STAFF FINDINGS & COMMENTS: Kerr1gan - Norris
1. The subject property 1S a vacant parcel located east of County Road #73,
north of the Union 76 Service Station on H1ghway #7 and west of the exist1ng
Hopkins House Annex Commerc1al Center. The property is presently zoned B-3
Commerc 1 a 1.
2. The appl1cant 1S proposing to construct a retail llquor store on the subject
parcel. The applicant presently operates the same type of bus1ness with1n
the commerc1al strip to the east.
3. The total slte conta1ns 27,830 sq. ft. and the proposed build1ng would contain
9348 sq. ft. for a bU1lding coverage of 336, which meets the Floor Area Require-
ment for B-3 distr1cts.
4. In accordance w1th Sect10n 427.45 of the Zoning Ordinance the following off-
street park1ng would be requ1red for the space as proposed:
Retail Space (7400 sq. ft.) 37 spaces (1 space per 200 sq. ft.)
Office/Warehouse (1948 sq. ft.) 5 spaces (1 space per 400 sq. ft.)
The appl1cant is proposing to prov1de 42 spaces (8 compact) which 1S 1n com-
pliance w1th the ordinance requ1rement.
5. The park1ng spaces would be located on the westerly and northerly boundaries
of the site. Along the westerly property lot line is a 10' ut1lity easement
which is acceptable for the parking use as shown. In accordance w1th 427.44
all off-street parking shall be required to be at least one (1) foot from the
lot llne, thus the curbing for the park1ng should be placed back approximately
3-4' into the park1ng space 1n order to take 1nto account the I' setback re-
qU1rement and the overhang of the veh1cle. The park1ng surface 1S to be
asphalt.
6. Access to the slte would be from two p01nts along 5th Street North.
7. In accordance w1th 427.04(64) the front yard of the proposed Slte would be the
northerly boundary llne. The follow1ng setbacks are proposed to be prov1ded:

8. The proposed bU1ld1ng 1S to be constructed of textured concrete block. A
decorative stucco facing and a llne of windows shall be alonq the west and
south sides. The ma1n customer entrance 1S to be located on west side with
a service/load1ng entrance on the northeast corner. The total proposed
build1ng he1ght 1S 16'.
9. The landscaping (trees and shrubbery) as shown on the plan would be placed on
the publ1C right-of-way along the north and west property llne and a port1on
of the southerly boundary llnes. If approved it would seem acceptable to have
the trees as shown w1thin the 5th Street North right-of-way, however, the
shrubbery should be moved back along the northerly property line. Any plant-
1ngs in the 5th Street North r1ght-of-way in accordance w1th City of Hopkins
Ordinance 650 would require a permit to be obta1ned from the C1ty Manager. The
landscaping along the County Road #73 right-of-way 1S under the Jur1sdiction of
Hennepln County and would requ1re their approval Any approval of this overall
plan could be subJect to the appl1cant submitt1ng an acceptable landscape plan
for thlS area to the County.
10. Surface dra1nage of the slte westerly to the publlC rlght-of-way 1S proposed.
The C1ty Eng1neer has reviewed th1S plan and found 1t acceptable.
11. Two 11ght standards are to be prov1ded on the slte w1th one on the southwesterly
corner and the other in the mlddle for the the northerly property llne. This
light1ng would be requ1red to conform with 427 44(2) of the zon1ng ordinance
WhlCh requ1res that llght1ng used to illuminate on off-street parking area shall
be shaded or d1ffused so as to reflect the 11ght away from the adjoining property
and away from abutt1ng traff1c.
12. For the northerly property llne the applicant would be required to comply with
427.44 which states that when a requ1red off-street park1ng area for SlX or more
cars 1S located in any "R" Dlstrict there shall be constructed and ma1ntained
a wall of suitable material of not less than three and one-half (3~') feet nor
more than SlX (6') feet 1n height to capture the vehlcle llght beams and muffle
the vehlcle n01se. It lS also recommended that 1f a CUP 1S approved the appll-
cant be requ1red to lmplement the above requ1rement along the westerly boundary
llne because some res1dentlal uses across County Road #73 as well as the overall
proxlm1ty of the park1ng to the roadway.
