CITY OF HOPKINS Hennepin County, Minnesota RESOLUTION NO. 86-17 RESOLUTION MAKING FINDINGS OF FACT AND APPROVING APPLICATION FOR SUBDIVISION APPROVAL SUBD86-2 WHEREAS, an application for Subdivision Approval entitled SUBD86-2 has been made by Oakwood Development Company, to divide the property at Smetana Road and Feltl Court into two separate lots. WHEREAS, the procedural history of the application is as follows: 1. That an application for Subdivision Approval SUBD86-2 was filed with the City of Hopkins on February 28, 1986. 2. That the Hopkins Planning Commission reviewed such application on March 25, 1986. 3. That the Hopkins Planning Commission, pursuant to published and mailed notices, held a public hearing on March 25, 1986; all persons present at the hearing were given an opportunity to be heard. 4. That the written comments and analysis of the City Staff and the Planning Commission were considered. NOW THEREFORE BE IT RESOLVED, that the Hopkins City Council makes the following Findings of Fact in respect to SUBD86-2: 1. That the subdivision conforms with the requirements of an R-6 District. 2. That a Conditional Use Permit was granted for construction of a 324 unit apartment complex. 3. No variances are required. . BE IT FURTHER RESOLVED, that application for Subdivision SUBD86-2 is hereby approved subject to the following conditions: 1. A favorable outcome of the Environmental Assessment Worksheet. 2. Securing a driveway easement 3. The parcels havlng two, or as required by the Fire Marshal, access points for emergency vehicles. 4. The necessary easements are recorded. CITY OF HOPKINS Hennepin County, Minnesota RESOLUTION NO. 86-16 RESOLUTION MAKING FINDINGS OF FACT AND APPROVING APPLICATION FOR VARIANCE VN86-4 WHEREAS, an application for a Variance entitled VN86-4 has been made by Lawrence Flake, to construct a breezeway from house to garage with a lesser rear yard setback than required. WHEREAS, the procedural history of the application is as follows: 1. That an application for Variance VN86-4 was filed with the City of Hopkins on January 27, 1986. 2. That the Hopkins Planning Commission reviewed such application on February 25, 1986 and March 25, 1986. 3. That the Hopkins Planning Commission, pursuant to mailed notices, held a public hearing on Feburary 25, 1986 and continued on March 25, 1986; all persons present at the hearing were given an opportunity to be heard. 4. That the written comments and analysis of the City Staff and the Planning Commission were considered. NOW THEREFORE BE IT RESOLVED, that the Hopkins Clty Council makes the following Findings of Fact in respect to VN86-4: 1. That a unique circumstance is present due to the two large trees. 2.
