COUNCIL WORKSHOP MEETING OF JULY 14. 1987
A workshop meeting was held on July 14 at 7: 30 at Hopkins
City Hall in the Conference room.
Present were Councilmembers: Shirley, Redepenning, Kritzler
and Anderson. Mayor Milbert arrived at 7:45. Also present
was City staff: Rapp, Genellie,Tom Anderson and City
Attorney Miller.
I. CONSIDER TWO DAY BEER LICENSE - RICHARDS LIQUOR
Richards Liquor applied for a license to sell beer outside
during the Raspberry Festival.
Mr. Shirle y moved and Mr. Anderson seconded the mot ion to
approve the license. The motion carried unanimously.
II. CITY ORDINANCE CODE MODIFICATIONS

The City ordinances were codified by the firm of LeFevere,
Lefler, Kennedy, 0' Brien and Drawz in 1986. Staff is now
preparing for Phase II of the codificat~on, which is
intended to clean up any problems that have been discovered
and omit ordinances that are obsolete or not enforced.
Department heads submitted their proposed changes to the
City Manager and copies were submitted to the Council.
Council was in agreement with the changes but needed some
clarification about some of the changes submitted by the
Police Department. The Staff will do some research to come
up with the answers to the questions presented by the
Council and resubmit their material. The action on the
amendments to the ordinances will be scheduled at a later
date.
II. DISCUSSION - EISENHOWER SCHOOL MODIFICATION

In January 1987, the Hopkins' School District, Building and
Grounds people asked the Fire Marshal and the Building
Inspector to tour the Eisenhower Community Center. The
School District is planning to change part of the building
into a grade school and wanted to know what requirements the
City would have for the building in order to do this.
After touring the school, the Fire Marshal sent a list of
requirements to the School Districts' Build~ngs and Grounds
office. In May, the Fire Marshal received a letter from the
Superintendent of Schools stating that their architectual
consultant submitted his recommendations and did not ~nclude
some of the requirements cited by the Fire Marshal and that
the School District would proceed with plans as outlined by

their architect. The architectual consultant's
recommendations were enclosed. The Fire Marshal replied to
Dr. Bruning that the City of Hopkins intended to enforce the
Fire Code. The Hopkins Assistant Attorney finds that the
Fire Marshal has the authority to order the School District
to bring that structure into compliance with the Fire Code
if the structure was not legally in compliance with codes in
effect prior to the Uniform Fire Code or if the Fire Marshal
determines that the existing condition of a structure
constitutes "a distinct hazard to life or property".
The Council concurs that, if there is a hazard to life or
property, the City must enforce the Fire Code.
III.
LEGISLATIVE POLICY MANUAL
City Staff prepared a Legislative Policy Manual to be
adopted by the City Council. City Manager Rapp explained
the changes that we made in the manual after a copy had been
distributed to the Council. The City Manager went through
the manual and asked for comments.
A question was posed as to whether it was prudent for a
Councilmember to state his opinion in a letter on City
stationary which might be misconstrued as the opinion of the
entire Council. There was also a question regarding travel
expense for staff members and Council.
For the most part, the Council was in agreement with Staff
recommendations. The City Manager said that the policies
would be "fine tuned" and returned to the Council for final
approval at a later date.
