CR 06-052 Adoption of Assessment Walter May Sanitary Sewer Connect Fee CITY OF May 2, 2006 m HOPKINS Council Report 2006-052 ADOPTION OF ASSESSMENT WALTER MAY SANITARY SEWER CONNECTION FEE Proposed Action Staff recommends approval of the following motion: adopt Resolution 2006-031, adopt assessment roll, Walter May connection fee. Overview Walter May resides at 41'2 Webster Place in Hopkins. He currently has a sanitary sewer pump that lifts wastewater from his home to the Hopkins sanitary sewer system. The recent Minnetonka Blvd improvements included a sanitary sewer line that is low enough to serve Mr. May's property by gravity. Thus he could remove the pump. This sewer line is owned by the City of Minnetonka and they have approved his connection, but will require him to pay $10,973.85. The property owner has petitioned the City to pay this connection fee and assess his property at 7% for 10 years. They have waived their rights to a public hearing and appeal of the assessment under Minn. Stat. Sect 429.01 et seq. Staff recommends approval ofthe resolution assessing this property. Supportinl! I/We acknowledge that the estimated cost of the improvements and rtilated costs is $10,973.85. I/We further acknowledge that this amount is only an estimate and that the actual amount may be higher or lower and I/We agree that the amount to be assessed will be the amount of actual costs regardless of the estimated set forth herein. I/We hereby waive all of our rights pursuant to Minn. Stat. Sect 429.01 et seq., including but not limited to our right to request or conduct a public hearing regarding the above improvements and/or the costs for the improvements, our right to object to the amount of the assessment for such improvements and our right to appeal to District Court the amount of the assessment levied against our property for the improvements. The terms and length of the assessment will be determined by the City Council at their meeting on May 2, 2006. (S~~ ~eJul1L f lMtf (Signature) 4 :? 0 Ob (Date) +/~/oC (Date) I CITY OF HOPKINS HENNEPIN COUNTY, MINNESOTA RESOLUTION NO. 2006-031 RESOLUTION ADOPTING ASSESSMENT ROLL WALTER MAY CONNECTION FEE WHEREAS, a petition and waiver was received by the City Clerk from Walter May, requesting said assessment and waiving rights to a public hearing and appeal under Minn. Stat. Sect 429.01 et seq., NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Hopkins, Minnesota: 1. Such proposed assessment, as may be amended and a copy of which is attached hereto and made a part hereof, is hereby accepted and shall constitute the special assessment against the lands named therein, and each tract of land therein included is hereby found to be benefited by the proposed improvement in the amount of the assessment levied against it. 2. Such assessment shall be payable in equal annual installments extending over a period of ten years, the first of the installments to be payable on or after the first Monday in January 2008, and shall bear interest at the rate of 7 percent per annum from the date of the adoption of this assessment resolution. To the first installment shall be added interest on the entire assessment from May 2, 2006, until December 31, 2007. To each subsequent installment when due shall be added interest from one year on all unpaid installments. 3. The clerk shall forthwith transmit a certified duplicate of the assessment to the County Auditor to be extended on the property tax lists of the County, and such assessments shall be collected and paid over in the same manner as other municipal taxes.
