A petition has been received from the campbell Addition area for an .. engineer's study conducted to identify advantages, disadvantages, and relative costs of two alternatives to improving the streets in the Campbell area. A normal petition would be for an improvement. This petition is for an engineer's study only. If a project is initiated as a result of' this study and hearing, the Council could order the project constructed, after public hearing, but it would take a 4/5 vote of the council to order the project constructed. primarY o o Issues to consider. CR:B8-203 Page 2 BaoJtqro\lnc3. The homeowners have been concerned about the status of the streets in their area. They have been discussing alternatives with City staff for several months. After the city adopted the Roadway Improvelnent Policy whereby the city shares 40% of the cost of a complete reconstruction, there has been more acceptance of a possible project in their area. The petition, as presented, asks to have an engineering study conducted to i.dentify advantages and disadvantages and relati.ve costs of improving the streets in accordance with Hopkins Roadway Improvement Policy 17-D section 3, ~oadways. Present policy is for the City to install storm sewers where needed out of the storm Sewer Fund. storm sewers are needed to control the drainage and to protect the street surfaces and subqr~de. storm sewers would be installed based on the forthcoming storm Water Management Plan. The street Reconstruction Policy calls for the property owners to pay 60% of the costs with the city paying 40%. This is for complete restoration, which restoration will include the installation of concrete curb and gutter. ~!lalvsis. In response to the petition1 the council has the fOllowing primary issues to consider: How should the Council proceed if the petition is honored? If the petition is honored, the Council, by resolution, should request an Engineer's R.eport. This will set up the project for an assessable proj ect. As the petition did not ask for the proj ect but only the report, the Council could proceed under the provisions of the statute, where, if there is less than 35% in frontage of the real property abutting on the streets named in the petition as the location of the improvements, the resolution adopting the project may be adopted only by a vote of four-fifths of all members of the Council. . . . 1 .! I I CR:88-203 Page 3 What are the current conditions of the roadway and storm drainage? The streets in the petition were constructed about 25-30 years ago. The city has no record of the amount of base material or the type of asphal t surface. constructed. The streets were constructed without curbing. This type of construGtion allows surface water to infiltrate into the base material, weakening the base and causing failure of the asphalt surfact. storm sewers exist only on Herman Terrace. All surface water drains on the road surface or leaves the road toward the edges, eventually softening the base. No curbing exists on the streets which would control the storm waters. ' Timetable for improvements? A hearing on the report to order the project constructed could be held the first meeting in December. This would be t.oo late in 1988 to construct a project of this size. The homeowners have been told that if a project is ordered in, that it would not begin before early 1989 and would be completed and assessed in 1989. They are aqreeable to this timetable. Alternatives. 1. Accept the Engineer's Report and order a Public Hearing. This action would be the next step that is necessary for an assessment project. For the project to be ordered at the public hearing, a 4/5 vote of the Council would be required. 2. Do no accept the Enginee's Report and deny the petition as presented. This action would return the petition to the Hobby Acres homeowners for further action based on the fact that the petition is not a standard petition. staff recolmnends Alternatiave No.1, accepting the Engineer's Report and call for a public hearing on December 6, 1988. CITY OF HOPKINS HENNEPIN COUNTY, MINNESOTA RESOLUTION NO. 88-91 A RESOLUTION RECEIVING REPORT AND CALLING FOR HEARING ON IMPROVEMENTS WHEREAS, pursuant to Resolution No. 88-50 of the Council adopted June 21, 1988, a report has been prepared by Robert T. Toddie, City Engineer, TKDA, with reference to improvement of Campbell Addition Area streets by the reconstruction thereof with curb and gutter and asphalt surface and the installation of storm sewers, thereon and '. this report was received by the Council on November 1, 1988. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF HOPKINS, MINNESOTA, as follows: 1. The Council will consider the improvement of such streets in accordance with the report and the assessment of for all or a portion of the cost of the improvement pursuant to M.S.A., Sacs. 429.011 to Sacs. 429.111, as amended, at an estimated total cost of the improvement of $347,323; and will further consider the market value before and after said . improvement, of the property affected thereby. 2. A public hearing shall be held on such proposed improvement on the 6th day of December, 1988, in the Council Chambers of the City Hal~ at 7~30 o'clock p.m., and the Clerk shall give published notice of such hearing and improvement as required by law.
