LOBBYING BY CABLE APPLICANTS

Staff recommends adoption of the following motion: 1't9ve that the Ho)!ki,ns City
Gounen adopt Re~olution #88-46 establishing a uniform volley with respect to
lobbvine by cable aDt!lica.nt~ with individual Council qtembeQor staff.
This action will establish ground lules fer lobbying Council or staff by future
applicants for our cable rranchise.

The other four cities have either already adopted this policy or, wil,l
adopting it shortly. .
o Will this ~olicy limit the Council in dealing with Cable applicants?
This policy is almost identical to the one adi)pted originally by the
C~uncil when the Ci~y fi~st sought a cable franchise.

. A s1mil~r lobbying policy was adopted when Hopkins and the otber cities of the
Southwest Suburban Cable Commission (SYSCC) first sought a cable fTanchise.
The operating committee suggested that the individual cities adopt identical
policies so that applicants for tne cable fTanch1.se and Rogers Cablesyst$DS will
understand the ground rules for lobbying.

RESOLUTION ESTABLISHING A UNIFORM POLICY WITH RESPECT TO
LOBBYING BY CABLE APPLICANTS WITH INDIVIDUAL COUNCIL MEMBERS
OR STAFF
WHEREAS, The City of Hopkins in conjunction with others
comprising the Southwest Suburban Cable Commission ("SWSCCIt)
have been requested by the Grantee of their similar Cable
Communications System Franchises (nFranchise"), to evaluate
issues relating to the potential sale of the Franchise; and
WHEP~, it is the concern of this City Council that in
this process all persons who may have an interest in a
particular cable company (either the existing Gran~ee und~r
the Franchise including its parent or affiliates, or
interested purchasers of the Franchise) conduct any
communications with regard to this matter with the City
Council as a whole and not with individual members of the
City Councilor administration, and
WHEREAS, the City Council has determined that it is in
the best interest of all of those participating in the
franchising process that all communications be public to
avoid any sort of misunderstanding and unwarranted
accusations that would otherwise develop either aqainst the
City or any of its Councilmembers or representatives; and
WHEREAS, the City Council has determined a policy must
be adopted that will be consistently followed by its Council
members and staff and with the understanding that
Councilmembels of other communities will likewise adhere to
a similar policy.
NOW, THEP~FORE, BE IT RESOLVED, by the City Council of
the city of Hopkins, Minnesota:
1. It is the policy of the Mayor and City Council that
all communications regarding any matter of the
cable communication system proposed sale and
transfer shall be directed to the City Council as
a whole and not to an individual Councilor staff
member. It is not intended by this that
communications by a constituent acting in a
private capacity as a constituent will be
prohibited.

It is requested that tho Chairman of the SWSCC
will request from the Grantee of the Franchise and
other interested cable companies that they provide
a list designating each person who will be the
official speakers or representatives on behalf of
them, and further, that the SWSCC shall provide to
the city council from time to time, a repQrt
advising it of the names of any su~h official
speakers or representatives.

3. That a copy of this Resolution be forwarded by the
City Clerk to the Chairman of the SWSCC and to the
Clerk of each of the cities who may be forming the
same cable communications system.
4. That the SWSCC is hereby authorized to distribute
a copy of the Resolution to each applicant or
potential applicant of a cable communications
system for this City.
5. This Resolution will be effective beginning with
the day of ita passage and continue until an
ordinance granting a franchise for a cable
communications system is adopted.
Adopted by the City council of the City of Hopkins this 21st
day of June, 1988.
