RESOLUTION NO. 89-6
A RESOLUTION ADOPTING THE CITY OF HOPKINS
MEDICAL AND DAY CARE EXPENSE REIMBURSEMENT PLAN
WHEREAS, the Plan will provide as savings to employees in
Federal, State and Social Security taxes, and
WHEREAS, the City will reduce its cost for the employer's
share of Social Security taxes, and
WHEREAS, the Plan is permitted under section 125 of the IRS
code, therefore
BE IT RESOLVED, that the city of Hopkins Medical and Day
Care Expense Reimbursements Plan be and the same is adopted;
and
BE IT FURTHER RESOLVED, that any proper officers of the City
are hereby authorized to make such contributions from the
funds of the City as are necessary to carry out the
provisions of said Plan at any time; and
BE IT FURTHER RESOLVED, that in the event any conflict
arises between the provisions of said Plan and the Employee
Retirement Income Security Act of 1974 (ERISA) or any other
applicable law or regulation (as such law or regulation may
be interpreted or amended), the City shall resolve such
conflict in a manner which complies with ERISA or such law
or regulation.
Passed and adopted by the Council of the City of Hopkins,
Minnesota, at a regular meeting of the Council held the 3rd
