be aS5e~aed
to the benet! tted properties. Storm sewera are needed in the f.obby
Aores streets to control the drainage and to protect the street
surfaces and 8ubgrade. Storm sewers would be installed based on the
forthcoming Storm Water Hanag&ment Plan.
The Street Reconstruction Policy calls for the property owners to pay
60J of the costs for ths street reconstruction with the City paying
40%. This is for complete restoration, which restoration will include
the installlation of concrete curb and gutter.
Analysis.
In response to the petition, the Council has the following primary
issues to consider:
How should the Council proceed if the petition is honored?
If the petition is honored, and the Engineers Report accepted, the
Council1 by resolution1 should call for a public hearing. This will
set up the project for an assessable project. As the petition did not
ask for the project but only the report, the Council could proceed
under the provisions of the statute, where, if there is less than 35~
in frontage of the real property abutting on the streets named in the
petition as the location of the improvementa, the resolution adopting
the project may be adopted only by a vote of four-fifths_ of all
members of the Council.

What are the current conditions of the roadway and storm drainage?
The streets ifi Hobby Acres were construoted about 35 years aso after
sewer and water was installed in the area. The City has no reoord ot
the a~ount of base material or the type of asphalt surfaoe
oonstructed. The streets we~e constructed without curbing. This type
of construction allows surface W9.ter to infiltrate into the base
material, weakening the base and causing failure of the asphalt
surfaoe. As a result, the a3phalt surface of most of the streets are
in a very poor condition. Normal maintenance would no, give a
~atisf&ctory result.
No storm sewers e~ist in the Hobby Acres streets. All surface water
drains on the road surface or leaves the road toward the edges,
eventually softening the baee. No curbing exists on the street~ which
would control the storm waters toward eventual disposition at Farmdale
Road and County Road #18.
Should the Council consider the petition for a study tor a two inch
overlay.
The streets in Hobby Acres as mentioned above are in a very poor
co~d1t1on. Normal maintenance would not give a aatistBctory result.
The applioation of a two Inch overlay would give a new satistactory
surface to the streets. This overlay would not address the underlying
problems of no storm sewer and a deteriorating base condition. Tbe
overlay would be a temporary lDeasure which would be fully asses.ed.
The estimated life of the overlay is about five years. This would Dot
be a good return on the costs of tbe project. Staft reco.aenda that
the overlay not be considered but a complete restoration only be
considered.
Timetable for improvements?
A hearing on the report to order the project constructed should be
held the secend meeting in November. The homeOwners 1n Bobby Acres
have been told that if a project is ordered int that 1t would begin
early in 1989 and would be completed and assessed in 1989.
Al ternati vea .
1. Accept the Engineer's Report and order a Public H9ar1ng.
This action would be the next step that is necessary for
an assessment project. For the project to be ordered at
the public hearing, a 4/5 vote of the Council would be
required.
2. Do not accept the Engineer's Report and deny the petition
as presented. This action would return the petition to
the Hobby Acres homeowners for further action bused on
the fact that the petition is not a standard petition.
Staff recommends Alternative No.1, accepting tbe Engineer'S Report
and call of a public hearing on November 15, 1988.

WHEREAS, pursuant to Resolution No: 88-48 of the
Council adopted June 7, 1968, a report has been prepared by
Robert '['. Tod(11e, Ci ty Engineer, TIDA, with referenoe t'O
improvement of Hobby Acres streets by the re-oonstruotion
thereof with curb and gutter and asphalt surfaoe and tbe
installation of storm sawers and this report was received by
the Council on Ootober 18, 1988.
NOW, THEREFORE, B~ IT RESOLVED BY THE CITY CODICIL OF
BOP(IIS, MINHESOTA, as follows:
1. The Council will consider the improvement of suoh
streets in aocordance with the report and the ass8sament ot
benefiting property for all or a po~tion of the cost of the
improvement pursuant to M.S.A., Sees. 429.011 to Secs.
429.111, as amended, at an estimated total cost of the
improvement of $472,407 for curb and gutter and aspbalt
surface and $160,400 for storm sewers and will furtner
consider the market value befo~e and after said improvement.

The cost to repair the streets using on overlay only would total between
$140,000 and $1501000 ($2250 - $2500 per Jot) and would last about three
to five years. The city would probably not partiCipate in sharing any costs.
According to state statute, thp, process to initiate street repair is:
-The neighborhood petitions the Council to perform an engineering
study to determine project actions and cost
-The Engineering stUdy is performed
-The Engineering Report is presented at a pUblic hearing
-if the project is ordered, the contract is bid
-The project is performed
-Assessments are determined at a second public hearing
-Assessments can be appealed through an established process
if HODb'~ Acres elected to proceed, the project would be approved about JlJjy,
1933, the engineering study would be performed during 1938, the project

The Hobby Acres Street Committee recommended that the Association

HOBBY ACRES HOMEOWNERS' ASSOCiATION

As a result of 1ncreasing concern over the deterioration of the streets in
Hobby Acres (see attached map) a number of actions have been taken by our
homeowners' association during the past year. These actions included
forming a Street Improvement CommitteeJ holdIng informattonal meetings
for our association members (with presentations by various members of
the Cay of Hopk.ins Public Works, Engineering and Street Department
staffs), and numerous fOllOW-Up discussions with these City staff
members. The above actions have culminated in a petition to the City of
Hopkins to conduct an engineering study to identify advantages,
disadvantages and relative costs of two alternatives to improving the
streets in Hobby Acres as follows:
1. Application of a two inch overlay on existing streets.
2. Comprehensive reconstruction of streets in accordance with
Hopkins Roadway Improvement Policy -7-0 Section 3, Roadwa~s.
Th1s petition was presented for sfgnature to the attendees of a meeting of
the Hobby Acres Homeowners' Association held on 21 April 1988 at the
Community Room in the Hopkins City HaJJ (copy of minutes attached). This
followed a presentation by John Thiel, Director of Public Works for the, City
of Hopkfns on the newly adopted streeet poHcy and '3 report from our
association's Street Improvement Committee. SUbsequent to this meeting
an attempt was made to contact all homeowners who had not signed either
the petition for the study or another form ind~caUng that they chose not to
sign the petition and reasons for not doing so. The results from the
petitioning activity are as follows (petitions attached):

The reason that the petltion includes the two inch overlay alternative to
the comprehensfve reconstruction of the streets per the policy is because
our Street Improvement Committee lacked the engineering expertise to
effectively provide answers to those residents who believe that this
approach would be adequate.
We would like to take this opportunity to publicly aCknowledge and thank
John Thiel, Director of Public Works, CHff Robinson, Street Superintendant,
Gordy Anderson, Director of Engineering and the City Councll for their

assistance and patlence in working with us this past year. We commend
the City Councll for the adopti"n of the Roadway Improvement Polley which
we believe to be important to the long term future of Hopkins.
-We respectfully request that you accept our petition hereby submitted and
authorize the engineering study to proceed as early as practicable. Our
Street Improvement Committee further recommends that the following
guidelines be taken under advisement in conduct of the study as these are
of the utmost importance to the residents of Hobby Acres. These
recommendat ions were discussed at the 2 J Aprll Assoc1at ion meeting
mentioned above and the expectation that they would be given se,rious
consideration by the City is largely responsible for the overwhelmingly
favorabJe response to the petition. These guidelines are as (oHows:
- No tree removal
- RepJace streets at approximately the current width
- -RolJed- design for concrete gutters, if gutters are necessary
- 60/40 homeowner/city cost share basis for street improvement
- Professional opinion on the effect that storm sewer installation
would have on the present sanitary sewer backup problems in
some of the homes in the neighborhood
- Include replacement of driveway aprons
Assuming favorable action by the City Council on our petltionl we request
that upon completion of the engineering study Otr Street Improvement
Committee be briefed on the results prior to the holding of a public hearing.
This will give us a chance to brief our Assoc1ation members before the
hearing which could facilitate the hearing.
Members of our Street Improvement Committee plan to be at the Council
meeting on 17 May to answer any Questions that Council members may wish
to ask.
