RESOLUTION NO. 86-36
RESOLUTION MAKING FINDINGS OF FACT AND APPROVING
APPLICATION FOR VARIANCE VN86-7
WHEREAS, an application for a Variance entitled VN86-7 has been made
by Jim Lindstrom, Hopkins Car Care, 404 Mainstreet, to construct an addition
with less than the minimum parking requirements.
WHEREAS, the procedural history of the application is as follows:

1. That an application for Variance VN86-7 was filed with the City
of Hopkins on May 30, 1986.
2. That the Hopkins Planning Commission reviewed such application on
June 24, 1986.
3. That the Hopkins Planning Commission, pursuant to mailed notices,
held a public hearing on June 24, 1986; all persons present at the
hearing were given an opportunity to be heard.
4. That the written comments and analysis of the City Staff and the
Planning Commission were considered.
NOW THEREFORE BE IT RESOLVED, that the Hopkins City Council makes the
following Findings of Fact in respect to VN86-7
1. That the parking requirements are an estimate of what the appli-
cant will need.
2. The leased parking area provides the applicant with sufficient
parking.
BE IT FURTHER RESOLVED, that application for Variance VN86-7 is hereby
approved subject to the following Condition:
1. The applicant provide sufficient off-street parking if it is deter-
mined to be necessary.

RESOLUTION MAKING FINDINGS OF FACT AND APPROVING
APPLICATION FOR CONDITIONAL USE PERMIT CUP86-4

WHEREAS, an application for a Conditional Use Permit entitled CUP86-4
has been made by Jim Lindstrom, Hopkins Car Care, 404 Mainstreet, for con-
struction of an addition over $75,000.
WHEREAS, the procedural history of the application is as follows:
1. That an application for Conditional Use Permit CUP86-4 was filed with
the City of Hopkins on May 30, 1986.
2. That the Hopkins Planning Commission reviewed such application on
June 24, 1986.
3. That the Hopkins Planning Commission, pursuant to mailed notices,
held a public hearing on June 24, 1986; all persons present at the
hearing were given an opportunity to be heard.
4. That the written comments and analysis of the City Staff and the
Planning Commission were considered.
NOW THEREFORE BE IT RESOLVED, that the Hopkins City Council makes the
following Findings of Fact in respect to CUP86-4;
1. That a parking variance was granted.
2. The proposed development meets the requirements ~or a Conditional
Use Permit.

BE IT FURTHER RESOLVED, that application for Conditional Use Permit
CUP86-4 is hereby approved subject to the following Conditions:
1. The applicant provide sufficient off-site parking if it is determine
necessary.
2. That a guardrail be provided along the west property line at the drop-
off area.
3. That drainage on the leased parking be provided to ensure that excess
water does not drain onto adjacent apartment property.
4. Waiver of the landscaping be granted as set forth on revised plan as
submltted.
5. Review and approval by the Director of Engineering and Fire Marshal.

RESOLUTION MAKING FINDINGS OF FACT AND APPROVING
APPLICATION FOR VARIANCE VN86-6

WHEREAS, an application for a Variance entitled VN86-6 has been made
by White Castle System, Inc., 540 Blake Road North, to reduce the required
parking.
WHEREAS, the procedural history of the application is as follows:
1. That an application for Variance VN86-6 was filed with the City of
Hopkins on June 6, 1986.
2. That the Hopkins Planning Commission reviewed such application on
June 24, 1986.
3. That the Hopkins Planning Commission, pursuant to mailed notices,
held a public hearing on June 24, 1986; all persons present at the
hearing were given an opportunity to be heard.
4. That the written comments and analysis of the City Staff and the
Planning Commission were considered.
NOW THEREFORE, BE IT RESOLVED, that the Hopkins City Council makes the
following Findings of Fact in respect to VN86-6:
1. Unique circumstances are present due to the storm water detention
,basin and the 351 easement,
2: A hardship exists due to the combination of the storm water detention
basin and 351 easement which prevents the applicant from expanding.

RESOLUTION FOR HEARING ON PROPOSED SPECIAL ASSESSMENTS
WHEREAS, by Resolution No. 86-25 passed and adopted by the Council
on May 20, 1986, the City Clerk and Engineer were directed to prepare
proposed assessments of the costs of improving various streets, avenues,
and thoroughfares and miscellaneous improvements in the City of Hopkins,
all as more fully described in Exhibit A. hereto attached and attached to
Resolution No. 86-25 and made a part hereof, and
WHEREAS, the said Clerk has notified the Council that such proposed
assessments have been completed and filed in his office for public inspection.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF HOPKINS, MINNESOTA,
as follows:
1. A hearing shall be held on August 5, 1986, to pass upon such
proposed assessments, and at such time and place, all persons owing property
affected by such lmprovements and assessments will be given an opportunity
to be heard with reference to such assessments.
2. The City Clerk is hereby directed to cause a Notice of the Hearing
on the proposed assessments to be published at least two weeks prior to the
hearing, and he shall state in the Notice the total cost of each of such
improvements.
Passed and adopted by the City Council of the City of Hopkins, this
1st day of July, 1986.

Road (11th Street South) from 11th Avenue South to the west City limits,
total cost being $251,563.20 of WhlCh $50,063,80 is proposed to be assessed

Section 25, Township 117, Range 22 (P.I.D. 25-117-22 33 0001); Lot 1, Block

$18,721.98 of which none is to be assessed.

11th Avenue South to the west City limits, total cost being $15,479.78
and the area proposed to be assessed being: West 1/2 of Southwest Quarter

(P.I.D. 25-117-22 33 0001); Lot 1, Block 1 Opus 2 Ninth Addition (P.I.D.

4. Project 82-13 Bridge construction on Smetana Road (11th Street South)
by the installation, landscaping and lighting of a secondary road -
pedestrian underpass bridge, total cost being $54,329.51 of which
$27,164.75 is proposed to be assessed to West 1/2 of Southwest Quarter
of Southwest Quarter, except road, in Section 25, Township 117, Range 22
(P.I.D. 25-117-22 33 0001); Lot 1, Block 1 Opus 2 Ninth Addition (P.I.D.
25-117-22 33 0003); Lot 1, Block 2 Opus 2 Ninth Addition (P.I.D. 25-117-22
33 0004); and all of Block 2 Davisons Addition to West Mlnneapolis
(P.I.D. 25-117-22 34 0032).
5. Tree removal at the following locations:
1. 730 Drillane Circle, Lot 4, Block 1 Drillane West, total cost
being $413.00 (P.I.D. 13-117-22 42 0046).
2. 209-211 21st Avenue North, Lots 19 and 20, Block 5, West Minneapolls
Third Division, total cost being $110.60 (P.I.D. 23-117-22 14 0134).
6. Mowing and maintenance at the following location:
1. Lot 30 except highway and Lot 31, Block 1, Park Valley 2nd Addition

NOTICE OF HEARING
The Hopkins City Councll will hold a hearing on Monday, June 16, 1986,
in the Council Chambers of the City Hall, 1010 Flrst Street South, Hopkins,
Minnesota, at 7:30 p.m. on a proposal to change the name of Excelsior Avenue
East and Second Street South (all of which is designated County State Aid
Highway No.3) to Excelsior Boulevard. The eastern terminus would be the
east City limits at Meadowbrook Road and the western terminus would be 20th
Avenue South.
All of the street address numbers on this stretch of road would be
changed to conform with the Minneapolis numbering system, from 7630 on the
east to 11600 on the west.
Also under consideration would be including that portion of Second Street
South, which street is immediately north of and adjacent to County State Aid
Highway No.3, from 5th Avenue South to 13th Avenue South, changing the name
of this street also to Excelsior Boulevard and changing the street address
numbers also.
If you are interested in this above matter, we ask that you appear at
this public hearing to be heard.

RESOLUTION NO. 86-4l
A RESOLUTION OF THE HOPKINS CITY COUNCIL
AMENDING THE 1990 COMPREHENSIVE PLAN FOR THE CITY OF
HOPKINS UNDER MINNESOTA STATUTES 462.351 TO 462.364
WHEREAS, the Planning Commission of the City of Hopkins approved the 1990
Comprehensive Plan on September 9, 1980, based on statutes, the Metropolitan
System Statement, extensive research, and analyses involving the interests of
citizens and public agencies, and
WHEREAS, the 1990 Comprehensive Plan was approved by the City Council on
September 16, 1980, and
WHEREAS, the use of such Comprehensive Plan will insure a safer, more
pleasant, and more economical environment for residential, commercial, industrial,
and public activities and will promote the public health, safety, and general wel-
fare, and
WHEREAS, said Plan will prepare the community for anticipated desirable change,
thereby bringing about significant savings in both private and public expenditures,
and
WHEREAS, the Comprehensive Plan has taken due cognizance of the planning
activities of adjacent units of government, and
WHEREAS, the 1990 Comprehensive Plan is to be periodically reviewed by the
Planning Commission of the City of Hopkins and amendments made, if justified accord-
ing to procedures, rules, and laws, and provided such amendments would provide a
positive result and are consistent with other provisions in the Comprehensive Plan,
and
WHEREAS, the Planning Commission has comprehenslvely studied an amendment to
the Comprehensive Plan and has conducted a public hearing on June 24, 1986 to con-
sider a change in its 1990 Comprehensive Plan and approve such change.
THEREFORE BE IT RESOLVED by the City Council of the City of Hopkins that the
1990 Comprehensive Plan as previously approved by the Planning Commission and City
Council is hereby amended by changing the 1990 Comprehensive Plan at the following
location from R-4 to B-3:
Lots 1-9; 40-42, Block 2, West Minneapolis
BE IT FURTHER RESOLVED, that approval of the amendment is contingent upon
approval by the Metropolitan Council.
