1997-032 CITY OF HOPKINS Hennepin County, Minnesota RESOLUTION NO: 97-32 RESOLUTION MAKING FINDINGS OF FACT AND APPROVING A V ACA TION OF THE ALLEYS BEHIND THE NORTHEAST CORNER OF 8TH AVENUE AND MAINSTREET WHEREAS, an application for Vacation V AC97-1 has been made by Jeff Kakach, and WHEREAS, the procedural history ofthe application is as follows: 1. That an application for Vacation V AC97-1 was made by Jeff Kakach on February 21, 1997; 2. That the Hopkins Planning Commission, pursuant to mailed and published notice, held a public hearing on the application and reviewed such application on March 25, 1997: all persons present were given an opportunity to be heard; 3. That the written comments and analysis ofthe City staff were considered; and 4. A legal description of the subject property to be vacated is as follows: That part of the East-West alley in Block 66, WEST MINNEAPOLIS SECOND DIVISION, Hennepin County, Minnesota, which lies East of the west line of said Block 66, extended across said alley, and which lies West of the southerly extension of the West line of Lot 6; and, That part of the North-South alley in Block 66, WEST MINNEAPOLIS SECOND DIVISION, Hennepin County, Minnesota which lies North of a line from the southeast comer of Lot 13 to the southwest comer of Lot 6, and which lies Southerly of a line from the northwest comer of said Lot 6 to the northeast comer of Lot 16. NOW, THEREFORE, BE IT RESOLVED that application for Vacation VAC97-1 is hereby approved, based on the following Findings of Fact: 1. That the alleys are not needed for a public right-of-way. BE IT FURTHER RESOLVED that application for Vacation VAC97-1 is hereby approved based on the following conditions: 1. That the conditional use permit is granted for the construction of the proposed development. 2. That the property is granted the preliminary/final plat. 3 That the applicant grant the City and utility companies an easement for any utilities located in the vacated alleys. RESOLUTION NO: 97-32 Page 2 4. That the City is granted a maintenance vehicle easement to allow City trucks to travel unimpeded on the vacated east-east alley. 5. That the vacated east-west be kept clear of any obstructions which would restrict or hamper City vehicle travel - see item 4. Adopted this 1 st day of April 1997. By Charles D.
