01-21-86 Resolutions RESOLUTION NO. 86-2 CITY OF HOPKINS HENNEPIN COUNTY, MINNESOTA RESOLUTION MAKING FINDINGS OF FACT AND APPROVING APPLICATION FOR VARIANCE VN-85-3 WHEREAS, an application for Variance entitled VN-85-3 has been made by Han-San Lee, 1601 Mainstreet, for parking, front yard setback and sideyard setback to operate a quick order restaurant. . WHEREAS, the procedural history of the application is as follows: 1. That an application for Variance VN-85-3 was filed with the City of Hopkins on November 12, 1985. 2. That the Hopkins Planning Commission reviewed such application on December 30, 1985. 3. That the Hopkins Planning Commission, pursuant to mailed notices, held a public hearing on December 30, 1985; all persons present were given an opportunity to be heard. 4. The written comments and analysis of the City Staff and the Planning Commission were considered. NOW, THEREFORE BE IT RESOLVED, that the Hopkins City Council makes the following Findings of Fact in respect to VN-85-3: 1. That a similar use currently exists within the structure proposed for remodeling. 2. That the proposal does not alter the overall square footage of the existing structure. 3. That strict interpretation of the Zoning Ordinance would create a hardship due to the preexisting conditions. 4. That strict application of the parking requirements in the ordin- ance would create a hardship based on the existing conditions and proposed use. 5. That the granting of these variances is keeping with the intent of the ordinance. BE IT FURTHER RESOLVED, that application for Variance VN-85-3 is hereby approved subject to the following conditions: 1. That parking be formally reviewed nine months after remodeling is completed. 2. Applicant provide at least 4 on-site parking spaces if it is deter- mined necessary at time of review. WHEREAS, an application for a Conditional Use Permit entitled CUP85-1 has been made by Han-San Lee, 1601 Mainstreet, for a Conditional Use Permit to operate a quick order restaurant at 1601 Mainstreet. WHEREAS, the procedural history of the application is as follows: 1. That an application for Conditional Use Permit CUP85-1 was filed with the City of Hopkins on November 12, 1985. 2. That the Hopkins Planning Commission reviewed such application on December 30, 1985. 3. That the Hopkins Planning Commission, pursuant to mailed notices, held a public hearing on December 30, 1985; all persons present were given an opportunity to be heard. 4. The written comments and analysis of the City Staff and the Planning Commission were considered. NOW THEREFORE BE IT RESOLVED, that the Hopkins City Council makes the following Findings of Fact in respect to CUP85-1: 1. That the use is a permitted use in a B-3 District. 2. That the front yard, side yard and parking variances were approved. BE IT FURTHER RESOLVED, that application for Conditlonal Use Permit CUP85-1 is hereby approved subject to the following conditions: 1. That the Conditional Use Permit be reviewed nine months after the remodeling has been completed. 2. Applicant provide at least four on-site parking spaces if it is determined necessary at time of review. 3. That the proposed business be operated as a take-out operation only, with no on-site seating. 4. That the addition of seating is sufficient cause for reviewing and amending the parking requirements. That an application for Variance VN85-48 was filed with the City of Hopkins on August 26, 1985. 2. That the Hopkins Planning Commission reviewed such application on September 24, 1985. 3. That the Hopkins Planning Commission, pursuant to mailed notices, held a public hearing on December 30, 1985: all persons present were given an opportunity to be heard. 4. The written comments and analysis of the City Staff and the Planning Commission were considered. NOW THEREFORE, BE IT RESOLVED that the Hopkins City Council makes the following Findings of Fact in respect to VN85-48: 1. A unique circumstance is the overpass. 2. A hardship exists due which dictates the height of a Highway 18. present due to the height of to the height of billboard to be the overpass visible from BE IT FURTHER RESOLVED, that application for variance VN85- 48 is hereby approved subject to the following conditions: 1. As proposed by the applicant, advertising on the billboard w~11 not include liquor or cigarettes. ~. 2. Staff in sign. Naegele Outdoor Advertising will meet with designing a sign identifying Hopkins below the the City main 3. Naegele proposes to allow the City of Hopkins to use two faces of the sign or any other Naegele sign in Hopkins for one month or one face of the sign or any other Naegele sign in Hopkins for two months during each year, without cost to the City. WHEREAS, the procedural history of the application is as follows: 1. That a request for rezoning ZN85-40 was requested by the Clty of Hopkins on November 2, 1986. 2. That the City of Hopkins Planning Commission reviewed such ap- plication on November 26, 1985. 3. That the City of Hopkins Planning Commission, pursuant to pub- lished and mailed notices, held a public hearing on November 26, 1985; all persons present at the hearing were given an opportunity to be heard. 4. That the written comments and analysis of the City Staff and the Planning Commission were considered. NOW THERFORE BE IT RESOLVED, that the City of Hopkins City Council makes the following Findings of Fact in respect to ZN85-40: 1. Ellen Lavin, Mayor CITY OF HOPKINS HENNEPIN COUNTY, MINNESOTA RESOLUTION NO. 86-6 RESOLUTION CALLING FOR PUBLIC HEARING ON AMENDMENTS INDUSTRIAL DEVELOPMENT REVENUE BOND WHEREAS, a proposal has been made to this Council by the Borrower mentioned below to enter into certain amendments to the City's outstanding Industrial Development Revenue Bond (Standal Project), issued in the original principal amount of $900,000 ( the"Bond"), pursuant to the Minnesota Municipal Industrial Development Act, Minnesota Statutes, Chapter 474 (the "Act"): and WHEREAS, the completed and is proposed: and Project for which the bond was issued has been being operated substantially as initially ~. WHEREAS, it is necessary that this Council conduct a public hearing on said proposal and publish notice of said public hearing not less than 14 days prior to the date fixed for the hearing: BE IT RESOLVED by the City Council of the City of Hopkins, Minnesota, as follows: 1. Robert Anderson, Councilman ~ Charles Redepenning, Councilman CITY OF HOPKINS Hennepin County, Minnesota RESOLUTION NO: 86-8 A RESOLUTION OF THE HOPKINS CITY COUNCIL AMENDING THE 1990 COMPREHENSIVE PLAN FOR THE CITY OF HOPKINS UNDER MINNESOTA STATUTES 462.351 to 461.364 WHEREAS, the Planning Commission of the City of Hopkins approved the 1990 Comprehensive Plan on September 9, 1980, based on statutes, the Metro- politan System Statement, extensive research, and analysis involving the interests of citizens and public agencies, and WHEREAS, the use of such Comprehensive Plan will insure a safer, more pleasant, and more economical environment for residential, commercial, in- dustrial, and public activities and will promote the public health, safety, and general welfare, and, . WHEREAS, said Plan will prepare the community for anticipated desirable change, thereby bringing about significant savings in both private and pUblic expenditures, and, WHEREAS, the Comprehensive Plan has taken due cognizance of the planning activities of adjacent units of government, and, WHEREAS, the 1990 Comprehensive Plan is to be periodically reviewed by the Planning Commission of the City of Hopkins amendments made, if justified according to procedures, rules, and laws, and provided such amendments would provide a positive result and are consistent with other provisions in the Comprehensive Plan, and WHEREAS, the Planning Commission has comprehensively studied an amendment to the Comprehensive Plan and has conducted a publlC hearing on January 28, 1986, to consider a change in its 1990 Comprehensive Plan and approved such change, NOW THEREFORE BE IT RESOLVED by the City Council of the City of Hopkins that the 1990 Comprehensive Plan as previously approved by the Planning Com- mission and City Council of the City of Hopkins is hereby amended by amending the 1990 Comprehensive Plan at the following location from B-2, B-3 Business and I-I Industrial to R-6 Residential. I NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF HOPKINS, MINNESOTA, as follows: 1. The Council will consider the improvement of such street in accordance with the report and the assessment of Lots 15 thru 29, inclusive, Block 2, Lots 1 thru 30 inclusive, Block 3 and Lots 1 thru 30, lnclusive, Block 4, all in West Minneapolis Third Division; Parcels 23-117-22 13 0001, 23-117-22 13 0002, 23-117-22 13 0003, 23-117-22 13 0004, . which parcels are the easterly 168 feet of the Southwest Quarter (SW~) of the Northeast Quarter (NE~) lying south of State Highway #7 and north of West Park Addition for all or a portion of the cost of the improvement pursuant to M.S.A., Secs. 429.011 to Secs. 429.111, as amended, at an estimated total cost of the improvement of $20,670 for street construction and asphalt surface, $4,656 for concrete curb and gutter, and $3,250 for storm sewer; and will further consider the market value before and after said improvement, of the property affected thereby. 2.
