03-03-1987 ., HOPKINS CITY COUNCIL MINUTES - MARCH 3, 1987 1 . A r gular meeting of the Hopkins City Council was held on March 3, 1987 in the Council Chambers of City Hall. Pr sent were Mayor Lavin, Councilmembers: Anderson, Milbert, Shirley, and Redepenning. Also present were staff members: Rapp, Renne, Mielke, G. Anderson, Kerrigan, E. Johnson, Strawn, Liddy, and Prosecuting Attorney Steiner. I. The meeting was called to order at 7:55 p. m. II. A Fire Department Commendation was awarded to Jeanne Sutich and Vern Evers for rescuing a person from a burning building on February 21st. The Police Department presented a plaque to Jeanne Sutich for her bravery in this same venture. III. PROCLAMATION: Mayor Lavin proclaimed the week of March 8th - 14th as Volunteers of America week. - IV. APPROVAL OF MINUTES Mr. Redepenning moved and Mr. Milbert seconded the motion to approve the minutes of the February 17th regular Council meeting. A poll of the vote was as follows: Mr. Anderson, Aye; Mr. Shirley, Aye; Mr. Milbert, Aye; Mr. Redepenning, Aye; Mayor Lavin, Aye. The motion carried unanimously. Mr. Anderson moved and Mr. Mi1bert seconded the motion to approve the minutes of the special joint Council/ccDC meeting of February 10, 1987. A poll of the vote was as follows: Mr. Anderson, Aye; Mr. Shirley, Aye; Mr. Milbert, Aye; Mr. Redepenning, Aye; Mayor Lavin, Aye. The motion carried unanimously. V. APPROVAL OF MISC. LICENSE APPLICATIONS Mr. Shirley moved and Mr. Milbert seconded the motion to approve the license applications (197 - 205) as listed. A poll of the vote was as follows: Mr. Anderson, Aye; Mr. Shirley, Aye; Mr. Milbert, Aye; Mr. Redepenning, Aye; Mayor Lavin, Aye. The motion carried unanimously. ..... VI. APPROVAL OF DISBURSEMENTS, PRELIST 759 Mr. Anderson moved and Mr. Shirley seconded the motion to approve the disbursements on prelist 759 in the amount of $266,912. A poll of the vote was as follows: Mr. Anderson, Aye; Mr. Shirley, Aye; Mr. Milbert, Aye; Mr. Redepenning, Aye; Mayor Lavin, Aye. The motion carried unanimously. VII. MID-BLOCK STREET LIGHTING - 7TH AVE, NORTH OF MAINSTREET Mr. Shirley moved and Mr. Anderson seconded the motion to call a hearing for April 21st regarding this item. The motion carried unanimously. VII. HEARINGS - LIQUOR VIOLATIONS Minnesota statute 340A.415 requires that the issuing authority (City Council) shall either suspend, fine, or revoke the license of a lie nse holder that has failed to comply with an applicable statute, rule, or ordinance relating to alcoholic beverages. In addition, no suspension or revocation can take effect until the license holder has been afforded an opportunity for a hearing. The following hearings were called as a result of this statute. Th alleged violations of Leaman's Liquor, Archies, and Richards were addressed together, since they were all under the same circumstance. Representatives of these liquor establishments were heard. After discussion, the Council felt that they needed more legal advice in dealing with this matter. Mr. Redepenning moved and Mr. Shirley seconded the motion to continue this item to the next Council meeting and have staff obtain special counsel to answer questions posed by the Council. A poll of the vote was as follows: Mr. Anderson, Aye; Mr. Shirley, Aye; Mr. Milbert, Aye; Mr. Redepenning, Aye; Mayor Lavin, Aye. The motion carried unanimously. The Council then discussed alleged violations involving the Opera Hall. No one was present from the Opera Hall. Mr. Milbert moved and Mr. Anderson seconded the motion to continue this item to the next regular Council meeting at which time they would have special legal counsel to answer questions. A poll of the vote was as follows: Mr. Anderson, Aye; Mr. Shirley, Aye; Mr. Milbert, Aye; Mr. Redepenning, Aye; Mayor Lavin, Aye. The motion carried unanimously. VIII. NEW BUSINESS: a. SENIOR CITIZENS CROSSWALK - CHAPEL VIEW A I tter was received from Roger Jewett, president of Chapelview requesting that necessary steps be taken to protect pedestrians crossing Minnetonks Mills Road at 6th Avenue North. He requested that lined crosswalks be placed at that intersection and that proper signs be placed. Staff recommended that Council order the painting and the proper signing of the crosswalk and authorize the placing of the walk and the installation of the ramp in the northwest quadrant, with costs of the concrete work billed the Chapel View. Mr. Anderson moved and Mr. Milbert seconded the motion to approve the recommendations of staff and have this work done. APPOINTMENT OF CHEMICAL HEALTH COMMISSION Mayor Lavin appointed the following persons to the Chemical Health Commission: Donna Leviton John Buck Kevin Kastelle Reb cca Lee Thorstad Ch ryl Currier Dave Gravdahl Mike Tait Mr. Milbert moved and Mr. Redepenning seconded the motion to approve the appointments of the Mayor. A poll of the vote was as follows: Mr. Anderson, Aye; Mr. Shirley, Aye; Mr. Milbert, Aye; Mr. Redepenning, Aye; Mayor Lavin, Aye. The motion carried unanimously. c. EASEMENT FOR RECONSTRUCION OF BRIDGE - HIGHWAY 73 . The City Council, by resolution, joined the City of Minnetonka in requesting that Hennepin County rebuild the Minnehaha Creek crossing at County Road 73. The County requested three easements in order to proceed with the work. Mr. Milbert moved and Mr. Redepenning seconded the motion to authorize the signing of the easements as presented. A poll of the vote was as follows: Mr. Anderson, Aye; Mr. Shirley, Aye; Mr. Mi1bert, Aye; Mr. Red penning, Aye; Mayor Lavin, Aye. The motion carried unanimously. d. HIGHWAY 7 IMPROVEMENTS The City received a letter from MNDOT asking that the City enter into an agreement to share in the costs of replacing the outdated equipment at 5th Avenue North and Trunk Highway 7 with modern equipment. The approximate cost of these revision is $80,000, with Federal Hazard Elimination Safety Funds paying for 90% of the project. The remaining costs would be split evenly with MNDOT and the City. The City's cost is estimated to be $4,000, which should be paid with State Aid funds. Mr. Milbert moved and Mr. Anderson seconded the motion to agree to sign agreement No. 58459 and notify MNDOT. PARKING REQUEST - WALSER Walser Leasing will be holding an open house/luxury auto showing on March 20 from 5 - 7 p.m.. They are expecting 250 - 350 people and r quest a street closure to insure parking for participants. That Walser provide an off-duty police officer to direct traffic from 4 p.m. to 8 p.m. 2. Provide "Congested Area Ahead" signs on Mainstreet west of Walser and on Washington Avenue at Park Lane and at First Street North. 3. Temporarily remove the parking restrictions on Washington Avenue from west of Walser easing to First Street North from 4 p.m. to 8 p.m. Mr. Shirley moved and Mr. Redepenning seconded the motion to approve the recommendation of staff as outlined above. LIQUOR LICENSE APPLICATION - DINGOS Tom Sullivan applied for an on sale liquor, Sunday liquor, restaurant, cigarette (2), amusement devices (8), pool tables (1-6), dance hall licenses at 517 Mainstreet. e Mr. Milbert moved and Mr. Redepenning seconded the motion to approve the application for licenses subject to the Health Inspector's approval. A poll of the vote was as follows: Mr. Anderson, Aye; Mr. Shirley, Aye; Mr. Milbert, Aye; Mr. Redepenning, Aye; Mayor Lavin, Aye. The motion carried unanimously. At this point a brief recess was taken. g. REPORT ON CLUB LICENSES At this point Mr. Anderson stepped down from the table, and was not involved, in the discussion of this item. At the last Council meeting, Mr. Strachota and Mr. Madden appeared before the Council to report that service clubs in Hopkins were selling liquor to non-members. Staff was asked to prepare a report covering the City ordinance regarding clubs in Hopkins. A report was received from Scott Renne, City Clerk. Dennis Madden, own r of Bursch's appeared to reiterate his concern about clubs selling liquor to non-members. Mr. Redepenning moved and Mr. Milbert seconded the motion to order a hearing on this subject at the April 7, 1987 meeting and to notify all club presidents and liquor establishment owners in Hopkins of their intention. A poll of the vote was as follows: Mr. Anderson, Aye; Mr. Shirley, Aye; Mr. Milbert, Aye; Mr. Redepenning, Aye; Mayor Lavin, Aye. The motion carried unanimously. h. FIRE PROTECTION EQUIPMENT ASSESSMENT Staff furnished the Council with a proposed policy statement regarding the petitioning for fire protection equipment. The policy limited the amount of money to be expended in a year to $200,000. The cost of the improvement plus an administrative fee of 5% or $100, whichever is greater will be assessed to the p titioning property owner. The length of the assessment shall not exceed 10 years and the interest rate shall not exceed 8%. Mr. Milbert moved and Mr. Redepenning seconded the motion to adopt the policy as presented by staff. PETITION FOR FIRE HYDRANT (MEDALIST) A P tition for a fire hydrant was received from the Medalist Sports Club at 1002 - 2nd Street NE. Mr. Redepenning moved and Mr. Anderson seconded the motion to adopt Resolution # 87-17 ordering an engineer'S report. A poll of the vote was as follows: Mr. Anderson, Aye; Mr. Shirley, Aye; Mr. Milbert, Ay ; Mr. Redepenning, Aye; Mayor Lavin, Aye. The motion carried unanimously. j. GAMBLING LICENSE - 1 DAY- ST JOHN'S st John's Church is having a one day fund raising event on April 25, 1987 from 5 p.m. until 12:30 a.m. on April 26. They made application for a gambling license. Mr. Anderson moved and Mr. Redepenning seconded the motion to take no action, allowing the Mn. Gambling Board to act. A poll of the vote was as follows: Mr. Anderson, Aye; Mr. Shirley, Aye; Mr. Milbert, Aye; Mr. Redepenning, Aye; Mayor Lavin, Aye. The motion carried unanimously. k. 1987 DISPATCH/PSO CONTRACT Staff presented changes to the 1987 Dispatch/PSO contract for 1987. Mr. Milbert moved and Mr. Redepenning seconded the motion to approve th contract as presented.
