RESOLUTION NO. 85-3217
RESOLUTION RELATING TO CHAPTER 349 OF MINNESOTA STATUTE
RELATING TO LOCAL REVIEW AND ACTION OF A LICENSE ISSUED
BY THE STATE CHARITABLE GAMBLING CONTROL BOARD
R E C I TAL S:
a. The State of Minnesota amended Chapter 349 of Minnesota
States in April 1984 relating to lawful gambling by creating
a statewide charitable gambling control board to regulate
and license gambling activities.
b. The ef fecti ve date upon which the char i table gambl ing
control board assumes such responsibility was March 1,
1985.
c. Minnesota Statute 349.213 allows the City of Hopkins to
adopt more stringent regulation of lawful gambling within
its jurisdiction and to adopt resolutions disapproving
issuance or renewal of such licenses.
d. The City of Hopkins has heretofore issued certain bingo and
gambling licenses to fraternal and religious non-profit
corporations holding a private club or on-sale liquor
license issued by the City who conducts their activities on
premises either owned or leased exclusively by such
corporations.
e. Minnesota Statute 349.11 defines the purpose of the statute
to prevent commercialization of legal forms of gambling and
Minnesota Statutes 349.18 permits an organization to conduct
lawful gambling only on premises it owns or leases.
f. Minnesota Statute 349.12, subd. 14 and Minnesota Statute
349.20 requires lawful gambling to be supervised by a
gambling manager who has been a member of a charitable
organization for at least two years.
g. Rule 7860.0100, subd. part 2 of the rules adopted by the
State Charitable Gambling Control Board provides no lawful
gambling should be set up or otherwise operated in
conjunction with business conduct by the charitable
organization.

h. The City of Hopkins has promulgated a policy based on the
aforementioned recitals prohibiting charitable organizations
from conducting its licensed gambling operation by lease or
otherwise on the premises of another private club or on-sale
licensees.

i. The City Police Department has expressed serious concern
over the Department's ability to provide controlled
supervision and inspection of additional gambling activities
within the City.
THEREFORE, BE IT RESOLVED that the City of Hopkins
disapprove
the issuance of a license by the State
Charitable Gambling Control Board to
Family Plus, Inc.
BE IT FURTHER RESOLVED a certified copy of this Resolution
be submitted promptly to said Board by the City Clerk.
Adopted by the City Council of the City of Hopkins on the 1st day
of October, 1985.
