At the February 22, 1983 meeting of the Zoning and Planning Commission, Mr. Schulz
of Dolphin Construction presented plans for a retial liquor store at the corner of
5th Street North and County Road 73. The commission recommended approval of a
Conditional Use Permit contingent on City and County approval of drainage plan,
County approval of landscape plan along the western property line, and locating
the landscaping on the north side inside the property line.
The County did not approve the landscape plan for the western property line. Dolphin
Construction is having the architect draw a plan for the type of and location of fence
to be constructed. A drainage plan has been submitted to the County and has been
reviewed by the Assistant City Engineer. To date, the County has not made any com-
ments. At the present time, Dolphin Construction has not submitted revised landscape
plans for the north side.

STAFF FINDINGS & COMMENTS: Kerrigan - Norris
1. On July 27, 1982, the Commission approved the preliminary plat known as Opus 2
Ninth Addition. This platting was done in conjunction with a concept review
and rezoning of the subject property.
2. The concept approval of the plan for the subject area was granted by the Com-
mission with the following changes requested:
a. the 10th Street extension within the subject site would be
cul-de-saced and that the existing 10th Street off 11th Avenue
South would only be used fer emergency access.
b. the office building presented on the concept plan be moved to
the west in order to preserve as many trees as possible to east
of the building.
c. relocation of the access point of the nursing home easterly
parking lot further west.
3. During the discussion it was stated the applicant should revise the concept plan
to reflect these changes at the time of final plat review by the Commission.
However, the only above change which would be of direct concern in approving
the final plan would be the 10th Street Cul-de-Sac (this concern has been
adequately addressed on the final plat). It would seem logical that the other
items be addressed at the actual pre-development stage when the applicant re-
quests a Conditional Use Permit. The applicant is aware from the concept review
meeting that the above concerns must be addressed prior to the City granting
a Conditional Use Permit.
