HOLD HARMLESS RESOLUTION IN CONJUNCTION WITH
STATE AID PROJECT NO. 132-346-10
WHEREAS, The City of Hopkins plan to construct State Aid
Project No. 132-346-10 on Eleventh Avenue where said Avenue
passes beneath the Soo Line Railroad, and
WHEREAS, the state aid standard roadway width would normally
be 52 feet from curb to curb, but this street needs to be 48
feet from curb to curb for compatibility with existing
improved adjacent street segments; thus necessitating a
request for a variance, and
o
WHEREAS, on August 4, 1987 , the Commissioner 'of
Transportation did grant the variance subject to a condition
precedent to approval that the City be obliged to save and
hold harmless the State, now therefore,
BE IT RESOLVED, that the city of Hopkins indemnifies, saves,
holds harmless and agrees to defend at its cost and expense
the state of Minnesota and all its agents and employees in
of an from any and all claims, actions or causes of actions
of any nature or character arising out of or by reason of,
in any manner, the reconstruction of MSAS 346 (Eleventh
Avenue) under the Soo Line Railroad (Engineers station 4 +50
to 14 + 00) in any manner than as a 52' wide street with no
parking permitted in accordance with Minnesota Rule
8820.9912.
Adopted by the City Council of the City of Hopkins,
Minnesota this 1st day of September, 1987.

RESOLUTION MAKING FINDINGS OF FACT AND APPROVING
APPLICATION FOR CONDITIONAL USE PERMIT CUP85-51
WHEREAS, an application for a Conditional Use
Permit CUP85-51 has been made by Mizpah United Church of
Christ, 412 Fifth Avenue North, to construct an addition to
the existing building.
WHEREAS, the procedural history of the application
is as follows:
o
1. That an application for Conditional Use Permit
CUP85-51 was filed with the City of Hopkins on
October 1, 1985.
2. That the Hopkins Planning Commission reviewed
such application on October 29, 1985.
3. That the Hopkins Planning Commission, pursuant
to mailed notices, held a public hearing on
October 29, 1985, at which time the hearing was
tabled; removed from the table and heard again
on August 25, 1987: all persons present at the
hearing were given an opportunity to be heard.
4. That the written comments and analysis of the
City Staff and the Planning Commission were
considered.
NOW THEREFORE BE IT RESOLVED, that the Hopkins
City Council makes the following Findings of Fact in respect
to CUP85-51:
1. That a church is a permitted use in an R-4
District.
2. That the addition meets the requirements for an
R-4 District.
