A RESOLUTION APPROVING SECOND READING OF ORDINANCE
N0.98-821, AN INTERIM ORDINANCE REGULATING AND
RESTRICTING THE DEMOLITION OR REMOVAL OF SINGLE FAMILY
RESIDENTIAL BUILDINGS AND STRUCTURES WITHIN THE
CITY OF HOPKINS
WHEREAS, on December 1, 1998 the City Council of the City of Hopkins approved the first
reading of Ordinance No. 98-821, which is an Interim Ordinance placing a moratorium on the
demolition or removal of any single family building or structure located within certain zoning
districts as established by the Hopkins Official Zoning Map.
WHEREAS, Section 1 of Ordinance No. 98-821 makes certain findings, including a finding
that it is necessary and prudent for City staff to conduct a planning study to determine whether the
City's Ordinances, Regulations and Official Controls should be modified to assist in achieving the
City's policies and goals relating to preservation of single family housing stock within the City.
WHEREAS, the City Council has determined that it is necessary to adopt an Interim
Ordinance regulating and restricting the demolition or removal of single family residential buildings
and structures in order to protect the planning process and the health, safety and welfare of its
citizens while the planning study is being completed by City staff.
WHEREAS, the "Background and Findings" contained in Section 1 of Ordinance No. 98-821
are hereby approved and incorporated in this Resolution in their entirety.
WHEREAS, the City Council has approved the second reading of Ordinance No. 98-821.
WHEREAS, Ordinance No. 98-821 will not be effective until twenty (20) days after its
publication.

WHEREAS, there is a need to suspend the issuance of permits or licenses for the demolition
or removal of any single family residential building or structure located within Zoning Districts R-1-
A, R-1-B, R-1-C, R-1-D and R-1-E, as established by the Hopkins Official Zoning Map, until the
effective date of Ordinance No. 98-821 for the purpose of protecting the planning process and the
health, safety and welfare of the citizens of the City of Hopkins while the planning study provided
for in Ordinance No. 98-821 is being conducted.
NOW, THEREFORE, the City Council of the City of Hopkins, Minnesota, hereby adopts
the following Resolutions:
RESOLVED, that the second reading of Ordinance No. 98-821 is hereby adopted and
approved, said Ordinance is hereby enacted by the City Council of the City of Hopkins, and
publication of such Ordinance is hereby ordered.
RESOLVED, that commencing on the date of approval of the first reading of Ordinance No.
98-821 and continuing until the effective date of Ordinance No. 98-821, no single family building
or structure located within Zoning Districts R-1-A, R-1-B, R-1-C, R-1-D and R-1-E, as established
by the Hopkins Official Zoning Map, shall be demolished or removed, nor shall any building permit,
license or other approval be issued or granted for such demolition or removal.
Adopted this day of December, 1998, by the City Council of the City of Hopkins,
Minnesota.
