Staff Flndlngs & Comments: Anderson-Kerrlgan
1. Applicant is requesting a variance to construct a 18' x 30' addition to existing
garage of 18' x 22'. The property is located at 1413 Cambridge Street and lS
zoned R-2.
2. The applicant is proposlng a 30 foot addition to the existing garage. This
addition would decrease the rear yard setback from existing 33'6" to 3'6".
The side ya rd on the proposed add it ion wou 1 d range from 4 I 2" to 3 I .
3. Ordinance 427.08(4) states that no detached accessory building in any district
shall be located closer than two feet from any side or rear lot line. The pro-
posed addition will be withln the mlnimum setback requlrements.
4. The current garage is 396 square feet. The square footage with the proposed
addition will consist of 936 square feet.
5. Ordinance 427.08(3) states that accessory buildlng to a residentlal structure
shall not exceed an aggregate area of 528 square feet. A variance of 408 square
feet is needed.
6. The site of the proposed addition is 8160 square feet. Ordlnance 427.07 makes
the site a legal lot. However, the mlnimum required lot size for a lot if it
were platted in an R-2 District today is 12,000 square feet.
7. Ordinance 427.23 states that variances shall be approved only by circumstances
unique to the property under consideration would cause undue hardship to owner.
The applicant has stated that here is no undue hardship realized.

Our lnsurance on traller would be less lf lt were
stored.
The two dlfferent sheds we have had were damaged In
storms, plus a garage lS more secure than a shed.

Request: Condltional Use Permit to construct a Share Health Clinic building
STAFF FINDINGS & COMMENTS: Anderson-Kerrigan
1. Applicant is requesting a Conditional Use Permit to construct a medlcal clinic.
427.26(c) requires a Conditional Use Permlt for new construction over $75,000.
2. The subject site is located at Seventh Street South and Second Avenue South.
The slte is zoned B-1, Limlted Business.

3. The proposed buildlng is to be 13,400 square feet and constructed of brick
and cedar siding. The height of the proposed structure will be 22 feet. The
building will have a canopy over the entrance extending in a northwest direction.
The canopy is made of metal and will be painted a copper color.
4. The structure as presented would have a 251 foot front yard setback, a 20-30
foot rear yard setback, a 156-188 foot sideyard setback to the west and an
easterly side yard varying from 15 to 90 feet. These setbacks comply with
the requlrements of 427.35.
5. The nursing home is located to the south of the subJect slte, single famlly
homes to the west, buffered by trees, an empty lot to the north, and Highway 18
to the east.
6. 134 parklng stalls are to be provided with an entrance/exit from the southwest.
14 compact stalls are provided along with 5 handicap stalls. The number of
parking stalls are in compliance with ordinance 427.45(13) which requires at
least three (3) parking spaces for each staff doctor or dentist or one (1)
space for each one hundred and fifty (150) square feet of gross floor area,
whichever is greater. The ordinance requires 190 parking stalls based upon
the square footage requirements.
7. Ordinance 427.23(7) requlres parking space shall not be less than 9 feet in
width and 20 feet in length. The requirements for compact cars are 8 feet by
16 feet. The parking spaces are 18 feet in length however the parking islands
provide the additional length.
8. The parklng lot is to contaln five lights. Any lights will have to conform
with ordinance 427.44(2) any lighting used to illuminate an off-street parking
area shall be shaded or defussed so as to reflect the light away from the ad-
jOlning property and away from abutting traffic.
9. The interior of the parking lot will be landscaped wlth rocks and trees. The
exterior of the parking lot will be screened wlth a variety of over and under-
story trees. The retaining wall will be constructed along the north, northeast
and northwest side of the site.

10. The dralnage plan has been revlewed by the City Engineer and has been found
acceptable. Dralnage wlll flow in a southwesterly dlrection on the slte.
11. The Fire Marshal has reviewed the plans and noted that the bUlldlng must be
sprinkled, any other Fire Code requlrements wlll have to be complied wlth at
the bUlldlng permit stage.
12. A sign is shown on the plan withln the sideyard setback ln violatlon of
427.42(3). If the applicant receives approval of a Condltional Use Permlt
for constructlon of the subject buildlng, he would have to apply for a sign
permit prior to erectlng the sign, and at that time, if it was determined
that the sign dld in fact not comply with any of the requirements of 427.42,
Signs, Advertising Lights and Devlces, the applicant would be requlred to
receive approval of a variance or additional Conditional Use Permit.
13. Ordinance 427.35 requires a maximum Floor Area Requirements of 1.0. The pro-
posed building has a F.A.R. of .12 which meets the requirements of the ordln-
ance.
14. Trash storage is to be at the rear of the buildlng and below ground level.
This area is sheltered from the publlC Vlew.
15. Access to the proposed site wlll be ln the southwest corner from Second Avenue
South.
16. The Assistant Englneer has noted the applicant be requlred to obtain an easement
for maintenance and occupation of water and sanitary sewer along the southbound
ramp.

Mr. Hatten owns a lumber and construction company ln Stacyvllle
Minnesota. This wlll be hlS first venture lnto this type of retail
buslness. Hopklns Bowl has agreed to train Mr. Hatten for a tlme
until he better understands the management of the operation.
All investigatlon would lndlcate that Mr. Hatten would be a very
capable and able holder of the buslness licenses that he seeks.
Pollce department would recommend approval.
