ADOPTION OF A POLICY STATEMENT CONCERNING REVIEW AND APPROVAL
OF LICENSES ISSUED BY THE STATE CHARITABLE GAMBLING
CONTROL BOARD UNDER M. S. ~ 349.11 ET SEQ.
WHEREAS, THE City Council of the City of Hopkins desires to
regulate charitable gambling in the City of Hopkins.

City of Hopkins hereby adopts the attached statement of policy

STATEMENT OF POLICY IN THE APPLICATION OF MINNESOTA
STATUTE CHAPTER 349 IN THE CONSIDERATION FOR APPROVAL OF
LAWFUL GAMBLING LICENSES BY THE STATE OF MINNESOTA CHARITABLE
GAMBLING CONTROL BOARD
1. Except as otherwise enumerated herein, the provisions
of Minnesota Statute Chapter 349 relating to the
definition of terms, licensing and restrictions of
gambling are adopted and made a part of the statement
of policy promulgated by the City of Hopkins as if set
out in full.
2. An applicant for a license shall be a fraternal,
religious, veterans or other non-profit organization
engaged in a lawful purpose defined in M. S. Section
349.12, Subd. 11.

The organization defined in Paragraph 2 must be
engaged actively in pursuit of the lawful purpose
defined in said Subdivision 11 for the benefit of the
community within the City of Hopkins for at least five
years on a perpetual continuous uninterrupted basis
and have at least 30 active members.

carried on only wi thin premises owned, occupied or
leased by the organization and within which premises
the principal business or regular meetings are
conducted except such activities permissible under a
single use license as provided for in Paragraph 5.
5. The City may waive the requirements imposed upon an
applicant in Paragraph 4 if the gambling activity
intended by the applicant is limited to a period of
one year to a single use for the conduct of either
bingo or raffles.

Except for licenses issued under Paragraph 5, the
operation of gambling devices and conduct of bingo and
raffles licensed or approved pursuant to the authority
granted to the City of Hopkins shall be carried on
under the supervision of a gambling manager designated
by the organization. The gambling manager shall be
responsible for the operation of the gambling activity
and the receipts and profits generated from the
operation.

The gambling manager shall provide the ci ty wi th a
fidelity bond in the sum of $10,000.00 in favor of the
organization granted the gambling license. The
gambling manager shall be an active member of the
organization issued the license and shall qualify
under state law.
