ORD. 84-537 (ALCOHOLIC CONSUMPTION IN PUBLIC) o o Q CITY OF HOPKINS Hennepin County, Minnesota ORDINANCE 84 - 537 AN ORDINANCE AMENDING SECTIONS 850 and 850.05 OF THE 1977 CODE OF ORDINANCES OF THE CITY OF HOPKINS PERTAINING TO DISPLAY OR CONSUMPTION OF ALCOHOLIC BEVERAGES IN A PUBLIC PLACE BE IT ORDAINED by the Council of the City of Hopkins as follows: That Sections 850 and 850.05 of the 1977 Code of Ordinances of the City of Hopkins be and the same are hereby repealed and there is hereby enacted and adopted in place thereof the following: SECTION 850: DISPLAY OR CONSUMPTION OF ALCOHOLIC BEVERAGES IN A PUBLIC PLACE Subdivision 1: DEFINITIONS. (a) PUBLIC PLACE, for the purpose of this Ordinance; shall mean and include any and every pub I ic road, publ ic bu ilding, highway, alley, sidewalk, street, avenue, driveway, or other thoroughfare; every public parking lot or area, schoolgrounds -public or private; and any private parking area or property which contains signs or is otherwise posted prohibiting loitering or trespassing thereon; except that any such locations which are temporarily permitted, licensed, or otherwise authorized for public or private use in connection with celebrations, Fairs, Bazaars, or other special events or activities, are hereby excepted during such events or activities. (b) ALCOHOLIC BEVERAGES, for the purpose of this Ordinance shall mean and include all distilled, fermented, spiritous, vinous and malt beverages including, but not by way of limitation, non-intoxicating malt liquor as defined in Minnesota Statutes ~ 340.001, subd. 2; intoxicating ..... .. o o o \ malt liquor as defined in Minnesota Statutes B 34 0 . 4 0 1, s u bd . 2 ; and in to x i c at in g I i quo r as defined in Minnesota Statutes B 340.07, subd. 2. Subdivision 2. VIOLATIONS. The consumption, exchange or service of any and all alcohol ic beverages is hereby prohibited in any public place in the City of Hopkins. For the purpose of this Ordinance, consumption, exchange or service of alcoholic beverages shall include the possession of any bottle or receptical containing alcoholic beverages which has been opened, or the seal broken, or the contents of which have been partially removed, for the purpose of consumption, exchange or service in a public place. Any violation of this Ordinance shall constitute a petty misdemeanor.
