ORDINACE 85-548 , ~ - . e CITY OF HOPKINS Hennepin County, Minnesota ORDINANCE NO. 85-548 AN ORDINANCE REPEALING SECTION 409 OF THE HOPKINS CODE AND AMENDING ZONING ORDINANCE 427 PERTAINING TO SIGNS AND BILLBOARDS BE IT ORDAINED, by the City Council of the City of Hopkin~ as follows: That Section 409 of the Hopkin$ Code and amendments thereto Ordinances No. 80-479 and 82-514 are hereby repealed. Thatthe Hopkins Zoning Ordinance No. 427 be and the same is hereby amended as foll ows: That subsections 1, 15 and 16 of Section 427.42 of the Hopkins Zoning Ordinance be and the same is hereby amended by revision and there is hereby enacted and adopted in place thereof the following subsection: 427.42 (1) All outdoor signs in existence and those proposed to be erected pursuant to this Ordinance in all zoning districts shall be governed by the provisions of the Hopkins Zoning Ordinance and such other ordinances and regulations as may be enacted. (15) Applications for other proposed sign permits involving a lesser setback than that required by the Hopkins Zoning Ordinance, may be granted only by and under a Conditional Use Permit as defined in Section 427.04(26) and under the applicable provisions and regu- lations of Conditional Use requirements set forth in Section 427.26 of the Hopkins Zoning Ordinance which Conditional Use Permits may require periodic reviews and may be cancelled for cause. (16) Sign Permit: No signs permitted by this Ordinance shall be erected or malntained without the existence of a valid permit issued therefor by the City of Hopkins. That Section 427 of the Hopkins Zoning Ordinance pertaining to signs, adver- tising lights and devices is hereby amended by adding the following provisions: 427.42 (18) 4.a DISTRICT/USE: B-2; PERMITTED TYPE OF SIGN: Name plate or symbol in the shape or form that denotes the nature of the business being conducted within, at right angles to the building wall are permitted at intervals of not less than 15 feet; ILLUMINATED: No; MAXIMUM AREA OF SINGLE SIGN: The area of such signs shall not exceed three square feet and shall extend no more than twenty-four inches (24") from the wall or side of the building to which said sign is attached and shall be mounted no lower than ten feet (10') from the sidewalk; TOTAL AREA OF ALL SIGNS: 2 square feet per front foot of building abutting a public right-of-way 50 feet or more in width. (22) Repairs: Every billboard or sign located in this municipality which may now be or hereafter become out of order, deteriorated or unsafe, and every billboard or sign which shall hereafter be erected, altered, resurfaced, reconstructed or moved contrary to the provisions of this Section, shall be removed or otherwise properly secured in accordance with the terms of this Section by the owners thereof or by the owners of the ground on which said billboard or sign shall stand, upon receipt of proper notice so to do, given by the City Manager, and no such billboards shall be repaired or rebuilt except in accordance with the provisions of this Section and upon a permit issued by the City Manager. . . -... - .. - (23) Removal: In the event of the failure of the owner or person, company or cor- poration having control of any billboard or sign, or the owner of the ground on which the billboard or sign is located, to remove or repair said board or sign within the time stated in such notice, the same may be removed by the municipality at the expense of the owner or manager of said board or sign, or the owner of the ground upon which such billboard or sign stands.
