RESOLUTION NO: 90-68
RESOLUTION MAKING FINDINGS OF FACT AND APPROVING
CONDITIONAL USE PERMIT CUP90-3
WHEREAS, an application by Marcus Corporation for a Conditional
Use Permit CUP:90-3 to construct a 6,000 square foot
retail building at 302 Blake Road North is approved.
WHEREAS, the procedural history of the application is as
follows:
1. That the application for CUP90-3 was filed with
the City of Hopkins on June 1, 1900.
2. That the Hopkins Planning commission reviewed such
application on June 26, 1990.
3. That the Hopkins Planning Commission, pursuant to
published and mailed notices, held a public
hearing on June 26, 1990 and continued on July 31,
1990; all persons present at the hearing were
given an opportunity to be heard.
4. That the written comments and analysis of the City
Staff and the Planning Commission were considered.
NOW THEREFORE BE IT RESOLVED, that application for CUP90-3 is
hereby approved subject to the following Findings of
Fact:
1. That the proposed building meets the requirements
for the B-3 district.
2. That retail uses are allowed in the B-3 district.
BE IT FURTHER RESOLVED, that application for CUP90-3 is hereby
approved subject to the following Conditions:
1. That the fence on the north side of the building is
extended with a height of at least 3 1/2 feet in wood.
2. That the applicant adds 2 or 3 trees to the site.
3. Receive the proper permits from Hennepin County for
drainage.
4. That the fence between the residential area and the
site is a wood fence.
5. That the area behind the building is designated 'One
Way' .
6. That the existing sidewalk is retained or replaced by
the applicant.
7. That the trash container is enclosed on four sides.
