RESOLUTION NO: 98-86
RESOLUTION MAKING FINDINGS OF FACT AND
APPROVING A CONDITIONAL USE PERMIT
TO CONSTRUCT AN APARTMENT BUILDING
WHEREAS, an application for Conditional Use Permit CUP98-13, has been made by Erwin,
Duane and Lesley Stobbe;
WHEREAS, the procedural history of the application is as follows:
1. That an application for a conditional use permit was made by Erwin, Duane and
Lesley Stobbe on October 23 1998;
2. That the Hopkins Zoning and Planning Commission, pursuant to mailed and
published notice, held a public hearing on the application and reviewed such
application on November 24, 1998: all persons present were given an opportunity
to be heard;
3. That the written comments and analysis of City staff were considered; and
4. A legal description of the subject property is as follows:
That part of the North half of the Northwest Quarter of Section 19, Township 117
Range 21, West of the fifth principal meridian lying Easterly of the Easterly right
of way line of the Great Northern Railway, South of the Southerly line of Trunk
Highway #7 as built and operated across said North half, West of the Northerly
extension of the Easterly line of the plat of Auburn North, Northerly and
Northwesterly of the Northerly and Northwesterly lines of said plat of Auburn
North and North of the Westerly extension of that certain South line of Lot 1,
Block 1, Auburn North shown on said plat having a dimension of 174.12 feet.
NOW, THEREFORE, BE IT RESOLVED that the application for Conditional Use Permit
CUP98-13 is hereby approved based on the following Findings of Fact:
That the proposed building meets the requirements for a conditional use permit.
BE IT FURTHER RESOLVED that application for Conditional Use Permit CUP98-13 is hereby
approved based on the following conditions:
1. The utilities are connected to the City's system.
2. The Minnehaha District will have to approve the proposed development.
3. The City will require a stormwater management plan with all runoff calculations.
Runoff will need to be mitigated to meet the requirements of Section 546.06
Subd. 7. The City will require a review of the developer's storm water
management plan by its own consultant. The applicant will be responsible for the
cost of the review.

4. The City will require utility easement dedicated to the public for an existing water
main, sanitary sewer and drainage ditch on site.
