CITY OF HOPKINS Hennepin County, Minnesota RESOLUTION NO: 86-51 RESOLUTION MAKING FINDINGS OF FACT AND APPROVING THE APPLICATION FOR CONDITIONAL USE PERMIT CUP86-7 WHEREAS, an application for a Conditional Use Permit entitled CUP86-7 has been made by W. Pitt Rolfe, to construct an office building in excess of $75,000.00 on Second Avenue South & 7th Street. . WHEREAS, the procedural history of the application is as follows: 1. That an application for CUP86-7 was filed with the City of Hopkins on July 31, 1986. 2. That the Hopkins Planning Commission reviewed such application on August 26, 1986. 3. That the Hopkins Planning Commission, pursuant to mailed notices, held a public hearing on August 26, 1986; all persons present at the hearing were given an opportunity to be heard. 4. That the written comments and analysis of the City Staff and the Plannlng Commission were considered. NOW THEREFORE BE IT RESOLVED, that the Hopkins City Council makes the following Findings of Fact in respect to CUP86-7: 1. That the structure is the same building as previously proposed in August 1984. RESOLUTI ON NO: 86- 52 RESOLUTION MAKING FINDINGS OF FACT AND APPROVING APPLICATION FOR VARIANCE VN86- WHEREAS, an application for a Variance entitled VN86-11 has been made by R. L. Johnson Investment Company, to allow parking in the 75 foot front yard setback, for the proposed construction at Fifth Street South & Seventh Avenue. WHEREAS, the procedural history of the application is as follows: 1. That an application for Variance VN86-11 was filed with the City of Hopkins on August 15, 1986. 2. That the Hopkins Plannlng Commission reviewed such application on August 26, 1986. 3. That the Hopkins Planning Commission, pursuant to mailed notices, held a public hearing on August 26, 1986; all persons present at the hearing were given an opportunity to be heard. 4. That the written comments and analysis of the City Staff and the Planning Commission were considered. NOW THEREFORE BE IT RESOLVED, that the Hopkins City Council makes the following Findings of Fact in respect to VN86-11: 1. A unique circumstance is present due to the shape of the lot 2. The negative impact of the variance will be reduced due to the fact the building has a 751 minimum setback 3. Elevation will provide screening of the project. Adopted this 2nd day of September, 1986. CITY OF HOPKINS Hennepin County, Minnesota RESOLUTION NO. 86- 53 RESOLUTION MAKING FINDINGS OF FACT AND APPLICATION FOR CONDITIONAL USE PERMIT CUP86-8 WHEREAS, an application for a Conditional Use Permit entitled CUP86-8 has been made by R. L. Johnson Investment Company, to construct an office/warehouse facility as Fifth Street South & Seventh Avenue. WHEREAS, the procedural history of the application is as follows: 1. That an application for Conditional Use Permit CUP86-8 was filed with the City of Hopkins on August 15, 1986. 2. That the Hopkins Planning Commission reviewed such application on August 26, 1986. 3. That the Hopkins Planning Commission, pursuant to published and mailed notices, held a public hearing on August 26, 1986; all persons present at the hearing were given an opportunity to be heard. 4. That the written comments and analysis of the City staff and the Planning Commission were considered. NOW THEREFORE BE IT RESOLVED, that the Hopkins City Council makes the following Findings of Fact in respect to CUP86-8: 1. The development meets the minimum I-I requirements. 2. The development meets the requirements for a Conditional Use Permit. BE IT FURTHER RESOLVED, that applicati~n for Conditional Use Permit CUP86-8 is hereby approved subject to the following conditions: 1. Approval by the Watershed District. 2. Approval by the Fire Marshal. 3. That the dralnage plan be approved by the Director of Engineering. 4. Sixty feet of evergreen plantings be added on each side of the plan of the north-south plantings on the Seventh Avenue perimeter. 5. Plan to incorporate low evergreens against the building. 6. CITY OF HOPKINS Hennepin County, Minnesota RESOLUTION NO. 86-54 A resolution approving Modification #4 of the financing plan for the original Hopkins CBD Redevelopment Tax Increment District (North Sector Project) Whereas, lt has been the lntent and deslre of the City Council of the Clty of Hopklns to improve the conditions wlthin the City of Hopkins. Whereas, the Housing and Redevelopment Authority of Hopklns, Minnesota (the Authority), has now prepared a modiflcatlon of the tax lncrement flnancing plan to include a parklng structure for the Clty of Hopklns, Minnesota dated August II, 1986 WhlCh detalls the followlng action: . 1. Modiflcatlon #4 of the Financing Plan for the Orlglnal Hopkins CBD Redevelopment Tax Increment Dlstrlct (North Sector Project); as addendum A to the document tltled: Modiflcatlon #3 to the Hopklns CBD Redevelopment Project Boundary and Create Tax Increment Distrlct and Adopt Financing Plan for the CBD South Sector Project and Modlficatlon of the Flnancing Plan for the Original Hopkins Redevelopment Tax Increment District (North Sector Project), Dated: November 15, 1985. Whereas, the Clty Zoning and Plannlng recelved a copy of the Modiflcatlon #4 and the opportunity to reVlew and comment and oplnlon has been presented to the Hopklns City Commission has has been given said written Councll. Whereas, the Hopklns Housing and Redevelopment Authority has informed the members of the local School Board of the Independent School Dlstrlct #274 and the Board of CommlSSloners of Hennepin County of the modiflcatlon. Whereas, a publlC hearing was held on September 3, 1986 at 7:30 p.m. before the City Council in the Councl1 Chambers in the Clty Hall, ln Hopklns, Minnesota, notice of WhlCh had been publlshed once ln the offlcial newspaper for the City, not less than ten, no more than thlrty days prlor to September 3, 1986. Now, Therefore Be It Further Resolved, By the City Councl1 of Hopkins that: the City of Hopklns does hereby approve ln all respects the Modlflcatlon of the Financlng Plan for the Origlnal Hopkins CBD Redevelopment Tax Increment Dlstrict (North Sector Project) to lnclude a parklng structure. Be It Further Resolved, that said approval is based upon the followlng flnding: 1. that the redevelopment plan conforms to a general plan for the development as of the City as a whole; 2. the proposed actlvity wl11 be undertaken in order to elimlnate bllghtlng influences WhlCh impede potential development; 3. to provlde maXlmum opportunity for redevelopment by private enterprlse ln a manner conslstent with the needs of the Clty of Hopklns as a whole and to encourage prlvate rehabllitatlon of structures within the area; 4. to accomplish flnancially feasible development or redevelopment the Houslng and Redevelopment Authority ln and for the Clty of Hopklns has been glven certaln powers pursuant to Minnesota Statutes, 462.411 et seq. 5. the Authority lS not prohibited in the use of revenues from tax increments for the constructlon or renovation of a parking structure, pursuant to Mlnnesota Statutes, Sectlon 273.75, Subd. 4, 11mltatlon on use of tax lncrement. Now Therefore Be It Further Resolved, that Modlfication #4 of the Flnancing Plan is approved for the Orlglnal Hopkins CBD Redevelopment Tax Increment Distrlct (North Sector Project). Now Therefore Be It Further Resolved, that the Modificatlon is now on file wlth the City Clerk is approved and the Mayor and City Manager are authorized to execute and deliver the Modlfication plans on behalf of the City. CITY OF HOPKINS Hennepin County, Minnesota RESOLUTION NO. 86-55 A RESOLUTION SUPPORTING UNITED WAY1S SALUTE TO SMALL BUSINESS WHEREAS, the United Way of Minneapolis Area currently provides funding to nearly 390 programs in 107 agencies, many located in and serving suburban communities. For example, in the Hopkins area agencies such as Vail Place and the Sojourner Shelter provide programs ranging from vocational training and job placement to a program at a battered women's shelter designed to re- duce the impact of family violence on children through counseling, support group services, education and advocacy; and WHEREAS, the efforts of thousands of community volunteers enable the United Way to maintain fundraising and administrative costs under nine cents to a dollar; and . WHEREAS, in 1986 funds are being distributed to guality programs that reach more people in suburban communities. The United Way works with county planning boards and private planning groups to identify gaps in service in a continuing effort to meet the comprehensive needs of people in the six county service area. BE IT RESOLVED, that the Mayor and City Council of Hopkins hereby support United Way1s Salute to Small Business, Wednesday, September 17, 1986, in the Hopkins community and encourage local business and their employees to partici- pate in this event. Adopted by the Hopkins City Council, thlS 2nd . . - CITY OF HOPKINS Hennepin County, Minnesota RESOLUTION 86-56 RESOLUTION PROVING PETITION FOR AND ORDERING IMPROVEMENTS WHEREAS, Hopkins House 4, Inc., a Minnesota corporation d/b/a Hopkins House has petitioned for an improvement consisting of the installation of a fire protection system pursuant to Minnesota Statute 1429.031, subd. 3; and WHEREAS, the petition and accompanying documents thereto complies with the requirements of the aforementioned statute. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF HOPKINS: 1. Such improvement is hereby ordered as proposed and requested in the petition. 2. That the Director of Engineering, Gordon Anderson, and Fire Marshall, George Magdal, be directed to review and approve the plans and specifications accompanying the petition for the construction and installation of the fire protection system. 3. That said installation and construction be in conformance with Minnesota Statute Chapter 429 and all state and municipal codes, ordinances and regulations pertaining thereof. 4. That periodic inspections be conducted by the City of Hopkins to assure compliance with said codes and requirements. That the Hopkins Zoning Ordinance No. 427.06 be and the same is hereby amended by additing the following provisions: 427.06 (10) A non-conforming use shall not be extended but an addition to a permitted use shall not be deemed the extension of a non-conforming use, if the addition meets all other provisions of this ordinance. (11) An existing non-conforming structure in which a permitted use is conducted on a lot of sub-stand- ard size may be improved if such improvement meets all other provisions of this ordinance.
