RESOLUTION NO. 86-44
CITY OF HOPKINS
HENNEPIN COUNTY, MINNESOTA
RESOLUTION MAKING FINDINGS OF FACT AND APPROVING
APPLICATION FOR VARIANCE VN86-9
WHEREAS, an application for a Variance entitled VN86-9 has been made by
James Marvy, 37/41 - 12th Avenue North to construct an addition which exceeds
the maximum building coverage.
WHEREAS, the procedural history of the application is as follows:
1. That an application for Variance VN86-9 was filed with the City of
Hopkins on July 3, 1986.
2. That the Hopkins Planning Commission reviewed such application on
July 29, 1986.
3. That the Hopkins Planning Commission, pursuant to published and
mailed notices, held a public hearing on July 29, 1986; all persons
present at the hearing were given an opportunity to be heard.
4. That the written comments and analysis of the City Staff and the
Planning Commission were considered.
NOW THEREFORE BE IT RESOLVED, that the Hopkins City Council makes the
following Findings of Fact in respect to VN86-9:
1. That a unique circumstance is present due to different elevations
and roof lines of the existing buildings.
2. That the negative impact of the variance will be minimized due to
the use of the addition.
BE IT FURTHER RESOLVED, that application for Variance VN86-9 is hereby
approved subject to the following conditions:
1. The addition is to be used primarily for storage.

RESOLUTION MAKING FINDINGS OF FACT AND APPROVING
APPLICATION FOR CONDITIONAL USE PERMIT CUP86-5
WHEREAS, an application for a Conditional Use Permit enetitled CUP86-5
has been made by James Marvy, 37/41 - 12th Avenue North to construct an
addition to the exdsting buildings.
WHEREAS, the procedural history of the application is as follows:
1. That an application for Conditional Use Permit CUP86-5 was filed with
the City of Hopkins on July 3, 1986.
2. That the Hopkins Planning Commission reviewed such application on
July 29, 1986.
3. That the Hopkins Planning Commission, pursuant to published and
mailed notices, held a public hearing on July 29, 1986; all persons
present at the hearing were given an opportunity to be heard.
4. That the written comments and analysis of the City Staff and the
Planning Commission were considered.
NOW THEREFORE BE IT RESOLVED, that the Hopkins City Council makes the
following Findings of Fact in respect to CUP86-5:
1. The proposed addition meets the requirements for a Conditional Use
Permit.
2. The proposed addition meets the requirements of the R-4 District.
BE IT FURTHER RESOLVED, that application for Conditional Use Permit CUP86-5
is hereby approved subject to the following conditions:
1. A Variance is granted for building coverage.
2. The proposed addition is to be used primarily for storage.

RESOLUTION NO. 86-46
CITY OF HOPKINS
HENNEPIN COUNTY, MINNESOTA
RESOLUTION MAKING FINDINGS OF FACT AND APPROVING
APPLICATION FOR WAIVER OF PLAT WVR86-3
WHEREAS, an application for a Waiver of the Platting Requirements WVR86-3
has been made by Mike Briggs, 1615 and 1625 Fifth Street South, for the purpose
of dividing the property into two parcels to receive two tax statements.
WHEREAS, the procedural history of the application is as follows:
1. That an application for Waiver of the Platting Requirements WVR86-3
was filed with the City of Hopkins on July 10, 1986.
2. That the Hopkins Planning Commission reviewed such application on
July 29, 1986.
3. That the Hopkins Planning Commission, pursuant to mailed notices, held
a public hearing on July 29, 1986; all persons present at the hearing were
given an opportunity to be heard.
4. That the written comments and analysis of the City Staff and the Planning
Commission were considered.
NOW THEREFORE BE IT RESOLVED, that the Hopkins City Council makes the
following Findings of Fact in respect to WVR86-3:
1. That the Waiver of the Plat will form two conforming lots.
2. That the proposed lots conform to all requirements of the City
Zoning Ordinance.
BE IT FURTHER RESOLVED, that application for Waiver of Platting Requirements
WVR86-3 is hereby approved subJect to the following condition:
1. Approval of the plat by Hennepin County.

RESOLUTION MAKING FINDINGS OF FACT AND APPROVING
APPLICATION FOR SUBDIVISION APPROVAL SUBD86-2

WHEREAS, an application for Subdivision Approval entitled SUBD86-2
has been made by Marvel Eggum for 0 & E Ventures for subdivision of the
property at One Loring Road.
WHEREAS, the procedural history of the application is as follows:
1. That an application for Subdivision Approval was filed with the
City of Hopkins on April 3, 1986.
2. That the Hopkins Planning Commission reviewed such application
on April 29, 1986.
3. That the Hopkins Planning Commisslon, pursuant to published and
mailed notices, held a public hearing on April 29, 1986; all
persons present at the hearing were given an opportunity to be
heard.
4. That the written comments and analysis of the City Staff and
the Planning Commission were considered.
5. That the City Council approved the Preliminary Plat on May 6, 1986.
NOW THEREFORE BE IT RESOLVED, that the Hopkins City Council makes the
following Findings of Fact in respect SUBD86-2:
1. That the subdivision does conform to the Platting Requirements of
the City of Hopkins, therefore the City Council approves the
Subdivision.
with the Condition that:
1. Access be provided from Minnetonka Boulevard.

RESOLUTION NO. 36-48
RESOLUTION ADOPTING ASSESSMENTS
WHEREAS, pursuant to proper notice published and given as required by law,
the City Council of the City of Hopkins has met and heard on August 5, 1986,
and passed upon all objections to the proposed assessments for the improvement
of various streets, avenues, and thoroughfares and miscellaneous improvements
in the City of Hopkins, all as more fully set forth and described in Exhibit
A. attached to Resolution No. 86-25 adopted the 20th day of May, 1986 and
Resolution No. 86-39 adopted the 1st day of July, 1986, and
WHEREAS, each of said improvements as set forth in Exhibit A. hereto
attached, were presented and considered by said Council separately at said
meeting and each separately accepted and adooted by unanimous vote of said
Hopkins Council:
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF HOPKINS, MINNESOTA,
as follows:
1. Such proposed assessments, a copy of which is attached hereto and
made a part hereof and hereby accepted and shall constitute the special assess-
ments against the lands therein named and each tract of land therein included
is hereby found to be benefltted by the proposed improvement in the amount of
the assessment levied agalnst it.
2. Such assessments shall be payable in equal, annual installments
extendlng over the periods of years set forth in the Schedule of Assessments,
the first of the installments to be paid with the real estate taxes due and
payable in 1987. Any deferred installments shall bear interest at the rate
as set forth in said Schedule of Assessments from the 1st day of October, 1986.
To the first installments shall be added interest on the entire respective

3. The owner of any property so assessed may at anytime after the adoption
of the assessments and before November 15th, pay the whole of the assessments
against any parcel to the City Manager, and no interest shall be charged if the
entlre assessment is paid before November 15th. Also, the owner of the
property may at anytime thereafter, except between November 15th and December
31st of each year, pay to the City Manager, the entire amount of the assessment
remaining unpaid.
4. The Clerk shall forthwith transmit a certified duplicate or dupllcates
of these assessments to the Hennepin County Auditor to be extended on the proper
~ tax lists of the County, and such assessments shall be collected and paid over
the same manner as other municipal taxes.
Passed and adopted by the Council of the City of Hopkins, Mlnnesota, thls

5. Tree removal at the following location:
